Jodieanne, on reflection I rather suspect that this not actually a problem.. not for you anyway. After all you have been advised you do not owe them anything and have an email to prove this.

It would be interesting to hear of anyone else who has been advised of this and in this respect I have amended your title in order to encourage others to view this thread and respond.

You dont have to report your bank cards stolen. If you cancel the continuous payment order with your bank they are obliged to comply. Any further payments made then are made without your permission and should be refunded by the bank.

http://www.consumeractiongroup.co.uk/forum/content.php?850-Continuous-Payment-Authorities-How-to-stop-them

But it is up to you to make sure that you advise your bank and probably best in writing with proof of posting and a receipt that you are cancelling the authority and that there is no longer permission for XYZ to take any payments.

A couple of points

1) I haven't seen where Jodieann has said she has an email, as far as I read it, I am the one with the email.

2) It's a great idea to stop the continuous payment authority and of course you are correct that it should be enough. However we know that not all banks have got their house in order so if the bank do let it through and your bank account is emptied, it's all well and good saying you will get it back...but if you have no money and you have to go through hoops to get it back it is of no help.

So maybe belt n braces, send letter and cancel your card.

  • 3 weeks later...

Hi I don't know whether I’m posting in the correct place but I have had the same problem!!

I owe QQ £187.50.

They set up a pre default payment plan for me which where I would pay:

26/03/2012 - £62.50

26/04/2012 - £62.50

26/05/2012 - £62.50

I have got a new debit card and was trying to provide QQ with the details yesterday on Live Chat so they could process my first payment. I was told that the payment system was down and to contact them tomorrow (today).

So! I contacted them today via Live Chat and was advised my account was in default as they couldn’t process my payment yesterday and to phone up the collections dept.

I phoned up the collections dept stating I wanted to pay the first lot of £62.50 I owe and the woman said I owe £75.00 as a late fee had been added.

I refused to pay the late fee and told them I was informed on the 26th to phone up today and pay and there would be no problem. I got put on hold while she ‘reviewed my account’

The woman then came back on the phone and told me she had just refreshed the system and I do not owe QQ any money my balance is £0.00 and my account had been closed.

I was very confused by this and I said I owe you money blah blah and she kept insisting that I don't and that my account had been closed.

I asked if I could get this in writing and she said QQ do not send letters when the account is closed but once the system has been updated if I log on to my account this will show.

I logged on to my account and found that my loan status is saying ‘in default’ Which is no surprise as I have not paid them yet because they keep refusing to take payment!! So I spoke to an advisor on live chat to get it confirmed in writing here is the conversation I had:

Never, EVER deal with them using phone calls or live chat. ONLY deal with them using email or a typed letter sent by recorded delivery. As you found out, they can and will do anything they like because there is no trail of evidence of what they said.

Also, if i were you, i'd just leave it now. Theyve said your account was closed and you owe nothing. You have it in writing ( i think) that you dont owe anything, so even if they try any tricks, you have full proof.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I have the above Live Chat conversation saved on a word doc don't know how that would stand as proof though as i have copied and pasted it...i have sent them the following email:

Hi,

I had a pre-default payment set up with yourselves and i was due topay the following:

£62.50 - 26/03/2012

£62.50 - 26/04/2012

£62.50 - 26/05/2012

On the 26/03/2012 I contacted Quickquid via live chat in the morningand afternoon to try and provide my new debit card details so youcould process payment. I was informed that the system was down and icould not process the payment and to get in touch tomorrow.

On the 27/03/2012 (today) i contacted live chat and they informed meto phone the collections department. I phoned the collectionsdepartment and i was informed that my account had been closed and£0.00 was due.

I have not repaid any of the outstanding balance so i do notunderstand how i do not owe quickquid any money?

Please can you resolve my query asap.

Thanks

I just find all of this a bit strange as why would a PDL company not want there money back?

It would be hard to have that as proof if it ever goes to court. Thats why CAG recommends you ALWAYS deal with them by email or recorded delivery letter.

You should really just leave it if im honest. They have closed your account for reasons only known to them. All you need to do is get this in writing, via email or letter. By continuously askign them why, you are risking the chance that they will open up a new account in your name, transfer this amount over and then add charges.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

It is very strange.. I got an automated email this afternoon about payment so i spoke to them via live chat again (i know its better by email but im still waiting for them to reply to my first email). The person on Live chat said i owe £72.50 then a minute later she was saying Your account is closed with us you dont owe us anything!!!!!! Confusing!!! I don't believe they can just write it off. Unless they pass it to someone else to chase up for them?

I've got a feeling that theyre on the verge of losing their license so theyre trying to clean up fast.

AS for them not being able to close it off... they can do it anytime they want. They can just write off the debt as a loss. Since theyre not UK based, theyve probably realised that they have no real legal grounds to chase them up.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Continue to check your bank account - one wonders whether QQ have now realised they cannot take people to court in the UK, clearly something is going on behind the scenes in the PDL market....

Hopefully there will be a message somewhere, I will check the OFT site and come back here with any news.

Keep anything in writing that you have (printouts of the chat are great evidence).
