Reply in 24 hours Westy - must be a different Cobbetts we're talking about. They still haven't replied to my rejection letter of 4th December which included the line "it has always been my intention that my claim is fair, reasonable and transparent".

 

We obviously share the same taste in sarcasm;)

Hi Paul (and everyone else)

 

In the absence of comments or cautionary words from anyone, I have indeed replied on Thursday 4 January and I did it Special D, coz I like the Elvis reference so much! (Return to Sender, for those who are wondering).

 

I have been at the supermarket, the shops and sitting at home and...the only conclusion I have been able to arive at is: they're stuffed. They didn't present a proper defence in time and I will only agree to an extension if they provide the info on their true costs, etc. And we all know the chances of that are so slim as to be anorexic.

 

So I may get settlement by the end of Feb after all. Or even earlier!!!!

 

Hurrah!

I have my hearing for application to order response to my part 18 request on 17th January. If the judge allows it then they will be required to disclose "their actual costs for each and every charge particularised by the claimant" so hopefully between us we have them well backed into the corner.

Here's a laugh for you all.

Since 9 November (the last charge included in my claim) the bank has hit my account with £178.14 in charges, including £114 for DDs and SOs I'd cancelled!

There's £9 for goodness knows what; £28 management fee (to be expected) and £27.14 for - well, anyone got any ideas???

 

Some people never learn, do they? That brings the total I'm after them for very close to £12K. I've never had that much in one hit from anyone before!

I'm rather looking forward to it!

Mine's similar. I have to file another claim, obviously. I'm thinking about going to the contractual rate rather than statutory next time. The next claim will be small beans compared to the first.... until I add 29% (or thereabouts) :Dinterest! Whoo Hoo!

After submitting that well-thought out and blistering (some may say) letter I got a letter from the court today!

 

Could it be...could it be...an order to NatWest to send in the documents?

No, dammit, it's a perfectly standard allocation questionnaire.

 

Oh, b*gg*r:mad:

 

Ah, well, I'll just have to request the order with the AQ. See if that works. It's a fast track AQ so I may well need some help, at least to check it over.

My claim was well over £5K at outset and the £100 for the AQ takes it rather close to £12K. If they leave it till early February before settling, it will be over £12000.

Hi, all

 

Brief reply as I'm still very much under the cosh.

 

Even tho I'm on fast track, I'm going to ask the Court to issue the Draft Order - as well as asking for standard disclosure. Hope they don't get peed off!

 

Nothing from Cobblers since their paltry offer. Nothing in my bank account, either!! They haven't come back about the interest: they kindly told me I could only claim 8%, not 8% plus statutory interest.

As they'd failed to submit a proper defence - and therefore hadn't raised the interest question at all - I wondered in my reply to their letter why they were seeking to raise it now. Nada response.

 

I have got something out of the Bank, though: £140-odd refund of charges since October. Not all, but most. So I won't have to take them to court on those ones.

 

Nice, but left me with a strange kind of unfulfilled feeling!;)

 

Must dash again - two articles to write and the AQ to get in to court. It's due tomorrow at the latest - by when I shall be in Cheshire for the day!

Westy, how come they refunded some charges since you filed? They didnt with me!

 

The fact they were for bouncing DDs and Sos I'd cancelled may have had something to do with it!!
