    • all DYL's are subject to a TRO. looking at this newish, ever increasing as old ind units have gotten removed, estate, there are only lines on one side, on the other there is a parking lane with traffic calming through which you mention. i seriously doubt your mate has any clue what he is talking about.!! its not a private housing assoc estate. so its a public council owned road. no construction co can just decide to draw their graffiti on a road. the DYLs are certainly there pre 2016 even before his home was built. now ive had a quick look to see if the main access to royal park road has signs. there is no royle park road even on your map but there is a royal barn road which leads to where you are parked royal road has a restriction sign on the pole by the fence of the electric substation jnc with gipsy lane there does not appear to be one leading in from the other end - tesco petrol station
    • Hi All. I was driving in Stevenage down a 40 road.  After coming off the motor way i noticed my car felt a little "weird" so i accelerated, then slowed the car down.  Shortly after i got stopped by a manned police car with a laser. During the stop the officer stated i was doing 54 in a 40, the conversation was short, but he said i would unlikely get a awareness course and it was most likely 3 points and a fine.  Mrs thought it was a good idea to have dairy when she is lactose intollerant on date night, so we just got on our way.  At the time, i didnt admit to the offence, but did say i didnt realise and had slowed down in any case. The officers chest camera was recording and on. At the stop, he asked where to send the fine to, as i knew i would be travelling to visit family up north, i provided my temporary details at that location in Yorkshire. It is now 05/05 and i havent recieved anything at either my home address in Stevenage or the temporary address. 1. Is there a time limit in which paperwork needs to be sent to me. 2. SHould i query the ticket as i dont want to miss any deadlines (if so who do i check with?) OR should i keep queit. 3. Given nothing has arrived in 20 days, is there a chance of appeal if and when it comes through? Many thanks CrazeUK
    • Hi All. A family friends car was having issues when she was on a trip visiting family up north at the begining of January.  She ended up leaving it at my friends garage in the same location, who parked it on his forecourt to investigate the issue, howver he said most likely it is beyond economical repair as its a serious gearbox fault. In the meantime i replaced her car with one of my spare cars. The insurance on the car then expired in at the end of January.  When the insurance expired, I sent a paper V890 paper as i didnt have her V5 Reference number in hand to do it online (i have a copy of this).  She didnt mention she hadnt recieved any confirmation as she didnt know if she would get one.  She then cancelled her road tax at the end of March (i think) as she was paying by DD. She then was travelling up north so didnt get her ,ail until last week. She recievd a letter dated 09/04/2024 stating she had failed to insure the vehcile and there was a £100 fine which could be reduced to £50 if she respons by 11/05/2024.  As soon as we noticed, i got her to dig  out the V5 and SORN'd the vehicle.   My friend has been a bit slow in checking the fault, however i suspect it will still be scrapped and is still on his forecourt. Is this possible to appeal?
    • worthy to not forget Just to let you know this bunch Kensington have been fined £1.225m by the financial regulator for treating borrowers who were in arrears unfairly. Claim those charges back plus the interest and tell them not to add any more to the account.     • Hi All. I went to visit a family friend in Rochdale on a new housing estate opposite a old row of houses. The location is Royle Road, Postcode OL11 3PE. I was originally parked in parking bays outside the old houses, then moved the car, when I noticed my tyre was flat, so parked on what looked like double yellows to use his air pump to check and inflate the tyres before we left the house.   In the time i went inside to sort the pump and power supply i got a PCN.  The tyre then got changed (has a puncture) and we left. PCN Number:         RE######## Date:             04/05/2024 Time:             20:36 Observation:         20:34 to 20:36 Reported location:     Royle Park Road Reason:        Parked in a restricted street during prescribed hours (Code: 01) I believe this PCN is not correct and has grounds to appeal: 1. My friend who moved into the property around 6 months ago, swears that even though it has old double yellows marked, they are not current or council marked.   He said the property development company had said they had marked them for ease of access during development. 2. The road i was parked on was Royle Road.  The PCN was issued for Royle Park Road, which is about 400 yards up the road. 3. There are no sign posts or marking showing parking  restriction hours in the entire area (there maybe on Royle park Road). I have attached a map of the Location where i parked as a red dot. I have 2 questions: a.  Is there a way to check where double yellow lines are marked on some register to check if they are current? b.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'd get trading standards to help you make a formal complaint first off, then take it higher from there - perhaps even physically going to head office, then demand to speak to someone, telling them you have a serious complaint.

 

I'm a believer in not giving any retailer, let alone such a big one as this even an inch of compromise when it comes to quality and what they actually deliver!

Thank you DW, Tilly has also advised me to go to trading standards which is the route I am going to take. My suite is wearing through after only 3 years, my husband and I both out at work, not spring chickens and our family has long since flown the nest. I have been complaining about this furniture for a year now, I have copies of the letters which have gone between us and the e-mails. I am so angry with their attitude that I am willing to take them to the small claims court myself if needs be. You can be sure that Iwill take every opportunity to make my complaint very public. CSL are no more than cooperate bullies in my opinion

Over any "ombudsman" I find court action preferable. Give TS a shot at sorting this, then LBA and court imho.

