Don't know where to put this or if it's even appropriate for the forum but just needed to tell someone and get some advice....

I know this is not a bank or even a charges problem but all will be come clear at the end (if you get that far!!).

My daughter started her dream job in Sept last year with one of the big four (in the world) Accountancy firms. Her and her boss who she had a great working relationship with set this new section up completely from scratch. Her job had also involved travelling all over the country, sometimes with her boss, to other branches detailing how the section works. About 4 months ago a new assistant manager was taken on who has frankly made my daughters’ life a living nightmare she watched everything my daughter did including timing her toileting breaks!

Needless to say the relationship with her boss deteriorated as my daughter was uncertain what this woman was saying to the boss. It’s her first job and she just wanted to keep the peace and progress. Unfortunately it became so bad that my D had to go and see her boss and ask if she’ d done anything wrong as she had really tried to work with this woman but to no avail.

Her boss intimated that she had better pull her socks up. Also if she was thinking about looking for something else then be careful as people talk in this city! She didn’t want to make waves so she decided to keep her head down, get the experience and the training she needed and basically work. She was, by now, as you can imagine completely disheartened. She had had such a brilliant working relationship, she had given 110% (I know it’s a cliché but she had). So much so, that her boss had recommended her for an "Outstanding Contribution Award". She received this recognition last month in the form of a monetary bonus (she received the highest amount!).

She then went on leave for a week on the 21st August. On the Friday of that week she had an email from one of the other partners in the firm (her boss was on holiday). This was asking her to attend a meeting on the following Tuesday which she did. She was told at this meeting that due to a complaint made about her and a file she had been working on her services were no longer required, in fact she had been sacked!!!!!

She had not been asked to bring a representative or a colleague with her. She had been dismissed without a real reason, she had not been given the opportunity to question the dismissal and more importantly they had not adhered to their own disciplinary policy. She was asked to clear her desk and leave the building but they were (out of the goodness of their hearts) going to pay a months salary in lieu of notice! She had four days to go before completing a year’s service. She left the building on her own.

She has yet to receive the formal letter of dismissal detailing the reasons. To cap it all this morning, she received a letter from HR telling her in no more than two sentences that the graduate loan she had been given at the commencement of her employment (a loan that she had thought was an incentive payment and she had used to pay off some of her debts incurred whilst a student) was now due for repayment and could they please have a cheque before Friday next!!!

She is now hysterical, she has not got access to that kind of money, has no job so no chance of getting a loan, I am not in a position to help so finally we get to the question. I have told her that as long as she contacts them and offers a reasonable payment schedule then if they do not accept this and they decide to go down the small claims route no judge would look at the facts and say she was being unreasonable and rule in favour of these crims would they???

As you will also no doubt be aware she is unable to go down the tribunal route so her dream job had ended up being her worst nightmare!!

Bl**dy hell, sounds like someone has had it in for her, not a very nice introduction to the working sector. To be honest I know very little about employment law. My best suggestion would be to book an appointment with Citizens Advice and see if they can help. With regards to the money they want back, I'd just write to them and say that she is in the process of obtaining independant legal advice on this matter and, until such time that this is complete, she will not be forwarding any money.

Sounds like this is nothing short of bullying, and being one of the big four they should have an anti-bullying at work policy. However I feel that any action you take now may be too late, as your daughter is no longer employed with them, they could see any reference to bullying and act of retaliation to being sacked. I would seek help from the CAB but they just confirm my worst fears. I would start by getting her to rewrite her CV with all the experience she gained with these monsters, get her to hold her head up high and rise above all this and move on, any company that treat staff like this don't deserve the hard working & honest working for them.

She is rewriting the CV!! What lovely people are on here, I really only put this on this forum so that she could see that she has done no wrong. You know what they're like don't accept that off mum as we're of course biased. She really is a lovely kid and frankly I could murder the bitch that made my daughters' first job so miserable but as my own mum said "what goes about comes about"!!

We are in the process of appealing the decision, when of course she gets the letter, and we are taking legal advice. We both know there's nothing anyone can do and she really couldn't face those monsters again but as long as we've covered all the options then to be honest I'll be happy. She is happy, not happy at being sacked but happy in the knowledge that she doesn't have to go there again!!

i know this wont help you but I thought I would share my story with you to make you feel better. (well I hope anyway)

 

A week after we got married my husband started a new job at the same company as my god damn awful stepfather who has hated me since he got togther with my mother (he is nothing short of a bully).

