    • Hi All. I was driving in Stevenage down a 40 road.  After coming off the motor way i noticed my car felt a little "weird" so i accelerated, then slowed the car down.  Shortly after i got stopped by a manned police car with a laser. During the stop the officer stated i was doing 54 in a 40, the conversation was short, but he said i would unlikely get a awareness course and it was most likely 3 points and a fine.  Mrs thought it was a good idea to have dairy when she is lactose intollerant on date night, so we just got on our way.  At the time, i didnt admit to the offence, but did say i didnt realise and had slowed down in any case. The officers chest camera was recording and on. At the stop, he asked where to send the fine to, as i knew i would be travelling to visit family up north, i provided my temporary details at that location in Yorkshire. It is now 05/05 and i havent recieved anything at either my home address in Stevenage or the temporary address. 1. Is there a time limit in which paperwork needs to be sent to me. 2. SHould i query the ticket as i dont want to miss any deadlines (if so who do i check with?) OR should i keep queit. 3. Given nothing has arrived in 20 days, is there a chance of appeal if and when it comes through? Many thanks CrazeUK
    • Hi All. A family friends car was having issues when she was on a trip visiting family up north at the begining of January.  She ended up leaving it at my friends garage in the same location, who parked it on his forecourt to investigate the issue, howver he said most likely it is beyond economical repair as its a serious gearbox fault. In the meantime i replaced her car with one of my spare cars. The insurance on the car then expired in at the end of January.  When the insurance expired, I sent a paper V890 paper as i didnt have her V5 Reference number in hand to do it online (i have a copy of this).  She didnt mention she hadnt recieved any confirmation as she didnt know if she would get one.  She then cancelled her road tax at the end of March (i think) as she was paying by DD. She then was travelling up north so didnt get her ,ail until last week. She recievd a letter dated 09/04/2024 stating she had failed to insure the vehcile and there was a £100 fine which could be reduced to £50 if she respons by 11/05/2024.  As soon as we noticed, i got her to dig  out the V5 and SORN'd the vehicle.   My friend has been a bit slow in checking the fault, however i suspect it will still be scrapped and is still on his forecourt. Is this possible to appeal?
    • worthy to not forget Just to let you know this bunch Kensington have been fined £1.225m by the financial regulator for treating borrowers who were in arrears unfairly. Claim those charges back plus the interest and tell them not to add any more to the account.     • Hi All. I went to visit a family friend in Rochdale on a new housing estate opposite a old row of houses. The location is Royle Road, Postcode OL11 3PE. I was originally parked in parking bays outside the old houses, then moved the car, when I noticed my tyre was flat, so parked on what looked like double yellows to use his air pump to check and inflate the tyres before we left the house.   In the time i went inside to sort the pump and power supply i got a PCN.  The tyre then got changed (has a puncture) and we left. PCN Number:         RE######## Date:             04/05/2024 Time:             20:36 Observation:         20:34 to 20:36 Reported location:     Royle Park Road Reason:        Parked in a restricted street during prescribed hours (Code: 01) I believe this PCN is not correct and has grounds to appeal: 1. My friend who moved into the property around 6 months ago, swears that even though it has old double yellows marked, they are not current or council marked.   He said the property development company had said they had marked them for ease of access during development. 2. The road i was parked on was Royle Road.  The PCN was issued for Royle Park Road, which is about 400 yards up the road. 3. There are no sign posts or marking showing parking  restriction hours in the entire area (there maybe on Royle park Road). I have attached a map of the Location where i parked as a red dot. I have 2 questions: a.  Is there a way to check where double yellow lines are marked on some register to check if they are current? b.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have been having problems with Bristow Sutor over two parking fines. Never received the necessary details from Cotswold DC and the matter was passed to Bristow Sutor. Again never received anything from them until a bailiff appeared at the door without notice. Did not let him in. He wanted £560.48 there and then. He asked about my car parked outside. I told him it was a Motability car. He then went away and two minutes later put a Notice of Seizure Goods and an Inventory of Goods Received through my letter box - and of course he put on the forms - my Motability car. He sped off.

 

I have been following the various threads on here - very informative thank you, and did what was advised to other similar cases. I am considered a vulnerable person, I am on the highest level with DLA for both care and mobility on an indefinite basis. I suffer with a chronic disease and only came out of hospital 2 days before the bailiff visited, having undergone further heart surgery. I suffered a major heart attack last July and this has left me in a very poor state. And this is not helping.

 

I did as was advised to other people on here and sent a letter to Bristow Sutor explaining my vulnerability and asked for the case to be returned to the council. Received an email back a few minutes ago saying they would not do that.

