    • The postcode is an important point. You cannot be in two postcodes at the same time and the contract only covers the F area and not the E area where Met placed your car. See there is some   advantages in with idiots.🙂 The other fact about the electric spaces is that as you are not allowed to park there, the sign is prohibitory so cannot  offer a contract anyway. and another biggie in your favour is you were not the driver and the PCN does not comply with PoFA. I had another look yesterday at the PCN and there is another error since it does not say that the driver is responsible to pay the charge during the first 28 days. Schedule 4 Section 9 [2][b] (b)inform the keeper that the driver is required to pay parking charges in respect of the specified period of parking and that the parking charges have not been paid in full; so that is another nail in their coffin and it s something I would include in  your WS since that is one that every Judge would accept as a failure to comply. As far as their WS is concerned some of them leave it to the last minute to prevent Defendants being able to counteract their claims. However if they leave it too late [ie after the stipulated time] you can email yours to the Court on the last day and complain at the bottom of your WS that you have not received it and therefore you are asking the Court not to accept their WS. In your case it isn't that important since you have a virtual walkover in Court. I would be surprised if they don't concede beforehand. It is a lost cause for them. Not that I would advocate parking in their electric bay in future with a petrol driven car again.🙂
    • I think the post code 0 v O is nonsense personally and would just annoy the judge.  Cases are decided informally at small claims and judges are not interested in the weakest of trivialities. Understood re FY v EY.  So add to the Unfair PCN section that the PCN includes the wrong post code and places you at a residential area rather than the car park in question. You should wait till 7 June before filing your WS - as a Litigant-in-Person you wont't be penalised for being a day late - to see if MET's WS turns up.  It will also give you a chance to see if they have paid the hearing fee.  If it doesn't turn up you can attack them for defying court directions.  If it does turn up you can ridicule their arguments.  Win win. Also you can see if they have bottled it - which they have done with the last two cases we have here. I think the exact points of your WS have become a tad confusing - and I have heartily contributed to the confusion! - so can you please add the latest version. • Thank you Dave for jumping in yesterday and advising not to send off the letter I wrote. I am sorry Clou but I thought at the time that both car parks were owned by Alliance. Before doing a snotty letter does anyone in your family able to alos drive your car apart from yourself and are you the keeper?
    • Thanks for this. UPS never said they delivered to the wrong address. Tracking just showed as delivered. EBay couldn’t find it for weeks and then said they found it and it had chocolate in it. Something clearly doesn’t add up here.
    • Try to think things through logically & legally - the two go together as the civil court system in England is pretty decent and easy to get your head round. 1.  Say you & I got into legal dispute.  Who could sue who?  Well I could sue you and you could sue me.  My next-door neighbour couldn't sue you and your best mate couldn't sue me because the case would have nowt to do with them.  The same goes for a DCA.  It's not their debt.  They can do nothing. 2.  Of course a DCA can't affect your credit score.  If they could, then there would be nothing stopping you picking on someone you dislike, saying they owed you a billion pounds, and affecting their credit score.  Logically there must be more to it than some daft allegation.  CCJs are issued and credit scores wrecked after a judge has decided on the matter and the losing party has still refused to pay.  With nine grand in play the matter will not magically go away but you need to gen up and seperate daft threats from paper tigers from concrete threats which could really cause you trouble. The others are right - you need to inform the original creditor of your address in order to avoid a backdoor CCJ. Also, why did you decide not to sue UPS who have admitted to delivering to the wrong address which in turn led to the theft of your goods?

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If you paid by card, try claiming the whole lot back as fraudulent activity.

Well.. Even though they are clearly trying to mislead people into thinking its a genuine site, they do clearly state ( although its in the small print), that they arent affiliated with DVLA)

  • 1 month later...

I friend of mine used this site thinking it was the Gov site. But its a cloned site if you look up in top corner you will its says 'TaxDisc-Direct' bank refuses to give a refund.

She paid £111 for £71 tax-disc only to get a message telling her to go to the post office.

She has also had an email asking for her bank details so they refund her the money less £8 admin fee.

Don't fell able to tell to give them the bank details.

Anybody got any ideas?

Hi Andy

We did just that having looked at the website we went down thr oute of asking for our £32.00 back leaving just an £8.00 admin fee payable and having given them the bank details and three chases later we did get our £32.00 recredited.

I think it is appaling that these types of site operate and that they give out the DVA telephone number for queries!

At least getting £32.00 back helps!

This site is registered to:

Claire Hall

Unit 2

The Old Stables

West Tisted

Alresford

Hants

SO24 0HJ

Why not write direct and also report the site to advertising standards: http://www.asa.org.uk/Consumers/How-to-complain.aspx

It might also be a good idea to write or email HMRC https://online.hmrc.gov.uk/shortforms/form/TEH_IRF?dept-name=TEH&sub-dept-name=&location=39&origin=http://www.hmrc.gov.uk

as income is being received and may not be being declared.

The original 'taxdiscdirect' complained about, (that's without the hyphen) is registered to:

Belcanto Investment Group Limited

Dixcart House

Fort Charles

Charlestown

Nevis

Saint Kitts and Nevis

So out of reach of UK regulation.

  • 4 weeks later...

This has just happened to me tonight with taxdisconline.uk.com. Right after I had paid I realised something wasn't right, and phoned my bank to cancel the payment. They said they couldn't, and that the site was legit, as it does provide a service. I then went through the genuine DVLA site and paid them for the disc directly, and emailed the fake company asking to cancel the whole transaction and issue a refund immediately. I'm waiting to hear back at the moment.

Surely this can't be legit? The site looks identical to the real DVLA site apart from a teeny tiny little notice in the corner saying they're nothing to do with DVLA at all! Bloody mental, that's what it is...

If nobody has reported this to the ASA, I feel a complaint would be justified. I will be doing one.

The layout of the website is very similar to the .gov website and they use the same colour scheme.

While they do say they are not part of the 'system' this is very well hidden within a large block of text. This should be a paragraph of its own.

If you are asked to deal with any matter via private message, PLEASE report it.

Everything I say is opinion only. If you are unsure on any comment made, you should see a qualified solicitor

I have already submitted an online complaint to the ASAP but I'm sure more than one wouldn't do any harm.

I received a reply to my request for the transaction to be cancelled, saying I would receive a full refund within 48 hours. Guess I'll just wait and see...

It may be legal but it's still a [problem] IMO...

Online companies set up to mimic Government websites continue to trick consumers into paying hefty fees for everything from renewing a passport or driving licence to filing a tax return.

This is despite promises from regulators, Government departments and leading internet search engines to crack down on these websites that charge fees of up to £1,000 for services that are often free on official Government websites.

The Advertising Standards Authority labels them ‘copycat’ sites. Hundreds of readers have contacted The Mail on Sunday in the past month to demand that such websites are shut down. This followed our report on websites that promise to process, for a substantial fee, your self-assessment tax return.
