    • I've received this notice to keeper. I work for the NHS and was delayed due to patient care. I park here regular and and have never had any issues. I've looked at the evidence on the portal and other than showing that i entered at 12.59.33 and departed at 17:14:14 it doesn't state how long i overstayed for. I paid for 4 hours parking over the phone which i wont have done till i got parked but as its over the phone i have no receipt or record but it is not possible for me to have been in excess of 15mins from the photos alone but I'm unsure having read other threads whether grace periods are 10 or 15 minutes. I havent appealed yet but and was about to but in appealing i'm showing i'm the driver which i gather is something you state we must never do. I don't like confrontation but £60 seems extortionate. Hope you can help. 🤞   1 Date of the infringement 30th May 2024   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 30th May 2024    [scan up BOTH SIDES as ONE PDF- follow the upload guide] please LEAVE IN LOCATION AND ALL DATES/TIMES/£'s   3 Date received 5th June 2024   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] No reference to schedule 4 just says"...we the creditor reserve the right to recover unpaid parking charges from the registered keeper in accordance with POFA 2012."   5 Is there any photographic evidence of the event? Yes   6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? [Y/N?] post it up NA   7 Who is the parking company? Carpark securities   8. • It never seems to amaze me how the chuckleheads think that No Stopping can ever offer a contract when it is prohibitory. In any case you did not accept the contract by entering the land, you entered the land to get to the airport for goodness sake. In most car parks there is a Consideration period that allows motorists to decide whether they want to stay in the car park . Here on a road, there is no consideration period and whether the motorist finds the terms agreeable or not even assuming that they are able to understand that they are being hoodwinked into believing they are being offered a  contract they cannot turn back. They have a plane to catch and even if they did turn back because they didn't accept the  No Stopping term of   the so called contract they would still have had to stop to turn around. Plus there is a question of Frustration of Contract. You had to stop at a pedestrian crossing .
    • Just a couple paragraphs their WS that it might be useful to refer to specifically in the OP's WS... Para 6 A contract was formed with "the driver" of the vehicle. Para 8 "The driver" accepted the contract. (The "driver" is not named, or identified anywhere in the WS). Para 7 WHY would there ever be a "no stopping" restriction in a car park? (In Para 10, they specify that it is a "car park"). Para 11 "The Defendant" became liable." Again, they have not shown that the Defendant was "the driver", simply the keeper. Para 20 "It is a matter of agreement"? Not really sure what they're trying to say here...
    • Thank you for relying so quickly! That is what I had concluded was the reality of the situation.. I'm still waiting for the call within my time slot.. I will try to fill this thread with more info, find original letters and show the docs of the pack I was sent, a pack with no real covering letter to show what it was in response to or from whom..
    • at this point nothing else really matters. wait for the form to come back theres no need to talk about what's right/wrong if you don't even have PTA bundle directions

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

There's nothing to work out really :) Are you suggesting that I'm so retarded that I should work for this lot myself? :)

For now I've maxed out the voice mail to 2mins delay to frustrate the hell out of them. They came close with a 1min 29sec call today. I may well send a peanut to the first monkey to leave a message.

Still, for now having been told to stop on many occasions they're still intent on breaking the law ... so be it.

Yes it just sits there noting the date time and duration of the call and you can sit and watch Corrie in peace without being interupted by the muppet show. All the while the evidence is piling up whilst the monkeys cannot understand why you are not answeriing even though they try to be OH so clever. Absolute Our Soles

I would say that I sympathise with them as low wage exploited employees but that would be a lie. They're nothing more than low life scumbags who would do anything for money.

The fact that the vast majority will not reveal their names shows that they know what they are doing is wrong on any number of levels.

The great thing about this is that I didn't give them my new number either ... my wife did. So I've never given my consent for them to use it :)

I have good teachers ... :)

2 more phone calls between 8:30 and 9pm ... not a great tally for today but sufficient :)

Maybe phone 'em up tomorrow or the day after, use 141 and ask them how they got your new phone number? Tell them "never use it again!" lol. Have you worked out a way of recording your telephone calls yet? It would be a priceless moment in a court room:)

And they're off ...

