As I suggested in an earlier post, "excellent conditions" to a normal reasonable person means that given age and mileage, the car has been kept in very good nick.

People determined to screw you over will instead think that "excellent conditions" means as good as the day it came out of the production line.

I would just reply to his laughable claim and wish him good luck in court (he will surely need lots of it).

Never say never. If court is threatened, its always a good idea to get everything in order. Especially if he does go through with the claim. Remember, all they go in is balance of probabilities. So it could go either way.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Not from a private individual ...When you buy a used vehicle from a private individual, you don't have the same rights as you do when buying from a trader. The legal principle of caveat emptor, or 'buyer beware' operates. You do not have a legal right to expect that the vehicle is of satisfactory quality or fit for its purpose, but there is a legal requirement that it should be 'as described'. For example, if an advertisement says 'low mileage, one previous owner', it must be correct. You should check the vehicle thoroughly before you buy it.

Don't know the exact model but a quick google shows up independent gearbox specialists offering recon focus gearbox fitted inc vat for under £500. Depending on how you feel either deny and defend or as a goodwill gesture and without prejudice offer to refund half that an independent gearbox specialist would charge. I'd probably tell him to fook right off - sold as seen - end off. Perhaps he should have employed the services of a professional to check the car over prior to purchase (don't RAC /AA offer this service).
