Right then, the saga continues lol.

 

As predicted by your good selves a letter has turned up this morning from 1st Credit, Dear Mr Smith..........

 

"SCOTT CALL HAVE CONFIRMED YOU MADE A PAYMENT FOR £5.50ON 18TH DECEMBER 2009. IN LIGHT OF THE ABOVE WE DONT NOT DEEM THIS ACCOUNT STATUTE BARRED"

 

what letter can i use to obtain proof of this phantom payment. I have cheked my bank statements for that exact date in 09 just to make sure I'm going completly mad and have definietly not made any payment.

 

Seems like a fairly bold statement for them to make unless they've got concrete proof I made the payment??

It's up to 1st Credit and Snotcall to prove that you made the payment.

 

Copied and pasted below is a letter that I have saved written by Brigadier2jcs...

 

Make a formal complaint to the Compliance Manager at 1st Credit.

 

Dear Sir or Madam

 

With reference to your letter regarding the alleged debt for xxxxxx

please not I do not acknowledge any debt to you or any company you claim to represent.

I reject your claim that this alleged debt is NOT statute barred.

I therefore require you within 7 working days to provide strict proof of the following matters regarding the alleged payment.

1. The exact date of the payment.

2. The method of payment, Debit/Credit card, Cheque, bank transfer ,cash.

3. If a cheque the Cheque number, the drawers name, the bank name and sort code.

4. I any type of card the 16 digit card number, the expiry/issue dates, the name of the card issuer and the 3 digit security code.

5. For any other method of payment a full explanation of the method of payment to include bank transfer numbers and the account number and drawers name.

Unless you provide the required evidence no further correspondence will be entrered into.

All they have done is make an unsupported statement,

no proof of the payment which must be unrefutable.

Use may letter that Sigman has posted for you.

Do not acknowledge the debt.

Criminal! Make a very loud complaint to the OFT&TS as well.

It's about time these fools were had up in court for fraud.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I have received a reply from 1st Credit.

 

"We have been advised that Call Credit recieved the payment of £5.50 on 18th December 2009 via postal order"

 

"The above outstanding blance remains due and payable"

 

Who wants to fire the next shot so to speak.

 

I presume that should a postal order have been sent to them then it would have been crossed and payed into Call Credit's bank account??

 

How can this be put to bed, they are blantently lying about the payment and to make matters worse once they're challenged they make up anonther load of bull hoping that the person reading it will suck it down.

 

These people really a bunch of insidious pond life morons!!

Ed,

 

You need to respond denying that you made the payment and making them prove that the payment was made and by who.

 

Also remind them that under CPUTR 2008, it is a criminal offence to mislead a debtor and that are they sure they can prove who made the payment.

 

Also reinforce that the debt is Stat Barred.

Hi Ed,

 

Send the letter that I posted up in #52 in this thread and amend to suit.

 

It's up to 1st Cretins to prove that you made the payment.

 

This is happening more and more now, 1st Cretins joining a long and growing list of DCA's who are so desperate for some cash, they have to result to possible fraud to get some money coming in.

Thank them for their written confirmation that they are attempting to defraud you, and you will be more than happy to produce this evidence in court to have them convicted of the offence.

 

Write to your local MP and send your story to BBC Watchdog.

Ed, can you think of any reason why you might have sent a P/O to Scotcall for £5.50?

 

The usual payments to DCAs are £1 [CCA request] or £10 [sAR]

which are then often posted to the debt as evidence that payments are being made and thus extending the collection period for a further 6 years.

 

You will note that I am not saying that you paid £5.50 off your debt [since I assume you would not then have done it by P/O ]

but you paid or part paid for something else?

 

It is better to try and jog your memory now rather than assume that you never paid Scotcall for anything.

 

If you do remember any dealings with them then it might be best to ask for the accompanying letter that they received

with the postal order or how they can prove that the postal order came from you.

I am absolutely certain I have never paid anything to Scotcall, and have never even heard of them. The last contact I ever had over this debt was from Citi-Financial in 2005.

 

I will write to them again Stigman with your letter and am going to add a paragraph about obtaining financial advantage through mis representation etc and about un fair trading. The request for the log entry accepting the payment to this account is a good line too, thanks, I'll definitely use that one.

 

They have not proved I paid any money, simply writing a letter without providing evidence is utterly insidious.

How can you see I've checked my credit file????

 

Your correct of course, I used Noddle last night. Didn't see anything suspicious apart from an address link for Lowell's in 2008.

 

Is there somewhere specific on the file the payment would be if it was there??? Would it show as an account??

 

I drafted a reply letter last night and attached it for comment. It's a culmination of templates and excerps from here.

 

I note that the 1st rebuttled letter is recieved from them speak of ScottCall, but this latest effort reference Call Credit???

 

Not sure I follow, is it incompetance they've got mixed up or my ignorance that I dont understand haha.

Postal orders paid to creditors/DCAs would be transacted through their bank account - so they should be able to find the transaction.

Am I missing something here Call Credit = CRA what is the relevance here?

Has their collections arm had any dealings with this?

I am confused as well.

 

I can scan the letter they sent to me to show you all.

 

For certain the only DCA that has has any contact with me has been 1st Credit. I have never recieved a telephone call or letter from anybody else except Citi Financial in 2005 when the account finally defaulted and the situation becaome untennable as I described in post #1.

follow the instructions below for trouble free posting of documents :)

 

Dx100 – Instructions on uploading pdfs

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

Sorry if you thought I had super powers in that you were just checking your credit file when I wrote that.

 

The actual reason I said that was a result of reading your first post

Ok here's the letter they sent referencing Call Credit.

 

Haha Thanks @lookinforinfo. I thought to myself, thats spooky I've only checked on it last night, forgettign what I'd put in the first post.

 

Yes, i first used experian, and last night used noddle, although I would add that noddle isn't that complete. It shows zero bank balances and not all of my credit accounts are on there.

 

Can I get any feed back for the reply letter I attached last night???

That letter they sent you is excellent evidence to use against them in court, not that these clowns will ever go anywhere near a court!

 

Forward a copy of that to the OFT&TS via consumer direct.

Just because they have sent you a letter claiming that a payment was made, is not evidence or proof of payment, ignore the clowns, if they rattle your cage again, then you can have some fun and run them ragged.

The only thing I can see is that you need to make a change to one word.. as follows:)

 

 

I further reject your claim that this alleged debt is NOT statute barred and do not accept

your claims the I have ever made any payment to Scott Call or Call Credit.

 

The highlighted word should read "that"
