      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am curious as to what happened with the purfleet trust.

 

Didn't happen. Casper needs a referral from the council, which isn't completely unusual.

I this is the first time I have ever had a sanction that I remember. My compliance officer asked me how I was living with all these sanctions from last year. Even my mum was stumped on that one. She knows I was never sanctioned last year. I need to speak to the CAB about the court thing. As I have put down I am living on my mum's sofa I am hoping I'll get an higher band. She said it would take 10 days.

I didn't go today as I was up last night being ill. I have an appointment tomorrow with job centre, and I will go int Ingeus. If I remember. I always forget to go in there. Last week I tried making an appointment with them, and yet to receive an appointment.

refuse to repeat myself again, Casper go to the JCP and ask to check how many sanctions you have received and the periods of the sanctions imposed.

That is the only way you will know and tbh how the heck would you not realise you had lost money?

I didn't get sanctioned last year. I know that for sure. All last year I was at Ingeus. I may have been sanctioned when I was in my teens, but not last year.They may have it wrong. The woman interviewing me said she didn't have my records infront of her.

I'm going to be completely blunt here, Casper. People on this thread, myself included, have struggled to believe your story at times because you're telling us that you've received a 26 week sanction without ever having been sanctioned before.

 

As Flumps has very patiently been telling you for weeks, it just doesn't work like that. If you have been stuck on a 26 week sanction without receiving a 2 week, 4 week and 13 week sanction first, someone has made one hell of a mistake. I'm not saying that mistakes don't happen, but you don't seem to be doing anything to sort it out!

 

If the Job Centre told me that I wouldn't be receiving any money for 6 months and I knew I had never been sanctioned before, I wouldn't leave until someone explained to me why it was happening. You can't keep putting things like this off!

 

If you only do two things today,

a) Speak to the Job Centre and find out why this sanction is for 26 weeks.

b) Speak to the CAB and ask for help with the County Court forms.

I may have had sanctions, but have no memory of one. My dad phoned someone to help with the court thing. He made a list of things the landlord never fixed. And will see them in the morning. Don't know if he wants me to come.

I tried phoning job centre to change my address, but the man over the phone said the information I gave him was incorrect. I told my mum on Monday, after asking job centre for a change off address form, that I was claiming income support. She told me that she was on there and that I couldn't be on there. I was told months ago, in September that I was on income support, and even saw my adviser who even told me that. She's on income support because she looks after my nephew.

This may be why I had given the man incorrect information, because I had said job seekers.

I was on the line for half an hour. Not doing that again, so going up there tomorrow to ask for forms. Maybe ask to see an adviser. Because this is really getting on my nerve. There I can ask why I was sanctioned.

 

I started my claim when I was 16-17, I can't remember. So back then I could have had one, but really have no memory of one.

I may have had a 2 week one. But not a 3 month one.

Casper i think you need referring to adult social services as this is obviously too much for you to handle.

I can not believe that you have not been able to sort this out.

 

I'm afraid I agree with this completely. I sincerely hope that your referral to the Purfleet Trust is successful, because a forum isn't an appropriate place for you to get advice.

Please let us know how you get on with them...I'm sorry I can't help you, but when you're not even sure if you're in receipt of benefits, it's just not practical to give you any advice.

What annoys me about this sanction is when I first got the letter. It was originally from 27 September-11 October. When I rang them when I got the letter, they said it wasn't from those dates. And instead of a 2 week sanction, which I expected it's a 6 month one. I don't have an appointment for tomorrow, it's monday. And my dad hasn't even told me who I'm suppose to see. I'll ask him tomorrow about that. If I get a higher band, do I still need to go to Purfleet? I'm hoping I do get a higher band.

Why do you say Income Support one minute then change to Job Seekers?

If you were claiming JSA you do not go straight for a 6 month sanction even on work program as I have posted time and time again.

On IS you would receive a sanction if you failed to attend an advisory appointment but you would need a condition of entitlement to claim and receive IS and that sanction wouldn't be a fixed period of ti,e it would be until you attended the advisory appointment and then the withheld period of the sanction would be back paid.

You have repeatedly stated throughout this thread which was started on 18th October that you receive JSA and were sanctioned because you failed to attend an advisory work program appointment due to being unwell.

Please can clarify that it is JSA that you are claiming (albeit not currently receiving payment)?

