Was going to take Sunday off as all this info is making head whizz but just have to say Tbern I really, really like your style. In fact I think we all should complain even though we get fob off letters (or words to that effect) it will keep them busy for a few days.:-D :-D

The thread to add your name for mass complaints is gaining momentum and plans are underway to get this off the ground soon....keep posting there every complaint counts.

It is intended to target specific culprits.

Kings Hill by the way is actually part of the address for Cabots operations........we are looking very closely at these,though as you will understand cannot elaborate further.

It is fair to say Mr.Maynard certainly appears to be a very active person who has much influence in the whole industry and it is certainly not unreasonable to question that.

Behind the scenes I can tell you that there is much work going on to fight for our corners.

Keep the posts coming as they are important as part of the end result we are striving to achieve.

 

By the way...tbern123 an excellent post above,will give Mr.Maynard some food for thought although there is nothing there that in his capacity and with his knowledge of the rules and regulations,that he should not know already.

Rhia - I totally agree with you - the more of us get involved and complain the better - these companies will eventually have to hear our voices and change their ways?

 

If we sit back and don't complain nothing will ever happen to resolve these issues?

 

Tbern is so right in what he is doing - even if these people simply "dribble on a page" with excuses to fob him off - he has given them plenty to think about and can then transfer complaint elsewhere showing that he tried to resolve issues?

Spot on, that is exactly what is all about...

 

The less they do, the worse it gets for them.

 

Something for people to bear in mind. When the Financial Ombudsman Service takeover dealing with complaint about DCA's as they currently do with Banks, they will automatically charge them (I think it will be about £400) to investigate any complaint we make...

 

The DCA's don't even get this back, if the FOS reject a complaint...

In addition to Mr.Maynard it may be an idea to contact other members of the council of the CCA.

One member in particular serving on the council is Mr.Pierre Haincourt.

Mr.Haincourt is a very well respected high flyer within the industry having created Credit Limits Limited, a company associated with International debt collection.

He is a member of the Institute for Credit Management,who have their own ethical codes for its members.

for reference here is an extract;

Tbern - EXACTLY - If we complain loud and clear - using various places to complain as available to us - we can each say at the "relevant" time look we tried this, this and this to gain no results!!

 

Like you say "case building" show people "hey look we tried to resolve by doing this!!" - FOS will be able to see everything we tried etc.. - we will have the "fob off" replies to show for our efforts or even the silences as some places are giving!!

 

All we need to do is continue what we are doing and give them ROPE!!! Eventually this will be resolved and we will see results for our efforts!!!

Cabot Fan Club

 

Should we pull a summary of each complaint we could send and have a set of DCA standar letters created and setup as a sticky?

 

If we create a template it would simplify the process of complaining and ensure all references in the letters are included. Each of us could send a copy with our support info to each regulatory body as a formal complaint about these lovely people.

 

I am guessing that these templates would help more than just the Cabot fan club.

 

If, as Tbern has implied, they get a £400 charge each time it would really cheese them off.:D

- Trading Standards

- Financial Ombudsman (£400 non returnable to DCA:D )

- Information Commissioner

- not sure if OFT is included somewhere too.

- Credit Service Association

 

Could we get a sample of a letter (or link to these letters - after obtaining the ok from the originator) for each body and we could start cutting and pasting our own info into them.

 

Lets all follow in Tberns (and others) wake and get rattling those cages officially, only cost the price of a stamp (or free if we get an email address for each) .

:rolleyes: thats about 15 times £400 :rolleyes: thats around £6000 per person times how many people on here? :rolleyes: 100,000? Cabot profits? - what profits? :D

I’m officially in the Cabot Club. Warming up the legal team on gas mk4.

 

This morning I received a S.A.R - (Subject Access Request) from Cabot in which they purchased a debt 3 months after it became statute barred, no paper work and then started to telephone god knows who for 2 years before starting to phone me late 2006. Approximately 300 calls in total of which I was only aware of about 40 in the last few months. Wonder who they phoned for the first 2 years it wasn’t me!

 

From the moment I picked up the S.A.R - (Subject Access Request) until I laid it down, I was convulsed with laughter. Some day I intend reading it.
Cabot: “That’s in every contract, that’s what we call a sanity clause.”

Louiboy: “You can’t a fool a me there ain’t no sanity clause”

 

They need to use the spill chucker. I’m of to the Buidling Society to open a Currant Account.

How long did it take them to reply? 40day +.

 

Also did they send copies of all letters ever sent to you?

 

How many calls is harrassment? shurely 300 in 12 months should be harrassment let alone 300 since "late 2006".

I did OFT and TS - am considering of we can do FSA? still reading that one. Am definitely doing FOS.

 

Oh!! And I just thought I'd let you all know - "messaging service is the wrong company" CABOT's said so!!! :lol::lol::lol:

They responded to my first S.A.R - (Subject Access Request) in under 40 days and in that S.A.R - (Subject Access Request) they drew my attention to another account they didn't send the info for. Strong letter back urging them to send all information or visit the court.

 

The calls were over 300 in 2 years the bulk being about 60 in the last months.

The other 240 calls never rang my phone. Lots of answer machine messages claimed to have been left. Somewhere in the UK theres a confused stranger.

 

There weren't many letters. Think they prefer the war dialler to get your attention.

 

Need to combine the 2 S.A.R - (Subject Access Request)'s. Theres already enough to launch proceeding. They even sent a letter "as goodwill we will not be pursuing these accounts"

 

I will be pursuing the accounts :)

If you mean -

Message Service Ltd, Registered Offices at Glebe House, 2 Clifton Road, Rugby CV21 3PX.

 

I think you will find they are connected with Cabot. In what sense did Cabot think they were the wrong company? In the same way that The Telegramme

Company has no connection with Buchanan Clark & Wells perhaps? Doubtless

another wrong company.

The message service is registered with the ICO and one of its functions is

that of debt collection and is also registered at Companies House.

Message Service has same directors as the Cabot bunch of assorted companies. They are definitely linked.

 

Debt Mountain the £400 penalty won't come in until April 1st but I am not sure if complaints logged with the OFT in the run up count. Perhaps we should hold fire but great idea re the sticky and template letters...here's one we did earlier.

Lookingforinfo & Rhia - YES we know they are linked etc.. same directors etc..

 

But according to letter cabot's sent us - they're wrong company!! They must think we are all green?? Just fell off the bush??

 

The question I shall raise now is - if these messaging people are the wrong company - then why was it their business to so aggressively phone every day for months!!! Surely if they were phoning they ought to have had the CCA/SAR info as I requested from them?

 

They sure is getting themselves confused??
