Friend's Gran misold life assurance by Scottish Widows

Recommended Posts

Hi all.

Brief one

- friend was speaking to his Gran about an ever increasing size of the premiums she was paying for the above

she was adamant to him that she was told at the point of sale that she "needed this" in no uncertain terms.

Unlikely there will be proof of this, of course,

but my question is

if there was no evidence of any advice given,

can a claim for mis selling on these sort of policies every be successful?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hard to say if it was mis sold without knowing what sort of policy it is.  I don't know who was doing the selling but Scottish Widows themselves are a reputable company not known for offering 'dodgy' products. I realise that even the finest products can be unsuitable for the person they are sold to.

How long has she been paying premiums into it?

well 'must have' is their usual twaddle.

typically associated with a mortgage...oh you must have a life policy to cover our mortgage in case you die and we dont get our money.

SW are part of the lloyds group so i'll suspect am old Cheltenham and Gloucester mortgage.

it wasn't actually ever needed but the mortgage advisor got a nice big fat commission in their pay packet for selling it to her.

we had two, reclaimed them both about 10yrs ago, made £1000's.

the advisor lied they were compulsory

Christ, no matter how many times I hear / read stories like these, they still boil the blood!!

If all is as suspected, are the days of reclaiming gone now?

I think we need more detail, craigten. In terms of reclaiming it may not be too late if the policy was missold but we need to know what type it is.

We need to know when the policy was taken out and why. Normally I would expect there to be proper paperwork to as it's been required for many years.

I hope you can get hold of details because a friend's gran is quite a distant relationship for us to advise. Could your friend or their gran sign up here perhaps?
