      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a car finance financed by welcome where the car came from Ucan / Carcraft.

My agreement is different to others seen on here and although there is no date entered by us there is a date signed on behalf of Welcome for Aug 2006

 

At the top of the 2 page document it says

Progressive Financial Services Limited trading as Welcome Financial services of (nottingham address)

then the figures are as follows

 

A 6,900.00 M-R Amount of credit for goods

B 295.00 N Amount of credit for Insurances

C 7195.00 A+B Total Amount of Credit

 

duration = 48 months at 277.12

40.4 APR

 

D 12870.88 A+R+V Total amount apyable for the goods

E 530 88 N+W Total amount payable for the Insurances

F 13401.76 D+E Total Amount Payable

 

G 0.00 PPI

H 0.00 Mechanical Breakdown

On the T&C it also gives the list ofvarious charges for letters sent out etc, and they are lower than I have read eslewhere but it could be as the agreement isdated 2006

Thanks for that Pickaname that gives me plenty of ammo for tomorrow when I pay them a little visit - oh and I wasn't able to contact them tonight by phone so I think I may just charge them £25 for my visit - lol

Hi your agreement sounds very simular to mine which I posted a few days back! I think the option fee is what you pay the blighters after paying everything else as a final payment to completely own the heap of crap that it will probably be after 4 years.

Its the bit on the bottom too, about acceptance fee and agreement thats confusing too?

 

Roms is the same and we are not sure if that is saying they can charge on the acceptance fee?

just had a look at your agreement

APR checss OK

the insurance is wihtin the Total amount of credit so it should have been optional to the purchase,I see no tick box or consent?if it was a condition of the sale then the agreement is unenforceable because the totla credit fugure is incorrect(sections127(3) (65)(9) etc.

The reason they like you to sign in there office is because the agreement then has no cancellation entitlement so be vary wary of what you sign.

Morning all, I am gonna try my hand at the calculator but if anyone fancies having a look over my OH's agreement, the one we are really fighting, it would be much appreciated.

 

The amount listed to settle loan ac blah blah is actually the amount the salesperson told my OH he had to pay to settle my loan (which he didn't know about until that moment!) as company policy that there cannot be 2 loans at the same address (we now know as total bull). Conning Gits...but would be nice to know how their agreement stacks up also ;)

The Wilaon case showed that the prescribed terms not only had to be there but that they had to be correct.

As far as i can see there is no guidence on these as to the peramitors involved.

The only thing i would say is that the regulations do lay out a rule that the APR must be within a range of 1%under or .1% over that that is stated on the agreement.

The APR is however not a prescribed term so you would have to argue that the apr was an indicator that the prescribed term was misstated since the interest is involved in its calculation. Which i believe has been successfuly done.

I second this Millymo, no offence taken, I have a wicked sense of humour and nerves of steel after my dealings with Welcome! I just wanted to clarify the reply I got incase it helps others who are being told different by NU. Why are they telling different Welcome customers different things? I told them they needed to confirm in writing as I have a court case & dispute with welcome, they obviously don't want to be involved, I thought the phrase 'Welcome....responsible for all sales issues" was very telling, but maybe that's my suspicious mind!
