    • Morning dx and thank you for your message.   With regards to your comment about them not needing to produce the deed, the additional directions ordered by the judge included 'a copy of any assignment o the debt or agreement relied upon'  so that is why I thought that point was relevant?
    • Sorry for the long post but I don't want to miss out any relevant information: My wife bought a car from Trade Centre UK and have been having nothing but trouble with it. Unfortunately we paid of the finance used to buy the car as we weren't expecting this much trouble with the car as we we though we would have protection as buying from a dealer. We are wondering if we can still reject the vehicle since the finance plan has been paid off. Timeline is as follows: 13/12/2023 -15/12/2023 Bought car from Trade Centre UK for £10548 £2000 deposit paid on credit card on 13/12/2023 £8548 on finance from Moneybarn (arranged through Trade Centre UK). picked up car on 15/12/2023 Also bought lifetime warranty for £50/month 25/12/2023 Engine Management Light comes on. The AA called out and diagnosed the following error codes: P0133 - Lambda sensor (bank 1, sensor 1) Oxygen Sensor. Error Message : Slow reaction. Error sporadic P0135 - Lambda sensor heat. circ.(bank1,sensor1) Oxygen Sensor. Error Message : Component defective Due to it being Christmas took a few days to get through to them but they booked me in for 28/12/2023 to run their own diagnostics. 28/12/2023 Took car in to Trade Centre so could check the car – They agreed it was the Oxygen Sensor and Booked me in for repair on 30/01/2024. I was told they had no earlier slots, and I would be fine to carry on driving car when I said I was afraid of problem worse. During diagnosing the problem, they reset the Engine Management Light. During drive home light comes back on. 29/12/2023 - 29/01/2024 I carry on driving the car but closer to the date, engine goes to reduced power every now and again – not being a mechanic I presumed that this was due to above fault. 20/01/2024 Not expecting any more problems paid off the finance on the car using personal loan from bank with lower interest rate. 30/01/2024 Trade Centre replace to O2 sensor (They also take it on a roughly 60mile road trip which seems a bit excessive to me – I can’t prove this as something prompted me take a picture of milage when I handed car in but I forgot take one on collection – only remembered next day.) 06/02/2024 Engine goes in reduced power mode again and engine management light comes on – Thinking the Trade centre’s 28 day warranty period was over I booked the car the into local garage for the next day to get problem fixed under the lifetime warranty package. Fault seems to clear after engine was switched off. 07/02/2024 In the Morning, I take it to local garage who say as the light gone off – the warranty company is unlikely to cover the cost of the repair or diagnostics and recommend I contact them when the light comes back on. In the evening the light comes back on and luckily I manage to get it back to the garage just before it shuts for the day. 08/02/2024 The Garage sends me a diagnostics video showing a lot error codes been picked up by their diagnostics machine including codes for Oxygen sensor and Nox Sensors, Accelerator pedal and several more. Video also shows EGR Hose not connected to the intake manifold properly, they believed this was confusing the onboard system as it is unlikely this many sensors would trigger at same the time but they couldn’t be certain until they repaired the hose. 13/02/2024 Finally get the car back as it took a while to get approval and payment for the repairs from the Warranty company. Garage told me to keep an eye the car as errors had cleared with the hose but couldn’t 100% certain that’s what caused the problem. 06/03/2024 Engine management light comes on again. Fed up I go into Trade Centre as I was just around the corner when it happened and asked them how to reject the car or have the problem fixed. They insist that as it’s over 28 days I need to get the car fixed under the warranty package I purchased and they could no longer fix the car as it was over 28 days. When I tried telling them it appeared to be the same or related problem they said they couldn’t help as I hadn’t contacted them earlier. I asked them if they were willing to connect the car to the diagnostics machine and tell me what the problem was, as a goodwill gesture, which he agreed to do and took the car to the back He came back around 30 minutes later and said they took a look at the sensor they replaced previously and there was nothing wrong with it and engine management light went off when they removed the sensor to check it. When I asked what the error code he couldn’t give me an exact fault but the said it one of the problems I told him earlier (Accelerator pedal). I have this visit audio recorded on my phone – I informed the reps I was recording several times. As the light wasn’t on, local garage couldn’t book me for a repair under warranty. 07/03/2024 Light came on so managed to book back into local garage for the 12/03/2024 Whilst waiting to take car into garage, I borrowed a OBD sensor and scanned for errors on the car. This showed the following errors: P11BE – Manufacturer specific code (Google showed this to be NOX sensor) P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow 12/03/2024 Took car to local garage and the confirmed the above errors. This leads me to believe that either Trade Centre UK reps lied and just reset the light or just didn’t check properly (Obviously I am unable to prove this) 22/03/2024 Finally got the car back as according to garage, the warranty company took a long to time to pay for the repairs 28/04/2024 Engine management Light has come back on. Using the borrowed OBD scanner I am getting the following codes: P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow P2138 - Accelerator Position Sensors (G79) / (G185): Implausible Correlation I have not yet booked into a garage as I wanted to see what my rights are in terms of rejecting the car as to me the faults seem related. I can’t keep using taxi or train to get to work every time the car goes into the garage as it is getting very expensive. Am I right in thinking that they have used up their chance to repair when they conducted the repair end of January or when they refused to repair it in February ? If I am still able to reject the vehicle could you point to any sample letters or emails I can use. Thankyou for your advice on my next steps.
    • Ok noted about the screenshot uploads. In terms of screwing up I had one previous ticket that defaulted and ended up in a CCJ from Southend airport because for some reason during COVID I didn't receive their claim form just a notice of default. This hospital ticket was the 2nd ticket that went to CCJ due to a lack of knowledge of the process. Maybe it's easier just to pay them in future I'm thinking though, I don't get them very often anyway

