    • Hi,    I'm almost done. One question is should I include a header with " Claimant's Trial Documents" or something similar and include a copy of my WX from the trial since that has the claim form defence and documents that were relied upon at trial so that the judge can see that? or should I assume they will already have those documents on the file and so simply include a short statement of case to show the case I intend to prove at the appeal should permission be granted. Since I've made a shorter concise statement of case setting out what I intend to prove at an appeal hearing I'm thinking maybe removing the header of "Documents/Exhibits for use for Permission to Appeal   " since the permission to appeal focuses on the grounds of law and so I'm thinking of just having   Appellant's documents Statement Of Case Skeleton Argument    Then a seperate category named Trial Documents Claim Form Defence Claimant's Witness statement Exhibibts to Claimant's trial witness statement   I'm wondering you think would be better, only because I don't reference a single exhibit in my appeal statement of case since I am just explaining the undeveloped points of law around why the judge is wrong since the  statement only focuses on permission, not the outcome of the appeal so there is no reference to any exhibits?   Or should I just remove exhibits and not add trial documents or exhibits on the understanding the judge will already have the trial documents and that if permission is granted I then include them in my appeal bundle.   Thanks   N/B My statement of case doesn't have the claim form or defence or any witness staements in. it is simply a short 4 page document setting out the claim history and the points I intend to prove at the final appeal hearing should permission be granted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think the presidential election will be down to Trump and Clinton. We'll know more after tomorrow ("Super Tuesday", when many states hold their primaries) but that's very much how it looks at the moment. I'm less cynical about the possibility of Americans electing a woman - I mean, 20 years ago I'd have said that no black man would be president in my lifetime, yet here we are. On the other hand, I think you are correct in saying that the Clinton name is something of a problem. Whether it's enough of a problem to allow the election of a fascist demagogue remains to be seen.

 

Fun trivia for the day: Clinton's main challenger for the Democratic nomination is Vermont Senator Bernie Sanders. His brother Larry stood for election to the UK Parliament in 2015, representing the Green Party in Oxford.

I suppose so - I don't really want to come across as defending Boris. But belief in principles is something that is usually a good thing in a politician, even if I may disagree with those principles.

 

I agree.

Boris believes very strongly in lying and making false promises.

More police officers on the streets=met police running with fewer officers than ever.

Cut rail fares within london=average 6% increase in fares and over 20% on some routes and tickets.

Keep London underground ticket offices open=all ticket offices closed.

Increase number of staff on London underground = cut 2000 jobs.

 

I admire (not) his passion for lies and his incidental comical attitude.

Sure, and this is why I didn't want to get into defending Boris.

 

It's the difference between a liar and a bull****er, really. In order to lie, one needs to be aware of the truth. Boris fits that definition. A bull****er, however, doesn't care whether what he says is true or not - the concept of "truth" or "falsehood" means nothing to Trump.

Well, with Rubio apparently refusing to pull out despite his crap performance, it would seem that Trump is looking to be the Republican presidential hopeful due to the rest stupidly splitting the non-redneck vote through self interest and ego.

 

Clinton also seems to be on track. I hear that based on family form, all the whitehouse male interns are stocking up on mouthwash... :/

I wondered why rubio would stay in with such crap results if he really cared about the party and despised trump as much as he presents.

Yeah. The Republican elites don't like Trump much, but they despise Cruz. Trump is pretty obnoxious and it would be a little embarrassing for them to have him as their candidate, but he isn't an idealogue, he's just a thin-skinned blowhard who wants to win the race to prove that he can. The elites reckon they might be able to control him somewhat, or at the very least that when push comes to shove, he might not do anything too stupid. Cruz, on the other hand, is very much a man of principle - that principle being that he wants to create a Christian theocracy. Cruz would be the Republicans nightmare candidate, Trump is just a nuisance.

 

Rubio is young. He can earn some credit points by doing his bit to take down Cruz. And then, well, in 2020 or 2024, maybe it will seem like it's "his turn" to be the nominee, sort of like it was with Mitt Romney in 2012.

You hit the nail on the head with your previous post saying Trump says anything and everything, and its amazing that his supporters just seem to pick the quote they like and ignore the rest.

 

I dont know a deal about US politics, but I do know that someone who doesn't look the part will never be president - I have met and spoken with Ross Perot - despite his solid fitness and posture, sharp mind and good dress, he's short and looked a bit like a well groomed goblin in fine clothes.

... and Sanders looks old, has bad posture and makes a $1000 suit look sad.

Can't ever see that happening - even with democrats.

I am no fan, but she has a following and people seem to buy anything she puts her name to.

 

The point is that there are idiots who would vote based on celebrity status, because they don't trust politicians to vote for them. Trump is seen as the anti politician and anti Washington candidate.

When you dream tonight think what it would be like if you woke up to the radio news " Prime Minister Katie Price has asked her Foreign Secretary the Right Honourable Joey Essex to lead discussions in the EU to make orange spray tan lotion exempt from VAT".

 

Almost as believable as Trump being a good President on good terms with his Mexican neighbours.

Yet, the fact that we are similarly motivated — white racists, white allies, and people of color alike — is the key to fixing this whole mess. We must find ways for the working class to maintain its dignity, we must find a way for them to have jobs that are satisfying to them, we must find a way for them to contribute to culture. We must find a way for them to feel heard. Which, by the way, are the exact same goals we need to have for oppressed races. We all need the same thing, and until we find a way to give it to more people, we will fight each other for it.

 

And, America is terrible at giving its citizens dignity and meaning. We have, with the internet, the power for more people to be appreciated than ever before, yet we use it primarily to shame each other. Shaming Trump supporters for being “ignorant bigots” is the worst thing you can do, because their entire motivation in voting for Trump is to alleviate the shame they are already carrying. If you add to their shame, they will dig in further.

 

It is, obviously, difficult to think about ways to reduce shame on a national level but we have to start finding ways to have more appreciation for each other, even those we disagree with. At the most basic level we can start by not explicitly shaming people. We can stop calling them ignorant. We can stop mocking them on the internet. We can stop calling them out on twitter. Unless they happen to be Martin Shkreli, then it’s ok.

I'm not sure I buy this whole "let's not shame Trump supporters" thing. I mean really, they are voting for a racist thug - if that doesn't deserve shame I don't know what does.

 

Well, my wife (who is American and thus gets a postal vote) just tried to talk me out of this approach, saying that even if they are lunatics, calling them names doesn't really help. And I suppose she's right, but I'm at a loss. If we've got to the point where people feel perfectly happy to support a racist thug, and to announce this fact in public, then I don't know what to do except to call out that racist thuggery and hope that those on the margins will choose to reject it.

Once you say, “He says what I’m afraid to say,” and point to a man who is essentially a 24/7 fire hose of unequivocal bigotry, you’ve said what you’re afraid to say, so how afraid could you have been in the first place?