 

The job was gonna be the making of us. Excellant money good hours etc etc.

 

A week after my husband had passed his exams he was called in for what was supposed to be his passing out interview. Whereby he was promtly sacked!

 

No explantion etc etc no respresentative and no notice that this was a disciplinary.

 

IF they Did - I knew exactly what was behind this.

 

So I left work at lunchtime after I got the news and met my husband.

 

Basically I got my husband to ring his manager and find out why he was sacked. WE also told the manager we are seeking legal advice.

 

Then I rang the chief executive of the company (yes it was a big company national - and I went straight to the top) I told them I was my husband reprsentative (never mentioned I was also his wife). They sent down the top HR person from their national office, I explained all the points of law which they had breached. I was curt and let them know who was in charge.

 

I also informed them that the manager who had sacked my husband was my step father golf buddy!

 

In the end the two managers which were responsible for my husbands sacking offence were discipline and demoted and so was my stepfather.

 

My husband has now been there 6 years and has been promoted (over one of the other managers head). Im sure to this day they dont know that I wasnt his solicitor - WE never once told I was a solicitor because actually Im a child pyschologist.

 

I just wanted to show my stepfather once and for all that he cant get away with bullying me or my family!!!!

 

I hope your daughter moves on from this and in 10 years time she will look back and realise what A lucky ecsape she has had.

For us it's slightly different. My daughter IS A SOLICITOR she trained in law did her LPC and then decided to go for this, what she thought was a wonderful career move - great pay, company credit card, first class travel and of course offices all over the world. She won't fight it now they've so knocked the stuffing out of her and and I can't blame her. She's the one who's going to have to face them all if she fights it not me and she can't!!

But anyway thank you everyone who's responded you are all an inspiration and helping her to achieve what I am sure will be an even better goal, she'll be happier anyway!!:D

It's a common ploy get rid just before the 1 year passes. This is why they where in such haste to get her off the premises.

 

However they have little understanding of employment law because as they didn't follow proper procedures she may still be in their employ. She almost certainly was for 4 days after their sacking of her taking her to the magic 1 year.

 

She must complete an ET application NOW before 3 months have elapsed. As soon as she makes her application she probably already knows that she will be contacted by specialist firms who will take her case on for her.

 

In the alternative she may wish to consider suing for breach of contract using a CFA.(their conduct & the way they dismissed her are good grounds)

 

The courts don't like employers sacking people within a whisker of the 1 year entitlement. They see it for what it is.

Forgot to mention there is no employment for 1 year requirement for such a claim

  • If your employer refuses to allow you to bring a companion you can complain to an Employment Tribunal.
  • If they sack you because you tried to take a companion into the hearing, you can claim unfair dismissal at an Employment Tribunal. Unlike some unfair dismissal claims how long you have worked for your employer does not matter.
  • If you are sacked for other reasons, but you were not allowed to take a companion into the hearing then you are likely to have a strong case at a Tribunal, and you may well get extra compensation.

My Other Half Got Fired Within Two Weeks Of His 2 Years Employment. He Was Sacked By His Manager. The Guy We Realised (i Know This Sounds Crazy) Was Seriously Affected By The Fullness Of The Moon. We Had A Running Joke At Home About How Most Of The Time He Was Quite Reasonable But As Soon As The Moon Was Full He Would Do Very Strange Things. Anyway Without Reference To Personnel Or Anyone Else My Oh Was Called Into His Office One Morning And Told He Was Fired. When My Oh Asked Why He Just Kept Shouting That He Was Fired So Get Out. To Cut A Long Story Short My Oh Walked Away With 1 Years Salary And The Guy Who Sacked Him Was Himself Asked For His Letter Of Resignation. We Know He Never Did Get Another Job.

 

So Even Tho Your Daughter Might Be Totally Disheartened Get Her To See A Employment Law Solicitor. The Very Least She Should Walk Away With Is A Good Agreed Reference And For Them To Write Off Her Debt. After All With No Real Reason For Her Dismissal Then They Cannot Expect The Money That I Assume Was Going To Be Repaid From Her Salary. So If They Stop The Salary How Did They Think They Were Going To Be Repaid.

Remember These Big Companies Do Not Like Going To Employment Tribunals Especially When They Are So Clearly In The Wrong As It Puts Potential Future High Flyers Off Working For Them If They Get A Bad Reputation.

