We have a blue badge and a parking bay outside our house

 

got home from work around 9.00 pm and forgot to put blue badge on car, received a ticket ant around 9.30pm and to my horror another ticket at 7.30 the next morning . I wrote to them as i think the 2nd ticket is a blatant **** take but they are saying i have to pay both. I am willing to pay the 1st bt wold like some advice....

surely a copy of the BB should null any ticket...honest mistake?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The DfT Operational Guidance to local authorities instructs in section 8.46

8.46 If two or more PCNs are issued within 24 hours for the same contravention,

that is, to a vehicle that has not been moved, it is current practice to cancel

the second PCN. It may be sensible to review both PCNs and cancel the one

with the least robust evidence. For instance, if the digital photograph for one

was taken in the daytime and the other at night, the one taken in the light may

well be clearer. If one PCN is at the higher rate and the other at the lower rate,

the lower rate PCN should normally be considered first for cancellation.

 

Although this is only guidance not law, it is a code of practice that authorities cannot ignore.

send a [1] saying that you forgot to put your disabled badge in the car, even tho you have one.

see what they reply - if it is leeds CC, you have no chance. if it is Wakefield, every chance. any other LA, depends.

You do NOT have to pay either...........disabled bays outside residential properties are NOT enforceable.............contact your local council

 

Is that a fact? What about if the bay is supported by a plate?

Not enforeceable unless sign on post indicating it legally enforceable.

 

Take photos of there being no sign, then tell them it not enforceable.

 

Chances are they will reply saying "this time we will let you off bull****."

 

You watch that sign go up if they legally can enforce those bays.

it won't help.

the plate is there, so the bay IS enforceable.

 

Your best (only?) hope an appeal is to send them a letter(email) enclosing your blue badge, and saying you simply forgot to display it.

Technically, you *are* a disabled badge holder, so are entitled to park there.

You've been given a pcn because the traffic warden/ceo didn't know you are a "disabled badge holder".

If you prove that you are a BB holder, they *might* let you off.

depends on the council - leeds city council never (in my experience) approve a first appeal.

Wakefield Council are MUCH more reasonable (in my experience).

Your luck would depend upon whichever council you are appealing to.

If there is a sign saying 'Disabled Badge Holders Only' then the bay is ENFORCEABLE. Forget what the other poster is saying that it is not... I can assure you that it is which is why you got a ticket. But you should still appeal sending in a photo copy of your badge explaining that you simply forgot to display it.

I think what many people confuse about disabled bays outside a residents house is that it is for their own personal use, which isn't true.

 

It may be true that the resident applied for it's introduction, but it can't be "protected" just for them as they cannot mark it for a specific person and anyone displaying a blue badge may use it. It is true though that if it correctly marked then anyone not displaying a BB can be given a PCN.

Hi

 

Something thats been missed here is yes they have a Blue Badge but that badge when issued comes with a booklet outlining the Blue Badge Holders Rights and Responsibilities.

 

The Op failed to displayed correctly a Blue Badge in I assume a Disabled Bay which had the relevant signage as well.

 

As this is a Parking Concession given to Blue Badge Holder you must still abide with the concession rules and must display your Blue Badge otherwise you as has happened may be issued a parking fine for not correctly displaying that Blue Badge.