 

I also copied my letter to Cotswold DC and they have received it and they say they have forwarded it to the relevant people.

 

As you can imagine this is doing nothing to for my health at all and I am experiencing similar bad heart pains to my heart attack, although I don't think I am having one!

 

The tickets were given to me when I parked in a safe place to visit the toilets, showing my disability badge and clock.

I explained to the council why I parked where I did for 5 minutes at a time, I had only come out of hospital two days prior to this, my wife drove me for an afternoon out, I was not allowed to drive at that time. To spare you the nasty details, the medication I was taking meant I had to visit the toilets quite frequently.

 

What can I do now do you think.

There is a process to appeal these parking penalty notices and to put a stop on any collection activity while this matter is reviewed.

 

If you contact the Traffic Enforcement Centre (see link below) to explain your situation, they can email you an Out of Time application, which you complete and email back.

Why was it refused ?

 

Suggest that you try to phone the council and if you have any difficulty, phone a local councillor this evening, who should try to help you.

The letter from the TEC did not give a reason, and it says they are not required to give an explanation.

 

Have phoned the council and Bristow, each one saying I should contact the other!

Get straight onto your local MP and Councillors and tell them in no uncertain terms that if they again fail to call off the bailiffs and deal with this matter in a mature manner you will take legal action against them.

 

Inform your local papers and BBC Watchdog, there is also the LGO who will take up your case as it seems your LA is completely incapable of using any modicum of common sense...

It IS the councils responsibility, NOT their chosen third party thugs, tell them that they WILL deal with it and you are not going to be threatened and bullied by them, ensure you take down the names of everyone you speak to at the council, blooming reprobates!

FAILED!!

 

Find the names and numbers of your local Councillors and MP and have them deal with it.

 

Time for a very firm and strongly worded letter/email to the council, they cannot simply wash their hands of their responsibilities and tell you to deal with their chose third party in order to sort out their problem!

 

It is the councils responsibility, DO NOT ring the bailiffs, DO NOT even speak to them, either at the doorstep or over the phone.

 

Keep everything in writing if possible, but ring your local MP/Councillors and have them slap whichever fool was on the phone spouting utter nonsense!

Ok, will not contact the bailiffs again. Is there a template for a suitably worded letter to the council - I am not asking you to come up with one!! Everything has been put in writing to date.

Off the top of my head I can't think of any no.....

 

I would definitely recommend contacting your local MP/Councillors ASAP though, the bailiffs CANNOT FORCE ENTRY, just don't leave doors open/unlocked nor windows open if you live on the ground floor, if they come to the door, either ignore them or speak to them through the letter box.

 

Regardless of what they might say and claim they can do, they CANNOT use a locksmith to gain entry, but these thugs aren't my area of specialty really others are well versed in advising you what to do if they should appear...get ringing your MP & Councillors... :thumb:

I am sorry about your problem with the bailiffs. Can you think of any reason why you did not receive any notices from the Council? Have you moved home recently or is your address similar or

confused with another?

It would be a good idea to check with the Council to confirm the address to which they sent all your notices. If they have sent them to the wrong address that should be sufficient reason for

the Council to look at your situation again

 

PS Have you told the Council of your heart condition thereby classing you as vulnerable and ask them to kindly handle the matter themselves

rather than using bailiffs.

I live in the Vale of White Horse DC, should I find my local one there even though the fine was for a different council.

 

Probably you should contact your local councillor, but as they are not on Cotswold DC then they may not have the same level of access as a councillor on Cotswold DC.

Yes I told them about my condition yesterday via email. They acknowledged receipt. I emailed the same letter about an hour ago - acknowledged again. Not from an autoresponder I might add.

I am sorry to ask so many questions but very often it is necessary to go back to the beginning to see where the error had been made.

 

You have a Motability Car and sadly many such cars are wrongly registered with DVLA.

 

In your case, do have the DVLA registration document in your name or is this kept with Motability?

 

 

After receiving a ticket on your car did you receive any further notices from the council such as: Notice to owner, Charge Certificate or Order for Recovery?

 

When did you file the Out of Time witness statement?

 

When was it rejected?

 

Did you receive a copy of any documentation from the council after you sent the Out of Time application?

Thanks for replying Tomtubby. I do not have the reg. document and Bristol Sutor have cked with the relevant people and acknowlege it is on Motability.

 

No notices from Cotswold DC

 

Filled out Out of Time notice 31.5.2013

 

Rejection letter dated 10 June

 

Yes I did, and they listed dates info was sent to me - I never received any of it.