9:55am -10:05am 5 calls - 3 to my sipgate phone, 1 to my mobile and 1 to my wifes phone.

I wonder if they got their CCA letter :)

p.s. make that 7 calls ... I've just noticed another 2 to my sipgate phone starting at 9:30 ish

Perhaps you should change your message to see what lies they are trying to peddle - something that might make them think you are on the phone, although the tone does give it away - perhaps something like (short pause) hi this is xxxx

And in the post sent 2nd class ...

It seems that 'Despite all of their previous communications' I have 'ignored demands for payment on my long overdue account'.

I 'only have 48 hours to stop further action' (in an impressively large font) and my account is going to be 'passed onto a local debt collections firm who may call at my address'.

Bring it on. It's not me that's been doing the ignoring. I don't know what this actually achieves other than sounding threatening. Views anyone?

These guys really are a piece of work.

Yet more dropped calls to my sipgate number and there's at least 3 hours left ... perhaps not a record today but all is good for evidence gathering.

I can see this coming to blows in court and I want to be prepared. There is absolutely NO way they are getting away with charging me at full whack with huge interest applied. Hell will have to freeze over after all of this grief from ill educated telephone monkey scumbags.

I took the suggested letter for my wife and modified it a little and that's been sent threatening immediate contact with the police and court action if necessary. They've been given 5 days to reply IN WRITING to her complaint or she will take action ... and she will too :)

... and we finish the day off with a further 3 phone calls to my sipgate number between 8:30pm and 9pm ...

The longest call of the day goes to monkey #8 who let the phone ring for 1 minute and 35 seconds ... sadly, I was in bed at the time enjoying some well deserved kip.

Not a bad day for evidence given that I wrote this to them over 2 weeks ago:

"I have not received any acknowledgement in writing as requested and my family have been subject to further telephone based harassment. When you are asked to cease and desist from such communication I expect you to do so. It is my intention to report your company and operatives to the Office of Fair Trading as threatened in my letter of 04/07/07. You are now clearly in breach of Section 40 of The Administration of Justice Act 1970. This is a criminal offence.

I also now consider you to be in breach of the Protection from Harassment Act (s.2) and will pursue this line vigourously should you not respond to this letter. You should be aware that this is a further criminal offence on your part."

Their response ... well, see above.

Tomorrow is another day ... I wonder what it'll bring

More pointless call giving you more evidence from a bunch of greedy monkeys.

Change your sipgate message to say This call will cost you £5.00 whether listened to by you or not:D

4 phone calls on my wife's phone between 8am and 10am ... none so far on my sipgate phone. They should have received her letter of complaint and threat of legal action by now though.

The usual nonsense applied and they got quite aggressive. One monkey refused to give her name because of the 'Data Protection Act' . This seems to be a common answer. When asked which section she ummed and ahhed and my wife nailed her to the floor by saying 'basically you're lying and know jacksh!t about the Data Protection Act' ... the monkey then accused her of being abusive and put the phone down. Another heard me in the background and demanded his 'legal right' to talk to me ... idiot. He probably heard me tell him where to go in the background too! The language was basic enough even for the most retarded chimp to understand.

Nothing heard from them since then.

Why is it that I can envisage (Reggie Perrin stylee) a bunch of chimps doing that curved arm head scratching thing?

I took some time (4 hours!!!) and have lodged a lengthy formal complaint with Barclaycard (also sent to TomTerm for comment and as an independent 3rd party for safe offsite storage).

As some pay back for you fella's I'd quite like to put all of this together as an easy to distribute information pack with document templates and advice etc. Would people find that useful?

I can't afford to pay any cash right now (but will when things improve financially here). This is the best way that I can show my appreciation.

I wonder if they'll phone again today ... any bets anyone?

Cheers,

D

Nothing wrong with being "abusive", there is no law that says you have to be civil to strangers who call you !! Keep at 'em

That's not abusive at all ... if they want abusive all they have to do is ask :( I've been known to invent new expletives and combinations thereof when annoyed ;)
