Hi,

 

This one goes back quite a way, but since BF has advised that it will be claimable up to 6 years I've decided to pursue it as its worth just over 1,000 GBP value.

 

I sent a phone via DHL (booked direct with DHL) to a screen fitter to get a custom screen protector fitted. DHL delivered it to the wrong industrial unit but claim that they are not liable because the unit they delivered it to is operated by the same third party (It is NOT).

 

sent a formal letter of complaint which has received a response referring me to some stupid ombudsman thing.

 

I used a skeleton POC as before, please find attached. Is this ok to submit to MCOL?

 

It's quite brief but I remember it fits within the 1080 char limit. 

 

Insurance? Yes (sent long ago)

Declared correctly? Yes

costs associated with bringing the claim against the defendant

you don't need to refer to associated costs but you will need to say that you are claiming interest.

Also you should put the date that you sent the parcel.

Please amend it and post it again for a final look

The defendant picked up the parcel on 12 may 2023 and delivered it on 14 may 2023.


The defendant has admitted in writing that they delivered the parcel
to the incorrect property.


The defendant excludes their liability to reimburse the claimant for
their lost parcel which is contrary to s57 of the Consumer Rights Act 2015.

The claimant purchased the defendants liability extension policy even though this is a secondary contract and prohibited by section 72 of the 2015 Act.
The claimant therefore claims for the loss of their parcel as well as interest at 8% simple per year pursuant to section 69 of the county courts act 1984.

I received the following email from the court today.

However when I click the link I get presented with an error.

I tried to login to the normal money claims bit but I also get the same error. 

How do I get a copy of the order?"

The court has made an order which includes instructions you must follow.

You must respond to the order."

404: Not Found

Are you referring to https://www.moneyclaim.gov.uk/web/mcol/welcome or https://www.moneyclaims.service.gov.uk/dashboard or both?

 

I'm using the latter which I'm aware is different to most people here, or are the errors the same?

urm.. i was wondering if you have a cookie error in your last post not allowing you to download.

your 2nd link provides the same error you get when trying to download the court doc link.

try downloading and installing and running Glary utils.

then see if things work.

Thanks, it worked this morning.

Does part 2 of the order mean a trial/hearing bundle? If not, do I explicitly just send the contract and the contact and nothing else?