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi. 

I received a ticket in the post a few days ago for stopping on a double yellow line. 

 

The PCN that I received in the post is dated 3/3/23 and i have 14 days before the reduced payment amount expires.  that is either today or tomorrow.

 

I don't have £60 spare atm. 

 

If I appeal it on the basis of:

 

a) had to stop and go to chemist and had disabled child in car who can't be left out of sight and was poorly so couldn't get out of car, or

 

b) didn't see any signs (I will go back and double check, but don't remember seeing any)

 

will that stop the clock at £60 until they write back refusing the appeal???

 

The road never used to have double yellows until they started a housing development at the top of that road and they didn't want to obstruct lorries. 

 

That development is now being finished and some of the properties are actually being lived in.  Yet the double yellows are still there. 

 

There's no other parking available in the area as it's all exclusive to this and that.  

 

Any help and advice appreciated. 

 

I didn't realise until writing this that the deadline had arrived.

Edit: based on previous ticket(s) that you guys advised on:

 

The photos were taken at 13:22:57 and 13:23:57 but the incident time is stated on the PCN as 13:58

 

photos on ticket are fuzzy  i might need to double check on their website if possible. 

 

No observation 'period' is mentioned other than the times on the fuzzy photos.

no anpr - it was a person because my grandson saw him taking the pictures but the guy did not stand where i could see him ie by the chemist door.  there is only the chemist, vet and gp buildings there. so don't know why he didn't put ticket on car.

So a windscreen ticket and no such thing as dyl's on private land anyway .they mean nothing, purely tarmac graffiti.

 

Scan up the paperwork to date, but ignore everything until/unless you ever get a letter of claim.

Thanks DX - he could have put the ticket on the windscreen but chose not to.  My young grandson was watching him, but the guy hid from my view.

 

ticket says 'no parking on access roads/roadways

 

It's a Parking Charge Notice. 

 

Apparently the road is part of the watercolour estate in Redhill, Surrey. 

 

The yellow lines are new ish to aid the building of a housing development but that has now been built the reason for the yellows - and the one way system that was put in place while the building was going on - is now null and void. 

Yet these restrictions remain in place.

Welcome back Eve. 

I cannot read the times on the photos nor is it possible to read any of the writing on the right hand op of the page above the photos.

It is unusual for them to write and additional time after the ones on the photo. The additional time is getting on for 30 minutes after the times on the photos. Is it possible that your car could have been parked there for that long? A few minutes stopped there would be ok to argue you way out of but 30 minutes is more than stretching it.

 

It might be worth ringing the council to see if the road is covered by the Council or whether it is  a private one. UKPCM should not be issuing PCNs on Council roads so that would invalidate their PCN .  So getting the UKPCM signs around where you parked  could be a help as long as they are legible. Is the parking free or is there a payment machine nearby. Please photograph the sign near the machine and any that have different wording to other signs.

As we're presuming this is local to you, it would be very useful if you could go back and get photos of the fleecers' signs, both close up and how they would look to a motorist pulling up.

 

Just don't park anywhere they might photograph you 😉

That is their NTK dx.

