What is the value of the claim? 100.00 ? Amount Claimed 125.00 court fees 35.00 legal rep fees 50.00  Total Amount 210.00 Have you moved since the issuance of the PCN? No Did you receive a letter of Claim With A reply Pack wanting I&E etc about 1mth before the claimform? Y dated 10 March 2024, no reply
    • Obviously I'm ignorant and don't know the local area - but to me the images show the front of the car entering, and the rear of the car exiting, both times. On a second point - do you have any proof of your being elsewhere during the two times they reckon you were three hours in the car park? BTW, I've just done a search and we have 81 G24 threads apart from yours.  This is a company that huffs & puffs but very rarely does court.  In fact of the 81 cases, in 79 they haven't done court In one court case sadly the Cagger didn't defend and lost by default. In the second case G24 issued a court claim ...and then wet themselves and discontinued the case once the Cagger defended.
    • Often vehicle insurers will refuse to deal with third party property damage claims. They will by lack of willing rely on the third party to use their company Insurance  and the companies Insurance would try to reclaim through your Car Insurance. Agree with Ethel, but sometimes Insurance claims staff will try to avoid additional work.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Carlisle Combined Court

 

My case - stay refused last Thursday, but judge said that in most cases stays are being granted to await outcome of OFT case and in the interests of justice.

 

Clerk told me that in instances where an application for stay had been received by the bank already, cases were being adjourned. I didn't ask about those adjournments, sorry, because my case was going ahead the next day.

 

Note for others: as soon as I received a letter from DG saying they were applying for a stay, I got the denial of request for stay letter in to court. My letter was there in the hearing already, they had to turn up in person to submit their application because of the short time before hearing. Use their backlog against them and keep getting cases in to court!

I have just spoke to Canterbury Court and they are staying all cases are still going forward. As with Ashford Court the woman said all cases are still going to their hearings but they will all be stayed. Looks like it is a fight on my hands to try and not get a stay on my case then there ;) will get back to you as they are on 15th and 16th respectively.

Ashford County Court are staying claims if requested by the Bank, not automatically. However the DJ did instruct us to use the extra time to reach a settlement and told us she would award Wasted Costs against a party which refused.

 

Seems we are getting conflicting information from Ashford court staff!

 

Blazing-badger, could you post some more details on your case (on your own thread would be best I suppose). When was this? Did you attend a hearing? Did you attempt to resist a stay? Did you get anything in writing from court - if so, would you mind posting it? Any thoughts on how you are supposed to "reach a settlement"? Thanks.

Hi yes the DJ stayed my claim while awaiting the OFTs announcement, I told him that the OFT were ruling on bank accounts and not credit card claims but he was having none of it, citi had failed to comply for full disclosure so their defence should have been struck out, ive poosted the details on my thread groovycaz v citicards..Gc

I think u ought to copy the info & complain to OFT & FOS about this - they are obviously abusing the system! I've had the same thing happen but before my court hearing :)

looks like Telford County Court is now doing it. My Brother and auntie have had a letter from the court saying its been suspended until the outsome of the test case ARGH! Bit unfair really as thats a completely different case to theres.

 

Any idea how long it will be until we find out what happends?

Good work ICY.

I have just spoken to St.Helens County Court and its business as usual.

All cases that have been given dates already will go on as normal.Most of these are bulk hearings of which I have 2 myself on 6/7th September.

I think a number of other Courts will be doing the same and reviewing future new cases as the time goes on.

Some Courts appear to be hearing existing cases with dates,but not new ones.

I have updated the list above.

Keep adding your new info guys.

Called Stafford Combined Court today, gentleman I spoke to said the Judge will decide tomorrow on whether to stay or not, but he said it was likely there would be a blanket stay on all cases pending the outcome. :mad:

 

Will call on Thursday and will let you know the outcome.

 

Stoke on Trent are running on a case by case basis at the moment.

Update on this - new cases are being stayed.

 

If the bank asks for a stay they WILL be granted - we had a date for next Wednesday with Lloyds which has been stayed - they also basically told me not to waste my money appealing the decision. :(

I've had notification of a stay on my c/card claim with YBank after they requested one - I've written to them & the court & am also going to complain to OFT & FOS as the banks are obviously abusing the system! :-x

Just got back from Peterborough Court and here's what happened.

 

My claim is actually for default charges on my mortgage account rather than my current account - but the wonderful Abbey put in a defence against a current account claim so i ended up in the same hearing as all the other current account claimants.

 

Briefly, the DJ said that from now on, as long as the banks requested it, then he would be staying the cases. He also sits in Cambridge court as well and so I presume that Cambridge are doing the same also.

 

He also stated that he had spoken to the senior judge covering East Anglia (sorry can't remember the exact title) this morning and from what he said it seems that all the courts in East Anglia will be following suit.

 

He also said that a date has been set in the Commercial Court to hear the test case on January 27th and that 8 consecutive days have been set aside for this case. He spent some time telling people that this was a quite extraordinarily quick timescale for 8 days to be made clear in that court. He went on to say that he wouldn't expect the judge to make a ruling on the case until the end of February - so that they can do all their "consulting" - and that, whichever way it goes, it is expected to be appealled.

 

While I was there, several people did object to the stay but, I gather, none were successful. I went in after all these other people had been in and the DJ did look distinctly fed up by this stage!

 

When I was in with the judge, the barrister for Abbey (who, by the way, was a really friendly chap and not at all like some of the other descriptions I've read on here about people's experiences in court) mentioned that he had full details of the Test case and that it very clearly was just in relation to current accounts and that other products such as mortgages, loans and credit cards were not affected. So the judge ordered Abbey to submit a proper defence, set a date for the trial and awarded me costs for my appearance today.

 

 

Before the hearing, there was a barrister for Lloyds there and he definitely settled a credit card claim before the hearing. I overheard one Lloyds claimant asking the barrister why the other claim had been settled but not his and the barrister clearly replyed that it was because it was a credit card claim.

Just as a ps, I was speaking to a couple of the barristers afterwards, it seems they had all come up from London (boy this must be costing the banks a fortune). The barrister in my case mentioned that he specialises in defamation in the sports world. They must be really bored out of their minds dealing with these sorts of things instead of what they normally specialise in.