I apologise now but managed to grab 5 minutes at work today and the previous sanctions would have definitely been 2 weeks initially followed by 4 weeks before jumping to 26 weeks) so I'm sorry but prepare yourself for notification if you do decide to visit the JCP office to discuss your sanctions as having received 2 previous work program sanctions in the duration of your of your claim they were not linked to any sanctions prior to referral to the work program .

Somehow I seriously doubt you will go to the JCP and get the forms to change your address let alone discus previous sanctions. ps the form you will need is JSA3 to declare the change in your circumstances.

 

I would recommend that you do attend with you Dad to see the people about the court proceedings. It isn't fair to leave your dad to deal with the rent arrears and court proceedings by himself is it?

Because my mum says I am not on income support, and there is some mix up. If I am on income support then I shouldn't sign on. That's what she says. She takes care of my nephew and on income support. I was told I was on income support over the phone AND face to face with my adviser. I have been on the work programme since June 2011. While there I had no sanctions, I will go tomorrow. But I was on JSA and they changed it. I don't know why. I have never worked, I have tried so hard to find work. I even volunteered in 2005. But wasn't allowed on the till. I handled money and that. But that doesn't get me far.

I filled in a form before, which I should have done this time. I have to go up town anyway. I want to know why Ingeus hasn't sent me a letter about my appointment. I changed my address back with my mother's address and they have my phone number. Going up there too.

What condition of entitlement do you have to claim Income Support?

Are you a lone parent with a child under the age of 5, on the old Incapacity benefit or severe disablement allowance or are you a carer in receipt of carer allownce?

If none of those apply then JSA is the benefit you are claiming which is where you attend the JCP once a fortnight to sign on and atend the work program in your case pm a regular basis.

They wouldn't just change you from JSA to another benefit you would physically have to close your claim for JSA yourself and have acondition of entitlememt as stated above to claim IS or ESA if you have a fit note from your GP and then you wouldn't be attendin the JCP every 2 weeks to sign on.

 

So Casper what do you do and which benefit do you claim but not currently receive?

JSA then. Why would they tell me my benefit was Income Support when it wasn't? But then why would the guy on the phone say I had given him incorrect info, when I didn't?

Since September I had been thinking I was claiming Income Support, why the hell would they do that? Sounds stupid.

tHe only explanation i can see is they told you it was income based job seekers. I do not know but even with sanctions aren't you expected to sign on?

 

I am truly sorry but how can anyone help you when your story changes.

You have never worked but you had a job in a factory where no one spoke English,you volunteered but as they didn't let you on the till, what happened? That would have been a help in team work and social integration, and self confidence. That is a major reason i want to volunteer at MIND.

I said I wasnt going to get involved again because of the merry dance we're in, BUT your story is so rediculous I now know you need support, Not your mum or dad but from a professional - this thread said "Being made homeless due to the jobcentre", it should read "being made homeless because of myself" can you see why? Do you understand that by not taking advice, not following up on things has made your

situation much worse. Like others have told you Casper, you do need support. I don't want to throw something else into this already jumbled hotpot but if you went to your doctor with all you have told us, I'm sure he/she would refer you.

This is really hard. I feel that i am banging my head against a brick wall or being taken for a ride BUT what if Casper is genuinely in need of help. If so fine,if not they should hang their head in shame at the way they have abused peoples compassion.

This is exactly how I feel Fletch. Couldn't have said it better. At this point, the only thing that makes me believe that Casper is for real is that it boggles my mind that someone would waste this much of their own time on doing this. In fact, I would suggest that if this is a wind up, the person concerned still needs help.

 

Casper, you asked earlier if you should still go to The Purfleet Trust. I understand that you were told that you needed a referral from the Council for them to house you, but to be honest I think that you should go there as soon as possible and say you need to speak to an adviser urgently. You need to go through this whole story from start to finish with them, before they receive your referral from the Council. It's very important that you do this, because unless you speak to them I doubt that they'll understand the level of support that you need, and they'll just treat your referral as a general request for housing.

 

As I have already told you, they can offer help and support with far more than housing - they have a benefits advise service and also run several courses to help the long term unemployed.

I suppose it is income based. I didn't count the factory work as it was only 4 hours. When I wrote never worked before,I never have worked for money. I was 16 when I went to the factory so don't know if I have ever gotten paid.

I'm not in the mood today as I have a chest infection and will be booking an appointment for tomorrow.

 

I'm crossing my fingers I get a higher band.