 

UKPCM rarely observe PoFA timings when it comes to sending out PCNs.

 

As you can see they have included photos as an NTK should plus that they say they are the creditor and the wording is pretty close to PoFA but it is still a fail.

 

Not only because it arrived twenty days or so early [not sure that all Judges accept that ] but because they have not given the keeper the option of paying the ticket nor providing proof of the parking period.

Hi.  Just to clarify.

 

I DID NOT have a ticket put on the windscreen

 

I checked their online photos and the guy took a pic of the signage at 13.57 so i don't know. 

I guess I must have left prior to him generating a ticket.

 

I went back there late last night to check the signs but my pics are dire, but as you drive in the road you cannot see a sign because it's behind you and not in front of your eyes at all. 

 

There is another sign on the wall by the GP practice but that is facing into the road and it you don't drive that far up you can't see it. 

 

The sign as you enter the road should really be turned facing the cars as they enter not any other way.

 

On the pic i took last night it says parking only in marked bays (I don't think there are any available for the chemist, except the two disabled bays), and it says no parking on roadways, yellow lines, ..... ?..... and handicapped spaces.

 

I;m tempted to just find the £60. 

Their signs are poor but the chemist service is poorer, hence this delay in getting back in the car and driving off.

 

Seriously, have I a realistic chance of fighting this?  They say online that they have a good record of court action.

@dx100uk There's no white square in this photo that I can see???  This is an old image before it became one way and before they drew the yellow lines etc.

 

the only white square on that wall is a list of the GP's in the medical centre.  It used to be free parking then, before they started the development at which time it was publicly stated that the one way and lines were temporary to aid the lorries getting materials to the site

 

@LookingForInfoThis is the only document I've had and the first i knew of the pcn.  This doc is titled  Parking Charge Notice and it says underneath that Do Not Ignore This Notice.

 

Examining the photos on the 'paymyticket' site it shows the two photos on the pcn showing me parked there for a minute, and it shows a third pic of the signage taken at 13.57 but my car is not visible in that pic. 

 

In fact it wouldn't be anyway because the sign is facing the wrong way. 

It's a one way road now and the signs are not facing the line of sight of the driver. 

 

but according to paymyticket site the pcn was issued at 6am the following day so perhaps it's an automated system ?

We really need good close up pics of the signage wording.

 

The fleecers reason for the ticket was "No Parking On Access Roads/Roadways".

Is this term actually stated on the signage?

 

Also, you state that their photo "evidence" only spans 1 minute.

Fail!

Their own ATA COP allows at least 5 minutes consideration time, so you can decide whether to accept their stupid terms and conditions.

 

If you really want to pay theses leeches £60 rather than stick two fingers up at them...

here's pdf of the signage photo they took which was not shown on my pcn but was shown on the paymyticket website

 

This sign is facing up the road, in the direction of traffic, so cannot be visible to drivers as they enter the road.

look at your 2nd photo from the PCN

on the GROUND by the red car is a circle Drain and a white Cover

the same is on my pic from google earth @2019

thats where he was standing to take that photo.

Yes the circle drain is still there but there were no parking restrictions at the time the google maps photos were taken. 

 

it was a two way street and no parking control except in the flats where the red signs indicate private parking

 

I will go out today and take a pic of the signage. 

 

I now know there are a number of signs. 

 

There's one as you enter the road, but it's facing up the road so you don't see it.

 

  It's on the post by the vets, after the 'polite notice' sign. T

 

hen there's one on the wall of the medical centre but it's a bit further up the road so I wouldn't have seen it anyway. 

 

And there's one or two more but again further up.

 

I also know that I wasn't there at 13.57 as I had received a whatsapp meme 10 mins before that time and i remember looking at it at home.

 

I am like many other drivers, I saw the double yellows and stopped outside the chemist because I didn't want to leave my grandson unattended as he's disabled and was a bit poorly that day. 

 

I also know there were no spaces next to the chemist wall where the disabled bays are or else I would have parked in one and just kept popping out of the chemist every minute or so to check on my grandson.

I have location services set up on my phone but when I looked it showed only the last 24 hours journeys eg what time I left to drop grandkids to school etc, yet it has 197 records that I cannot see.  I don't know how to unlock that part of the phone.

ok, well i went there in the daylight there are signs and I should have seen them.  There was one that was visible today that I couldn't see last night.

 

So, on that basis I'm just dumb for not spotting them.