I was with one company for 20 years, but the environment changed around me so much that I couldn't remain (ended up as a square peg in a round hole). Major conflict with the 'new boss' when the man who employed me (who was a computer systems man of the old school) passed the business on to his Son (who was an accountant) :mad: I left for a different job, but feel I was pushed out, but had so much rubbish going on in my personal life I didn't get to do anything about it - that was over 4 years ago. [basically left after 20 years with a firm and feeling all I'd got was salary - and not a brilliant one at that :( ]

 

What happened to your daughter is blatently wrong. I hope she gets the help she needs to fix this situation. Core to that is probably their 'official' reasons for sacking her. Give her our best wishes. :)

oh she must be so disheartened.

 

may i offer a few suggestions for when she gets her new job (which she will).

 

firstly join a union.

( i did this when i was having trouble with my boss, best thing about it is that i didnt go through works union i contacted usdaw personally and joined myself, the money didnt come out of my wage so my boss never knew)

 

if she has any problems at all. even the slightest one. write them down. she needs to write down, who said what, date, time, any responce from herself, and how it made her feel.

 

i did this for 6 months and when my boss gave me a disiplinary for having a miscarriage (that was the final straw).

 

i had my boss and his boss nervous as hell when they found out i was in a union. the big boss was well cheesed off as i was his biggest assset as he said and bring the most money into the company. there was 12 in the office and me and another colleague (my mate) brought in more revenue than all the other 10 together and doubled.

 

in the end i got out of there with 12 months pay, as an apology of my bosses actions. and my friend also left. 4 months after we both left the department closed down (insiders told me it was due to us both leaving) they werent bringing in enough money to keep it open. and the boss got sacked for causing it all.

 

so what comes around goes around. and i had 12 months off !!

 

and it is the best thing that ever happened to me. though i really never thought that at the time.

 

what it will give her is the understanding that just because she works for a big firm does not mean she will get treated better. i have found that smaller firms treat their staff better and will do more for their staff.

Most of the major companies don't encourage Union membership and we all know why!

I work for the Local Authority and frankly you'd have to murder the boss, hang, draw and quarter his body and display his entrails outside of the main council building for any action to be taken. But to have your wrists slapped though someone would have had to bare witness to the whole episode.Then there's always the ET!!!!

Boo, JonCris is exactly right it makes no difference how long she has worked there she has certain statutory rights which this company have blatently disregarded - I can speak with authority as I am a HR Manager for a huge company in retail and thus am on the pulse with employment legislation- your daughter has grounds for e t as outlined by Joncris as above - I would strongly advise that you get professional advice ASAP. I know exactly where everyone is coming from and I am so grateful to you all. I have to be sooooo careful as to how I deal with this issue and her. I will be showing her all of your responses but at the end of the day, as I said earlier, it is her appeal and only she can face it. Under no circumstances do I want to be seen to bullying her into taking action as I would then be no better than the monsters that did this to her. I hope she decides to fight it but whatever her decision I will support her (as you have all amazingly done).

PS She is rather beautiful, very clever and quite gentle I suppose (unbiased that I am). Before she was sacked she told me that she was going to see the bitch and apologise if she'd done anything wrong and ask this womans' advice as to how she could improve or put things right (she'd not done anything wrong mind)!!! She felt perhaps if she used this tactic it might help the situation - I'm glad she didn't get the opportunity to do it!!

Quick update - baby got an interview on Wednesday - it's with another huge firm, but a lot of the job seems to entail what she was doing with her last employer and it's an interview never the less.

Still no letter of dismissal and it's now been just over a week - what are these monsters playing at, they can ask for the gradulate loan to be repaid but can't be bothered to give the reasons as to why she was sacked?

Get a grip big boy cos I'm coming after you!!!

No advice to give here - just my sympathies and if your daughter decides to fight just remember the monsters at the top have further to fall!!!

It seems for a supposedly civilised society we are regressing our employment rights back to Victorian times!

In all seriousness, really sorry to hear this absolutely disgusting story Boobaby, and glad to hear she got another interview - hope it went well. Can't really add anything to the advice already offered - I hope you've suggested she persues the CAB/Industrial Tribunal route to get these buggers for what they did to her?

 

And yep, it's a sad fact that this sort of thing still happens in this day and age. On the one hand we're always told we're a civilised society, and in the same breath we're told that employment in the city in the particular comes down to the Law of the Jungle.
