    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.      
    • I thought I should send the begging letter to the prosecutor. Does the hearing means the time I need to send back by?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am posting my letter to the office in the morning. Abbey's fortieth day was Monday 17th.

Letters sent for two accounts 8/03/06 - 40 days= 17th April

Reminders sent 5th April (along with cheque) 12 Days to go...

Rang Abbey 1600 18/04/06 asking where info is....

Sent Letter to Infomation Commissioner 18/04/06

Quite right - but if it's not under DPA they don't have to send them within 40 days.

my husband sent the dpa letter a couple of weeks ago and as he hadn't heard anyhting and i had recieved my info form first direct he telephoned abbey and they sent as his account was closed his info was microfiched and it would take 4- 6 weks for the info. As this was a telephone conversation and not a letter do you think we should send the letter re the microfiche argument and them opting out of a dpa request. I think it was dave who wrote it?

sent the usual standard dpa letter to abbey dated 24th march 2006. recieved from abbey the standard "microfiche" letter plus 13 months of acc statements, which btw includes £1032 worth of charges for that 13 months ouch !!! lol. so sent another letter to them:-

 

Dear Ms Small

 

Thank you for your letter dated 28th March outlining that you could only provide me with statements covering the last 13 months on my account because any earlier information has been archived onto microfiche. Enclosed was a list of transactions and account detail covering the 13 month period.

 

My request was for a schedule of all the charges applied to my account with appropriate descriptions for the past six years – in short a list of charges with dates and amounts - alternatively a complete set of bank statements for that period will be acceptable. This should be retrievable from your accounting systems and easy for you to produce. I will accept a computer print out of these transactions.

noticed that my chq for £10 had been cashed and today thurs 20th april.06 rec`ed acc statements for the last 13 months again.huh. sooooooo does this mean they are goin to send me the rest dating back the full 6yrs? or am i goin to have to send them the letter u have posted ? or just wait the 40 days and and guess the amount they stole in charges then send then the LBA ?

Funny that an organisation that has been fairly efficient all along mysteriously becomes crap.

Abbey (Charges on 3 accounts and default on my credit record) - DPA letter sent 30/03/06 - 40 days limit is 9th May - Recieved DPA printouts 05/04/06 with microfiche "fob off" letter. <p>Barclaycard (Charges on 1 account and default on my credit record) - DPA letter sent 03/04/06 - 40 days limit is 13th May - Recieved some statements 08/04/06 along with DPA printout and a microfiche "fob off" letter. Claim for £340 sent 11/04/06

We are expecting to lodge our claim in Court at the end of this month.

 

Good to see the tradition is being maintained in the location. If you fancy a laugh and to give some support we will let you know when we are due in Court! However from the posts we have seen it will not get as far as The Morledge.

At 7.30 p.m. on 26 February I requested copy statements for both my accounts back to January 2000 via e-banking (no mention of a charge anywhere on screen).

 

A couple of days later I received a letter dated 27th February saying they had "received my request and had passed it to the administration department as they've been archived so they'll send them to you shortly." (still no mention of a charge).

 

After a couple of weeks they had not arrived so I called the phone number on the letter - 08456 090014 Customer Account Service Excellence and said that I had not received them and was told that they would progress my request. About a week later, I received some sheets of paper which were not actual statements but a list of all transactions on my account including the date, what the transaction was, i.e. transfer, ATM, Visa payment etc., the date, amount and balance, and when a charge had been applied to my account, it said CHG.

 

However, they only sent this info. for one account. A week later, I got some more lists but they were a repeat of the first lot!

 

I'm still waiting for the other account info. and have called various numbers to expedite and "should receive it this weekend".

 

I don't appear to have been charged for this info. at all and I can wait, I'm just biding my time.

Mystery solved. One letter refers to one account, one refers to another.

However both dated the same date but arrived a week apart.

I therefore expect to get a third.

 

The form attached to it says "accounts(s)" so I have put all three on and have put back to 1988 to really make them earn their £10. It will be very interesting to see how much they have had off me over the years. Enough for a small car I reckon.

You should have reported them by now thats way over 40 days....

No, this is absolutely the wrong approach. You should submit a DPA requestr, enclose the statutory fee of £10 and send it to them recorded delivery. This is the only way that you will get all of the information you need. Abbey are playing silly b&%$$£s with people who do not make these requests in a way that forces compliance.

 

Not only do they want to mug you for unlawful bank charges but they do their utmost to keep their ill-gotten gains when they are challenged. Scummy behavior from a **** bank.

My 40 day's are up tomorrow and still no statements.:-x

 

I now think they are stalling for time to see what's happening with eveyone else's cases and while they get their lawers to find some excuse for them.

i just got the pam speed letter (see my thread) and have sent them the ltr that alanfromderby put on the abbey forum. I haven't received statements requested for 2001, 2002, 2003 and 2004 so they have 15 more days under the DPA to get this information to me,

 

i think you should report them though to the IC if they don't get the requested information to you by your set deadline

 

what are Abbey like - talk about sailing close to the wind?!!

Hiy guys

 

just thought I would let you know that I got my microfiche stuff through whilst i was on hols - so, that was on or about 3 June ... so it took Abbey some 2.5 months to get this information to me, but I guess, at least I got it in the end, and I have to say, that after getting all statements from my other creditors etc, and managing to get refunds from them, at least its prepared me for what I think, is going to be a very long fight with Abbey!!

Lois - you waited 2 and a half months for your statements..? why did you not sue them for DPA non comlpiance on the 41st day?

Abbey - 547.00 settled in full.

Second claim: £204 WON.

Barclaycard - 142.88 incl interest due WON BY DEFAULT as they didn't even bother entering a defence. Barclaycard paid up £184.88.

 

MBNA - Concluded £634.31

Capital One Concluded £148

Kinda disappointed I've no more banks to go after now...

Hi - I am also in Scotland and fighting Abbey for money. I have been told by them that I will only get 14 months of statments for my £10 and then for an additional £10 they will send the rest of my statements from microfiche. - Have you been told the same?
