    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well done - sounds like your day has come:D

i take it from your last comment that once a CPR Part 18 request has been made then its a pure 'countdown' to a date with no potential interruptions - or is this naivety on my part?

also, who requests this? Courts or you?

enough questions...enjoy your night in with Jack

Hi, Sod

Yes, it does sound like it. Will be awaiting the postie with huge anticipation tomorrow!!

I made the CPR Part 18 request of them. They did not make one of me. Have a look further up the thread to see what I said - and the circumstances. I think it was the tipping point but not everyone will have the same opportunity.

Hello Natwesttookmymoney

WELL God If anybody deserves it you do. You have helped so many on this site and you have given confidence to many to continue the fight that you have now won.

I respect and honour you. Without your help (and Deller1) sorry I adore him too. I thinK I would have given up when the going got tough but you were always there to push me on with advice and support. This is probably very selfish but enjoy your triumph but Please Please do not desert us, we need you to continue the fight.

Lots of good wishes and luck to come your way. (I am a witch(a white witch) you know I dont have a cat, I have a ferret. Its more modern and they don't burn you at the stake!!!!

I would be overcome if I wasn't such a conceited, smug, self-satisfied, puffed-up, arrogant b*gg*r.:D

thank you all - it makes me feel quite humble!

And hellhasnofury - were you responsible for my fab round of golf this morning and my call from the USA this afternoon? 7-under this am, equalling my best competition round on that course; the work I thought was going to go into June has been compressed to the next few weeks - which is v handy, in the light of other stuff happening.

On the strength of all that good news, I bought a lottery ticket this evening. I shall be v disappointed if I don't win!!

I may know how to do the job but I'm not sure I want the responsibility.

I think I shall seek the position of 'eminence grise' and get the power without responsibility - the prerogative of the harlot throughout the ages!

Thanks, peeps.

As for not spending it all at once - that is beginnign to get a bit difficult!

Have I won the lottery?

I'm in that interesting position of quite possibly having done so.

I say that because I'm in the middle of a Schroedinger's cat-type experiment - the one where a cat is locked in a box with a lump of radioactive material. While the cat remains in the box there is an equal chance that it is alive or it has died of radiation poisoning. You will only know for sure when you open the box and look.

(What you're then likely to find is that the cat has become bored waiting to be killed by either radiation or starvation (the experiment never involved food and water) and has used its powers of matter transportation to get out of the box and go and settle down in front of a fire somewhere. I know this seems the least likely outcome but my cats do it. If they're really keen to go and hunt something they find a way out, even if I'm not there. Or, more likely, they use those powers to come in out of the wind and rain and cr*p on my carpet, in the warmth and comfort of their own home.)

In short - I haven't checked my ticket yet. So I may have won or I may not - either is equally likely, at this time.

What a nice position to be in - I may be a lottery winner!
