Al they have is an alleged debt that they have bought with very many others,

they won't pass on details to each other bur just the barest info amount of debt name of debtor

sometimes not even the contact detail which is why you will find tracing searches on your credit file.

What is the debt when did you first have contact with 1st Credit?

They are saying they want you to do a DATA SUBJECT ACCESS REQUEST this is

done under the DATA PROTECTION ACT on payment of the required fee of £10.00 the creditor

is obliged to supply ALL data they hold on you. The fee should be paid by Postal Order (unsigned)

there is a template letter in the library.

CCA request £1.00 PO.

No, you do not have to pay to obtain a copy of this. They should have sent you one if/when the debt was assigned/sold to them from the original creditor.

 

They need to prove that they own the debt and a letter of assignment would go part way to proving that.

hi guys thanks for the advice 1st crudit have acknowledged my request for a cca and they say should my request include the deed of assignment then i will have to pay 10pound for a copy of it and they refer to section 136 of the of property act 1925 (whatever that is)?....

The deed of assignment which will include how much they paid for the debt are confidential business records

and are ptotected.

If you are sure the debt is SB'd and you have written to them with the SB letter then ignore all communication and report them.

Normal rule of business confidence would you like to disclose your business dealings to all and sundry including your competitors

the notice of assignment tells the debtor all they need to know.

The Law of property think but I will defer to greater knowledge of course.

Well of course the creditor will not want you to see the actual deed and you would then need to make an application to the court.

Does that not only apply if a court orders the creditor/claimant to produce a copy of the Deed to confirm the accuracy of the Notice of Assignment ?I would also want know if the actual deed was legal

Does this mean a DCA can demand the money but does not have to prove, until a judge orders them to do so, that they have the rights to collect? Sorry if iv got this wrong, but that seems very backward.
