The only thing I can see is that you need to make a change to one word.. as follows:)

 

 

I further reject your claim that this alleged debt is NOT statute barred and do not accept

your claims the I have ever made any payment to Scott Call or Call Credit.

 

The highlighted word should read "that"

I've just sent an email to the OFT detailing this issue with 1st Cretins, asked for a response I've not attached any letters just yet, although I've said I'm happy to send everything to them.

@CitizenB - I think it's just another incompetence on thier part. They'll say anything I'm sure. It's like having a new pen friend, we make up stories to please each other lol. Every letter I get now gives me a smile, better than getting bills through the door.

I doubt OFT will do anything in respect of an individual - but they will add your complaint to others made.

 

I think it is important that any relationship between 1st credit and Call Credit be investigated, that's for sure.

:madgrin:This £5.50 sounds very much like a subscription fee, normal payments

made as a ''one off' are £1, £5, £10.

I would like an explanation for Call Credits involvement, they do

have a rather amateurish collections department, so one wonders

IF a subscripition has been to paid to CC for a CRA report has it/ could

it have been diverted to an account their collections dept. was handling??

I find it rather suspicios but that's just professional habit

The payment certainly didn't originate from me, and doubt very much if they the information anyway.

 

The more disturbing thing for me right now is the phone call today from a Mr Brown at 1st credit claiming to be able to get money from my mortgage to pay this debt. They've written to me in the past saying they can see from my credit file that I'm financially able to pay the debt. Can I stop them from looking at my credit file??

 

What gives them the right to behave in this manner.

 

Regulators complaint in the offing here to FSA as their guidelines state they cannot make statements which are untrue., Look thru FSA guidelines updated and you will get a better idea of the false statements they are making, enough people complain then action can be taken by the FSA etc. were 1st credit not cautioned in the past of their statements etc?

And ignore my reference to forward a complaint to the OFT&TS via consumer direct....I've just been informed they no longer exist!!! You have to make a complaint to them direct...(slaps wrist)

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

what a tangle web 1st crapit try and weave........

 

ruddy fleecers trying it on as normal.

 

once they have you conversing

they'll try all tricks in the book to spoof you into paying!

 

IMHO: i dont think you really need to worry about the debt.

 

the taking out of a new or a refinancing of the loan

would be very difficult for them to prove you gave perm.

 

and ofcourse the 'clincher' here is the 'discount letters'

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

What next ? Capquest claiming your debt is not SB after they were informed that you paid Morrisons a fiver last Christmas ?

Well the letter is printed and on the way to the post office as we speak.

 

Not sure what to try next, maybe a letter of discharge?? 10 days to prove it or sod off kind of thing????

No it is difficult to stop them getting CRA data, but in this case

I think a formal complaint to the ICO immediately qouting Mr.Browns

phone call and the written confirmation you have that they unnecessarily

have been checking your files.

Also a formal complaint to Call Credit regarding 1st Cruds statement

about them accepting a payment of £5.50 and requiring strict proof

of the payment.

Hi all

 

A quick update on the situation, The letter I sent to 1st cretins low and behold got lost by Royal Mail and has neither returned to me and made it to them, the 2nd copy of the letter I have sent prompted a reply 7 days to the day simply saying passed to relevant department who will be in touch shortly. Looks like they're trying to fob me off as usual.

 

Shall I wait for this relevant department to respond?? or send another letter to them pointing out the 7 day deadline which they've not adhered to so matter closed etc??

If the letter hasnt arrived then you should be putting in a claim to the Royal Mail. You are claiming for the cost of the Recorded Postage as the letter hasnt been delivered or returned to you. You should also claim for the cost of the paper/envelope.

 

You can pick up a claim form from the post office and it is free post.

Thanks cb, already got a claim in, I should have a rant about it now, but it's an all to familiar tune I'd be whistling, lol.

 

I guess that seeing as the reply I got from 1st crud was very evasive hopefully that'll be the last I hear from them. My only minor concern is that they'll sell the debt to someone else and I'll have to go through this all again. I've penned a complain to the OFT who simply replied they've noted it but don't respond or act on a per case basis. I guess they've added it to the stack of other complaints then.

 

What I'd really like from 1st cretins is a closure type letter, agreeing SB'd But I'm not sure I can hold my breath for that long.

To be honest, these fools are very unlikely to admit they are in the wrong, we all know we have far more powers than they ever will, they just don't want to acknowledge it. Sad really...:violin:

As suggested by several people in this thread

I'm in the process of attempting to complain to all and sundry about 1st crud.

 

This in fact is harder than it first appears.

 

I have written to call credit reference the received payment statement and to be honest they're as retarded as the fools at 1st crud.

 

I keep replying to their emails that say they won't deal with me until I've checked ,y credit file with them,

 

then say if I wan information corrected then to contact the original creditor,

they seem to have missed the point that I'm not complaining about my credit file but complaining about the various muppets that keep

viewing it and making false statements to try and make me pay a debt that's SB.

 

No wonder the countries in such a state. Lol

Hi everyone

 

I have eventually recieved a reply from 1st crud over this issue,

a month after the 7 day deadline,

they have returned the signed letter I wrote to them in December 2010 with an accompanying letter saying its not SB.

 

I wrote to them before I took any advice from here

so the letter plays into their hands.

 

I myself have unwittingly reset the SB timer and now have another 4 years to wait before it's SB again.

 

I doubt I can dodge them for that long lol.

 

I dont know which way to turn now.

 

All help appreciated.

 

I really dont want to have to pay this after the way i've been treated.

What did your Dec 10 letter actually say ?

 

Have you sent them a CCA request ?

Need a proof of payment letter, Scotcall ( capquest?), you say no payments okay, can you remember the date or abouts of the last known payment you made?? it would help greatly for peeps to further advise the best letter etc.