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

I want to make a formal complaint about the bag of rubbish I bought from CSL Sofas. Which do you think is the best organisation to complain to?

 

Why would anyone want to buy a bag of rubbish?:|:razz:

Make a formal complaint and bullet point what you want as a resolution. Give them 14 days to respond.

 

After the 14 days, if no resolution is given, then send them a LBA detailing exactly what you want as full recompense and what you will do if they dont agree or come to a resolution.

 

If still no agreement after 7/14/28 days, then enter a claim in MCOL for the amount you want to claim back or what you would like.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

There's some great advise you've been given on here Hills!

 

I can't believe that after only 3yrs it would be wearing already!!!! Also, with you saying it's just you and Hubby, not only that most of us have seen with our own two eyes on may the best house win that you're house is far from a chaotic one, with parties and/or people lounging all over them 24/7, although even if you did - are suites not supposed to be used? Or are they just built for show nowadays?

 

Keep every record of every letter sent and received, every name, date and time of every person you speak to - and wherever possible, record any telephone calls (this has covered my back many a time in situations like you would not believe Hills, the smug feeling when someone complete denies saying something, and you can produce the conversation is unreal lol! And contrary to what people believe, it is not against the law and you don't have to inform them you're recording it, unless you're a registered company).

 

They won't want to go to court trust me - so if you have to, make it clear that this is where it will end up!

Letter to trading standards went off recorded delivery yesterday, along with copies of e-mails and letters etc. Also sent copy of 5 year guarantee which they could not possibly honour as material is no longer in stock. Sent a copy of the invoice as it cost quite a lot of dosh. In their hands now for the time being.

Hi,my old furniture is looking really bad, especially my armchairs…I have moved to another county these days , and as you all know it can be a big mess. So what I want to ask here is - can someone offer me a firm that sells furniture in Leeds. What I need is something comfortable and stress releasing. Armchairs, sofa and mattress that can make massage? I’ve heard something about different firms here, but I’m afraid that I don’t have enough information since I’ve moved in just now… Can someone tell me more about adjustable beds and armchairs from experience?

Hi Ann, congratulations about your desicion, Leeds is a great palce to live. I know one firm here which is selling furniture that can make massage and it is Dreamwell. I’m sorry but I havent experienced it. From what I’ve herd it is comfortable and makes good massages…I know this information is not enough at all, lets hope someone can give you more.

I have received a letter from the ombudsman which says they will be contacting CSL. They also say it can take up to 4 months to resolve a dispute. Both fair enough. But they also say they may require samples from my suite. It looks bad enough without me cutting chunks out of it!

Hi, my grandma is from Leeds and I think she has bought an armchir from Dreamwell. She complaind about it being expensive, but after a week using the armchair she was really pleased with her chiose of bying it. All I can say is if you like you can call them for more furteher information. My grandma said they were really kind to her. Went to her home and have explaind everything she needed to know, even they staid making company to her for 3 hours, if this doesn’t bother you, you can call them : 0113 394 6380.

cassidy871, your information was very useful for me. I have called Dreamwell firm after I saw your post and I bought from them one adjustable bed and two armchairs. I have to say that I am really impressed by my new adjustable bed. I have been using it and the armchairs already for about two weeks. It appeared very comfortable and I really enjoy how they make massage. Thanks for the information again.

Hello,

I noticed your post regarding Csl issues and wondered if you could advise me.

We bought 2 and 3 seater sofas ar the beginning of September. They were delivered on 03/11. The same day we noticed a tear on the 3 seater. csl send someone to repair at home. He couldn't do it. Took the leather away for 10 days. We got around 150.00 compensation. Which was fine. The problem is that the leather was now way too lose and wrinkly. Our sofas look like 10 years old sofas. Not a month old. Everyone I know who saw the pictures was disgusted. It is really bad. Csl claims it's wear and tear (after one month for two seater and 14 days for the 3 seater!) and there's nothing wrong with my sofas.

We are concidering our next step and as I see you already went through all this so I was wondering if you could advise me. Did furniture ombudsmen help? Did you have to pay for their services?

I'm really sorry to bother you but I really need some help.

Hiya. Thanks a lot for replying.

The first problem we had was with the stitching in the front panel. there was a tear in leather just next to it. Looked like not enough leather has been used. We had a feeling it would not be possible to repareally our house but they saw the pictures and they assured us the repair could be carried out in our house.

The technician took the whole front panel away (both cushions that you sit on) and brought it back after 10 days with the stitching repaired. We were not over the moon about leaving us with an unusable eye sore for 10 days but we accepted it.

The actual problem started when he put the leather back on the sofa. The leather now is all crusty and wrinkly. Looks like it's way too lose and it realy looks nasty in my living room. i wish i could post some pictures here ( they have been posted on cls facebook page if you are interested). Csl send someone over. To be honest the bloke did not seem to be interested at all. After a week of them not contacting me I phoned again yesterday. Apparently the specialist said that there is nothing wrong with the sofa. they say it's wear and tear (after a day from the repair and not even a month from the delivery!!!!) They offered a chargeable repair. If you look at the picture of the sofa they have online or the sofa they have in their show room it's nothing like what's in my living room!

I requested a manager to call me back. I was assured it would happen today. But no-one bothered.
