Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

That would no doubt tend to be the Moodys and Standard & Poor rather than Experian Equifax and the likes although they have a considerable amount of baggage attached to their paymasters too.

Everything moves very slowly, but the 'trickle down effect' has to start somewhere.

Sod the bus...we should get a nationwide campaign up / down there. Consumer Action Groups go postal on the debt collectors...I could even get a wee television crew for support.

 

We could organise our own awards outside...or possibly something even more interesting.... What debt collectors probably understand but don't take seriously is that their victims come from all walks of life and you really shouldn't get us angry.

I have no doubt they are aware that the writing is on the wall for some of them - but it's still some time away for UK DCA's.

 

So many USA owned/backed/influenced agencies are setting up here that the collection market is feeling a squeeze too, and only the ruthless are likely to survive.

 

Not much comfort for those people battling with them now, but change will have to come.

hi this is my first thread so hello and here goes...my husband received a letter roughly 4 months ago and it was from red dept collection saying he owed 1,497 pounds and he use to live at so !!!!!! address which may i add he has never lived at nor ever heard of it its states it was a dept from atleast 8 year ago,he laughed at put it in the bin then last weekend we received another saying the same blah blah if payment in full isnt made we will take matter further so this time he rang explaining calmly he has never lived at this address and to stop sending these letters she asked for him to send his signature which he did i presume to see if they have same signutures of whoever this dept is,these people red dept colletors are collecting for capital one,so he thought thats end of it then today he received another saying our client lowell portfolio ltd has offerd you a settlement on your figure for an attempt for you to settle your account in an amicable way that also saves you a large amount of money before further action is needed to be taken....i am ina position today to offer you an early settlement of 598.95 im sure you will agree this is a excellent offer,an offer i hope you are able to take advantage of....is only availible till 11th oct 07 unless funds are received and cleared by this date we will continue with other means of recovery this dept will not go away and repyment has to be made.......payment can be taken over the phone or cheque!!!!!!!!!!!!!!!!!!are these people completely dumb or what???????how thick are they how wrong are they whats going on????hasnt my husband explained he has never had dealings with capitak one or lived at the address they state im so ****ed off you wouldnt believe any ADVICE PLEASE GUYS XXX:( :-?

Please start a new thread of your own on this and we will be better able to help you. Your posting on this thread may get confused. Dont worry you are dealing with Lowells and they are easy to defeat. The alleged debt will be Statute Barred anyway and Clownells will not have any paperwork relating to it. They are just greedy ****

Which agency is it? You mention Red Dept Collections - Red Debt collections maybe? It might be useful to actually start your own thread and we'll pick it up from there.

I speak from experience, there's good money to be made in exhibitions. 10 years ago it cost my old company over £32K to have a stand at the NEC for a week, plus another grand for carpets but that's another story... :p

  • Barclays: WON!!! It took four months but was totally worth it!
  • Cabot: I'm still waiting for an enforcable agreement, more than a year after requesting it. Go on, Uncle Ken, take me to court if you dare. You know you want to!
  • Elephant.co.uk: VICTORY - they admitted there was no debt!
  • Ashbourne Management (gym membership): Finally got my default removed and out-of-court settlement; I'm not finished with them yet!

Yes, but stand outside and listen to the people who have paid it complaining it wasn't worth it!
