    • Yup, well so far they have lied to me about responding to a CCA,  are threatening me with a default notice that they don't have, produced a knocked up version of my NOA, sent me 29 pages of spew for an agreement. No wonder they pay 5 p in the pound for that crap.

Paragraph 3 – this is unnecessary because you are not claiming as an entitled third-party. This worries me because it makes me feel that you haven't fully read around because this is a paragraph which you would include where you were suing EVRi as a beneficial third party because you had actually made your contract with Packlink or some other broker. I think you need to revisit and do some more reading. I'm afraid I have a sense that you have simply copied this from somebody else's witness statement without understanding that it wasn't necessary. Please can you post the amended draft. Other than the suggestions above, it looks okay – but let's see it again for a further appraisal. In terms of the evidence, parties bundle, I think it might be an idea to start off with the correspondence with EVRi and then go onto the other evidence. You will have to amend the index page accordingly. You could shorten this bit. Take 19 is pretty well blank and you may as well miss it out also, there seems to be some repetition of emails and the email chain. I think will be worth going through and getting rid of duplicates if you can. 49 pages is a bit long and it would be a good idea to try and reduce the number. I have a feeling that 50 pages as the County Court limit anyway. The judge will be happier with you if the bundle is smaller. Maybe you could reduce the size of some of the images or messages et cetera. You have got several messages which straddle onto a second page so that things like sign off information and standard confidentiality information become orphans. A bit of manipulation and they could be joined to their parents I think. Page 31 as an example. So is page 19. You may only be up to shorten the whole thing by 56 pages – but I think it would be a good idea. 56 pages is, after all, 10%. If you can do more then so much the better

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well the Aq has to be with the Court before the end of the week, I had planned to do it today and hand it in tomorrow, but the Easter sun was far more appealing so the AQ did not get completed.:o

 

however the sun tan is coming along fine;)

Just thought I would give you all an update, I have just got back from the Court after handing my AQ in it was not due to be in until Friday but I did not want to leave it to the last minute.

 

The lady at the court was so helpfull they have already received Abbey's AQ so they put it with my claim and I asked when would the judge see it? she said he probably won't because of the new rules regarding AQ's, I think I missed having to file one by a day, (so I said and I hope I have done the right thing) I wanted him to see it as I had included some information about a local case and the Lincoln case, plus I thought I had spent all that time preparing it I wanted it looked at.

 

So it will be refered to the judge on Monday or Wednesday, I really want it to go Wednesday because of the Judge who is in that day, but the lady at the court said they all work on the same principal so hopefully by the end of next week I will have a Court date.

 

I have not received Abbey's AQ yet but have just posted to them a copy of mine,

Well hopefully the process will now start to speed up with the courts stopping the AQ's,

 

I had a look at my claim since it was submitted the interest has already increased it by £48.50 so if you look at it that way the longer it takes the more we all get:p

Hello Everyone

 

The thing is with these claims now, because the courts are getting snowed under with them, the backlog is just going to get longer, giving longer waiting times for court dates!

 

I can't understand why more pressure is'nt being put on the financial institutions from those above to stop these claims before they get to the court process, maybe by giving out refunds at the LBA stage. I hear some banks are now doing this.

 

You will all get there in the end!!!!!

It depends on your dates for the defence to be filed I think

Nat West paid my two claim at this stage which was fantastic, I can see why most of the bank's won't pay out before court as I feel if they did they would have more claims, there are so many people out there that will not submit court paperwork so that way the bank wins

I know there are at least 5 of us on here that filed AQ's within 24 hours of each other can I ask if you have received a copy of Abbey's AQ?

 

When I went into the court on Wednesday a copy of Abbey's was already there (early) as I had not received mine at that stage I thought it would arrive in Thursday's post but it did not and I have not received a copy just wondered if this is standard practice?

 

I have send Abbey a copy of my one recorded and would like to see what they have put in their's although I guess it's the same as everyone elses I still would like a copy, I think I may e-mail Inga and ask them to send me it, don't know if she will comply

I never received a copy of the shABBEY's AQ, from them or the court! I don't think you need to worry about what's in it. I think you can probably guess its all pretty standard irrelevant stuff, so irrelevant that soon after you get your court date, they'll be calling you to negotiate a settlement just like they have with a lot of us on here!!!!!!!

My AQ was due in on 11th April, had delivered on 10th and like you I thought I would have sight of their AQ by now. Spoke to the court and they confirm they have the AQ from the Shabbey. I am now going to play the waiting game for either calls or emails . Good luck

I'm on the same time schedule as a few more of us here.

 

My AQ was due on 11th April (last Wednesday). I took it to the court personally.

 

I received a copy of the Abbeys AQ in the post the day before.

 

Don't know if it means anything whether you receive it or not. The only think I noticed was that they had ticked the box for a stay of a month to settle. I ticked "No" in that box - as far as I'm concerned they have had since last November to settle.

I never asked why they never sent me a copy I just advised that I had filed my copy of the AQ which a copy was sent to them via recorded delivery, that I was aware from the Court that Abbey had filed their AQ but as I had not received a copy would they forward one to me.

 

It was short and to the point, don't forget to add your claim number and I always request a read receipt.

 

Maybe you could ask the question why we never got a copy? will you let me know what response you get if any please?

Good afternoon everyone. I have have spoken to the Court today , they state the District Judge who deals withese cases is back from annula leave tomorrow and will be looking at the case papers , I should get some news by the weekend. I asked about the AQ, if the Shabbey had asked for an extra month and she said she was unable to look as the papers were now upstairs.

I have just sent Ms Kirkman and email asking for a copy of their AQ explaining I had sent a copy as a matter of courtesy to them .

 

Charleyfarley is it a good thing or a bad thing ? Or as I suspect just plain sloppy/bad manners Or that we are both claiming longer than the 6 years .......

I did get the 50% offer at the defence stage Charleyfarley, just no funds into the account unlike some, regarding the 6 years my claim is only one month over the 6 years, which was for January and I filed with the courts in Feb I thought six years was ie 2001, it's only about £60 to be honest.

 

Are you starting to work out a picture Charleyfarley? please post and tell us because as hard as I have tried I can't see any

It was meant to be a joke about the GOGW and AQ ( or lack of!), sorry if it was a bit laboured, no offence intended:)

 

 

The only picture I can build up is that this is going to take us a LONG time. I've seen a post today where the court has just issued a date for August, and without the court date you can't exert any pressure on Abbey to speed up their dealings.

Well I got a GOGW and AQ - some people have had neither -some people GOGW +50% +AQ.

 

Abbey are their usual consistent self:rolleyes: :rolleyes: :rolleyes:

 

We're all at about the same stage - give or take a day or two.

 

That guy on the Nat West thread getting over 35K has really inspired me - if he can do it - SO CAN WE!!!!!!!!!!!!
