Fraudulant claim made to my insurance company

A year ago I slightly bumped a guy that was stationary doing less than 5mph. He has lodged a claim with my insurance company for approximately £30 000 claiming 4 severely whiplashed passengers. I have since then taken out a new insurance, lost my 7 years NCB and cannot get my insurance company to prosecute the claimant. He has got himself a solicitor who only registered as a solicitor 3 months after the incident and I am the one who has now been penalised for this. The claimant incidently runs a business up the road where I work "Motor car accident claims". He also use my details home telephone etc to lodge more claims by the insurance company thinks it is not worth calling in the police. I am absolutely lived. Is there anybody out there that can help and advise.:mad2:

Let your previous Insurers that you had at the time of the accident deal with the claims as they seem fit.

 

You would have lost 2 years NCB anyway*, whether your Insurers paid out £1k or £30k. It does not affect you whether they pay out £1k or £30k. Insurers are just interested in whether it was a fault or not fault claim.

 

There is no point you getting upset about this when you were at fault for the accident. It is pretty common these days, for third parties to take this p-ss. Your Insurers may be working on this using the information you have supplied by employing investigators. But they won't tell you about it if they are investigating. It will be kept confidential for the reason that if you were in contact with the third party you might let slip that they are under investigation.

 

The Police will not be interested unless the Insurance company report this to them. The fraud would be against your Insurers and not yourself. I suspect your Insurers will drag the matter out and let it go to court. These people might be willing to try to defraud your Insurers outside of the courts, but if it goes to court it will be a different matter, as they could then be open to a charge of purjury. If it does go to court, you could be asked to attend as a witness and if so you would be able to tell your side of the accident story.

 

* When you have a claim, with say 7 years NCB, you don't normally lose all of the NCB. You normally lose 1 or 2 years depending on the Insurers. Some Insurers will base the reduction on 5 years max NCB discount, so you might be down to 3 years NCB.

Dito with the unclebulgaria67. You should have some bonus left phone the company and find out. It is your fault so you cant realy argue.

If there is fraud happening and you have evidence. e.g you took photo's and there was only 1 person there but they are claiming 4 then you can forward this to the fraud squad. I assume theyve alrady got paid the 30k so you cannot realy do anything, as once its closed it closed.

They have declined the claim. I am just upset that they refuse to call in the police. This man used my address and telephone, which I advised them of to lodge another claim. I had ind depth visits from 3 investigators and have been very co-operative. This man also runs at the top of the street where I work a motor car insurance claims company. Whilst everybody has to pay ridiculous premiums he is aloud to run around and do as he pleases. Where is the fairness in that? How will the insurance companies ever get rid of this kind of action if they dont take positive steps to stop the fraud taking place. You cant just leave it because you are afraid to step on somebody's toes! I had a passenger in the car who saw what happened. Unfortunately in Whitechapel you dont just get out of your car and take photographs, you may no live to see the next day!

yes I think this is quite huge but maybe better for me to leave now and not get involved to much, I am a firm believer in what comes round goes round eventually he will totally overstep the boundries out of pure greed and get caught!!!!! This has been very stressful for me on top of the fact that at the NHS we are waiting to hear if we all have jobs left so I am just going to let go for the moment.
