What's AP/AR markers? It's probably something obvious but I can't remember seeing this mentioned before. It's been a while since I heard anything on a thread that I subscribed to on here!
-
Mine are around the same time too, except for one which I stupidly left for a bit longer and annoyingly is my highest debt! My understanding is that it becomes SB 6 years after the last payment or any acknowledgement of the debt. You still need to keep on your toes though, some DCA's try a last shot at it! Good Luck and keep us posted.

Arrows/restons Claimform - MBNA 'debt'
Dotty50 replied to foxyflugel's topic in Financial Legal Issues
Hi Foxy, I'm sorry I've got problems with my computer so really struggling to assist, although it's been a while since I've had to deal with a claim. It's such short notice to get help so I would alert someone from the site team urgently and also find andyorch who I'm sure will help if he can. I think more history of this will be needed too. -
CitiBank, no CCA forthcoming.

Did you ever get a notice of assignment allets? If Cabot bought the debt, they can update the CRA's accordingly. Where have you been for the last 4 years? -
Roll on July!
-
Hi Ford SB should be July next year if I've got it right (last paid/acknowledged) ? I didn't pursue the ppi, I think other things took over at the time but I guess I could use it as a lever, should they get nasty! Fortunately this isn't a huge amount but still a concern as it's Lowells. They issued an SD on my OH last year but it was successfully set aside with some assistance.
-
I'm just updating this for anyone who reads it and wonders what happened. Having heard nothing since June 2010, I received a letter from Lowell Portfolio advising that they had purchased the debt, this was followed up by another letter from Cap 1 confirming sale. Lowells have sent another few letters asking for payment or a payment arrangement to which I have not yet responded. I always wonder if it is best to ignore (unless it's a threatening letter) so that my file stays at the bottom of the pile so to speak, rather than to keep bringing it to their attention. The Cap 1 account disappeared off Noddle (CRA) but has now returned under Lowells. Default date is Dec 09 and my last payment was July 09 so another few months to SB!
-
I remember a similar letter from someone but it's been such a long time ago, I really can't remember. I'm finding a bit of action being taken at the moment, phone calls and texts have started but I'm not losing any sleep certainly not like I was when getting here nearly six years ago!

We seem to have been here a few years now! I really think that your solicitors should have picked up on this, you simply can't trust these companies! Without going back through your thread, I don't know what happened with the court case but I think I would be informing them (or your solicitor should be!) that the offer of repayment was only ever made on the proviso of the removal of the history from the CRA's therefore the offer is no longer on the table.
-
Hi MeeBroke what is your solicitor doing about it? Surely, if the agreement of payment was on the basis of removing information on your credit file and they have reneged, then I would have thought that your offer no longer stands. Did you ever have written confirmation that they would remove it or was it just in your correspondence to them in which you stipulated it?

MBNA debt - Wright hassle / AK claimform
Dotty50 replied to rutland1's topic in Financial Legal Issues
It's been a while since I did mine but I drafted it in a word document and once I was happy with it and it was checked over on here I could just copy and paste it to the online form. I probably wouldn't leave it until the very last minute just in case of any issues when you go to submit it. I'm not sure if the court will accept it by fax? -
I put it down to the stress and implications of receiving a SD and the deadline looming! I know from experience that receiving a SD sends you into panic mode! Andy has been a great help to many on here, me included but there comes a point when he simply can't be everywhere for everyone I hope trout has managed to get things sorted.

MBNA debt - Wright hassle / AK claimform
Dotty50 replied to rutland1's topic in Financial Legal Issues
CB was going to alert Andyorch for you so you need to get in touch with him. You need to draft a defence applicable to your case but I can't advise on this because it's been a while since I had to do one so I wouldn't want to give you any incorrect information. At least this will bump your post and I'm sure someone will be along soon. -
SD's the last thing you want! I've got around a year on most of mine now and I can't believe how quickly the time has gone! The majority of the threads I subbed to when I found this site have all gone quiet so I don't spend much time on here now, one of the reasons is that things change and I don't feel that I have the knowledge to advise any more. I don't get much grief nowadays (touch wood) but generally the odd letter I get is not a major concern.

I guess you mean SB not SD?

MBNA debt - Wright hassle / AK claimform
Dotty50 replied to rutland1's topic in Financial Legal Issues
Who are the claimant's, Wright Hassell? They are in Leamington Spa so who's the company overseas? This really needs to be done asap because of the deadline for you to submit your defence. -
Hi Herigo, Responding to your pm. It's been a while since I've had to deal with a claim and as Andyorch says, the defences you are looking at will need updating so it will be better to find some more recent claims for reference. MK issued claims like confetti a couple of years ago, most of us defended and heard nothing more! They rely on the defendant not having a clue what to do so they get judgement by default. I'd be surprised if they are any different now and it's unlikely (although don't take it for granted) that they will have any paperwork. They also issued a claim to my OH but it was at a time that was difficult for us to defend alone so we used a solicitor and MK discontinued and cost them a lot of money! Now I'm subbing, if I can offer any help, I wil.l

We have to put up with men!!! -
If you haven't already done so, I would send a SAR probably to the OC and see what they come up with. It will cost you £10 but may explain the balance they are asking for now.

MKDP LLP Barclaycard debt from 2005 claimform - HELP PLEASE!
Dotty50 replied to sit down's topic in Financial Legal Issues
Hi sit down, how time flies! As Andy said in the previous post, allbeit two years ago, they do need to be able to justify their actions. When did you first hear from Marlins? They bought a lot of old Egg accounts from Barclays in recent months but no one seems to be getting much hassle from them as far as I know, although I don't tend to spend too much time on here of late so others may know different. I've never heard a thing on my MKDP claim since so maybe I'll be getting a letter too. I've heard of Mortimer Clarke but not had any dealings with them so can't comment on how they might proceed. I'm sure somebody else will be along to offer assistance, should it be required. -
Yes, I'll just wait and see what happens next, SB is my aim and that will be around May 16 so more than half way there! Thanks
