    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

    • Yes, it was, but in practice we've found time after time that judges will not rule against PPCs solely on the lack of PP.  They should - but they don't.  We include illegal signage in WSs, but more as a tactic to show the PPC up as spvis rather than in the hope that the judge will act on that one point alone. But sue them for what?  They haven't really done much apart from sending you stupid letters. Breach of GDPR?  It could be argued they knew you had Supremacy of Contact but it's a a long shot. Trespass to your vehicle?  I know someone on the Parking Prankster blog did that but it's one case out of thousands. Surely best to defy them and put the onus on them to sue you.  Make them carry the risk.  And if they finally do - smash them. If you want, I suppose you could have a laugh at the MA's expense.  Tell them about the criminality they have endorsed and give them 24 hours to have your tickets cancelled and have the signs removed - otherwise you will contact the council to start enforcement for breach of planning permission.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good luck for tomorrow,i can guess how you are feeling right now i had a lady solicitor and a male doctor on my panel and they were both very nice people ,as soon as i walked in the room i burst in to tears with all the worry and stress it had caused me it was such a relief when they allowed my appeal, let us know how it goes

Less than 24 hours and I'll know if I'll be held in the loving arms of the disability premium. Or herded into the DWPs cattle trucks on route to a surefire fate...

I think I have as much evidence as I can have. My medical support is good. Tonight is when the worry and nerves will strike. My main worry is that I get so tired I can sleep and sleep and sleep. Have to set more than the one alarm clock for tomorrow!

good luck rae, i see youve strayed over to the "wild side" lol im just lurking trying to give back what help ive been given on my threads from yourself and a few others , since all that happened with me, something great has come out of it all, applied for DLA it got accepted and after kind help with my CT from head of revenues iv now been told im entitled to HB and CTB, all of which i never new i was entitled to untill i came on here, youl be fine il have my fingers and toes crossed for you! :)

Well, fellow Caggers, the night before draws to an end. I look to the morrow with a little confidence, a little trepidition. I sit in my trench with my tin helmet firmly in place. Nervous fingers taking my bayonet out of its scabbard. In a few hours the whistle will blow for me to charge unthinkingly over the top. And face the few who hold so much in their hands.

I am bouyed, this night, with thoughts of the many who have gone before and fought valiantly for success. But my mind is tinged with a little sadness for those who have fallen in this great endeavour. Never achieving the basics that humanity should offer.

I know that I won't be online again before the cries of the DWP are ringing out over a sunlit Dorset bay. But, in the meantime, those who may stumble onto this little patch of the internet that will be forever England, I ask only this: May I take your thoughts with me at 1110hrs on Thursday the 25th of March 2010.

To be continued late tomorrow afternoon...

Sorry to keep you all on tenterhooks. I've just stepped through the door and waddled straight here!

Well, I'm afraid it was the DWP cattletrucks for me. The tribunal in their wisdom found I warranted 9 points. They seemed quite pleased with this as it was a major improvement on 0! I nearly let go a rather manically crazed howl of derisive laughter at that observation.

They were very pleasant and friendly about it. But, then again, I suspect some serial killers can be too.

The conversation centred around walking and standing. The former I was awarded the 9 points for, the latter they couldn't quite understand how COPD can affect this. Sometimes I get staggered by the sheer scale of ignorance about a disease that causes the highest number of fatalaties in the UK. I am beginning to suspect I consult the only GP in the land who has any depth of knowledge. It's not exactly rocket science. I have stage three emphysema. There are only four stages with the fourth being the one that you breathlessy phone around the Funeral Directors looking for the best deal.

The answer to the question as to how COPD affects standing is, of course, a lack of oxygen in the bloodstream affecting muscle. Muscle atrophy is something I have to be aware of and try to avoid.

I have an appointment with my GP on wednesday and I suspect she'll be less than impressed with the tribunal. She's already warned that if I look for part time work then I need to be incredibly carefull. Let alone fulltime! I suspect that the outcome of our meeting will be to reapply for ESA and go around the merry-go-round once more...

What ho, stiff upper lip and all that!

Aww Rae I'm so sad that you didn't get awarded the points you need. COPD is a terrible affliction - unfortunately it's one of the many that doesn't get the recognition it so desperately needs for benefit purposes. People can be so ignorant about it.

Thanks Erika, but please don't be sad. It's more of an irritant than anything else.

I do like to look at the bright side and find much to amuse me with COPD. If I must have a progressive degenerative disease than this is far better than some!

I've researched it a fair bit - know your enemy - and that's why I know about the muscles. It was quite amusing in town recently, I felt ok and thought I'd paced things pretty well, when my legs decided to go strike. A bit like being drunk without the expense. :)

Rae, is there an organisation that supports people with COPD, or does it come under something one of the charities deals with? When I've been looking online, several of them are clued up about Atos assessments.

Hi Rae, sorry to hear you didn't get the magic 15 points. As well as seeing your GP you should contact the Tribunals Service and request a statement of reasons and a copy of the record of proceedings. Once you get these you need to check that the Tribunal has not made an error of law. If they have you can seek to appeal to the Upper Tribunal. If you have no idea how to find an "error in law" or how to submit an application to the Upper Tribunal I will help you through the forum.

Paul, good advice. I will follow that up and may well take you up on your offer. They were quite clear that they could award no points for standing as COPD 'only causes breathlessness' !

Hi paul, yes. My medical evidence is very clear on the subject. It included a spirometry reading and graded me as severe with a fev1 of 49 (that's lung efficiency of 49%. Just under one lung working so to speak). Most people tend to use four stages and I'm in the third stage. The fourth stage is also referred to as 'the final stage' for obvious reasons. That's usually when your fev1 reading is down to 30-35.

 

Thanks ee-bee, have to keep soldiering on as I'm totally unsuitable for jobseekers allowance.

 

My main worry now is that I simply can't afford a disruption in benefit payments :(

I admire your attitude Rae. I am dreading the migration to ESA that we all might face. It's incredibly unfair and the stress caused is going to be too much for some people.

 

To say that if a person can stand and lift a cup (or whatever) they are fit to work is astounding. :eek: I'm so disappointed with this system.:sad:
