i have had a call from Mackenzie Hall asking for monies said owed to mothercare £1790. The debt was registered to my old address and i have not lived there since December 2005. i told them im sure dept was cleared before moved did a cedit search to get mortgage for where i live now and also original debt was under £1000. they said they had just recieved the debt last payment was paid in March 2006 and amount is with intrest. I have refused to deal on phone but still get at least 5 calls a day and can they actually take legal action so close to 6 years?

The alleged debt is statute barred as you have not made any payment towards it for 6 years (5 in Scotland) send this letter recorded delivery - once you state that you have no intention of paying towards a debt that is statute barred then they have to stop harrassing you - http://www.consumeractiongroup.co.uk/forum/content.php?408-Letter-sent-when-debt-is-statute-barred You might also find this interesting too after Mackenzie Hall had a shot across the bows by the OFT - http://www.oft.gov.uk/news-and-updates/press/2009/44-09

Ok, if you didn't make a payment from when you moved out in 2005 and March 2006 then send them the Statute Barred letter.

If you did make payments between when you moved out in 2005 and March 2006, then send them the CCA request letter, which will keep them busy until it does go statute barred.

as i stated in original post i did an original credit check on myself back in 2005 for mortgage purpaces and cleared all debt showing including mothercare. the original debt was £1000. i have checked credit files for this debt and nothing shows and there is no ccj for this. so my concirn is as far as im aware debt was cleared in DECEMBER 2005 puzzled as to how payments made in MARCH 2006 when i made none and how a debt i am sure was cleared for £1000 in 2005 can appear almost 6 years later at a larger amount almost double. has in been known for companys to pass on settled debts ?
