If they continue after all that, consider legal action for harassment. You will win and you'll find they'll quickly settle out of court.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

You are entitled to get copies of his credit files as administrator of his "estate" the same way you are entitled to see yours .

 

 

You will probably have to send a copy of the death cert and an affidavit witnessed by a solicitor

(costs about a tenner to get them to sign if you write it out but the wording has to be right so look it up).

 

 

Commonly called doing a swear- and send it to the CRA's.

 

As suggested, once you have the credit files data and find your address is linked you can go after the companies involved

for deliberately processing false data

 

 

as the only way the linking could have come about is by them deliberately adding your address when you first contacted them,

without any authority or cause.

 

Read other [posts to find the names of the people at the top of the heap for these companies and write to then directly.

 

 

Let them know that you are going to sue for harassment and expect to win several thousands of pounds in damages

 

 

as they know that their actions are based on false data they have refused to correct and they would know the likely effect of the harassment.

Thanks so much guys for the absolutely solid advice.

 

I'll get cracking and get a copy of his credit files. Until then I will certainly take the advice to ignore them, keeping all evidence. It's all too easy to get involved on the phone with these clowns out of frustration, but quite right, I'll need to refrain from that; although one creditor had his 'hair off' after he told me I would "Hear no more from them" and me telling him that call was recorded! Can't think why he was so upset.....

 

Didn't realise dealing with other peoples debts was going to be so stressful, although sites like this one are a major help in delivering stress relief I can tell you! I am genuinely grateful to you all.

dont forget, the debts dont exist if your father had no estate. They died with him.

Estate is defined as property, cash, stocks and shares and in certain cases valuable assets such as cars paintings and jewellery. These will count if the total value is more than the threshold for death duties which is currently £350k. Everything else is personal effects.

Deceased persons pay for their own funeral but not the sandwiches afterwards so knock that off the value of the "estate".

And remember, these are DCA's chasing him. They pay a very small amount for the debt. Normally 7-15% of the entire amount, then they get greedy and chase whoever they like for the full amount. You MUST report it if they have recieved the death certificate and they are still harassing you. Think of how many others they are doing it to and how many actually pay up.

Definitely no estate certainly not £350K! "Sandwiches after", that made me smile!

There's no way I'm going to let these swines get away with this. I'm currenty in the process of getting the proof I need to obtain my dad's credit report. I think I'll have a much clearer picture of whats what then. In the meantime I'm going to keep gathering as much evidence as I can, then report them to every authority in the country! Then hopefully, I'll make them pay for the upset and stress. One thing is guaranteed, they ain't getting one penny from me.

There is a particular DCA, Phillips and Cohen, who 'specialise in deceased persons debts' so watch out for letters and calls from them. They also apparently have 'dementia friendly trained specialist customer service staff' whatever that means.

 

The 'moral' stance some DCAs take over the deceased debts is astonishing, some DCAs back off quickly, others persist for some time, even beyond when probate has finished.

 

I'm not a specialist in this area but I am learning about it from my elderly neighbours, hope to be able to help them wherever possible,

 

If I find out any info as to who you can report them to - I would also consider the local Trading Standards and the local Action Fraud people at the local council.

Ferguson V BG for harassment and Durkin v DSG for false reporting. get your evidence, give them a chance to make amends and thenhit them if they continue to give you problems. Mostly though, it will be huff and puff from them, which is annoying but harmless in itself but not in the effect it has on the bereaved..
