hi sleepydragon I am right where you are now. I have just cancelled my DD with PTP as well (payment due today)

I have emailed them asking that they have contact only by email or letter. i have offered to send them an statement of incoming/outgoings. I have offrered them £40 month.

So far no phonecalls, only an email asking me to contact payment services by phone, which i won't do.

Don't get worried about it. Stick to your guns and pay wht you can afford. just be happy you got off the 'merry? go round' I am! I've been on it best part of a year but i need to get back in control now!

Sorry to here the plight you and Sleepy are in, can you enlighten me as to how the scenario escalated, and what made you take the money in the first place?

Just curious thats all

DO NOT send anyone a statement of income and expenditure, especially be careful with these documents as they often now contain a clause stating "You admit the debt is liable in full with daily interest charged at XXX rate and do not have any right to split the payments" or words to that effect.

Only a court of law should have an income and expenditure statement.

Ive been stung twice by I&Es, once for a mortgage company where they put down car charges of £250 a month and clothing costs of £300 a month, I have never had a car and NEVER spent £300 a month on clothes! The company had to backtrack on this one as I had a scanned copy of what the guy had taken away with him...

On the second occasion I appeared to have signed any legal rights I had by signing the document.

Be careful with this type of company, as stated they like to operate in gray areas and think that YOUR bank account details gives them a right to take all your money.

I would write to the bank and ask that this company should not have access to your bank account anymore as the liability has ended...

dont know if it will help anyone but Halifax do an online account with no credit check which gives you a cashpoint card and online statements.

Just make sure your salary is paid into a different account from now on - sadly I have proof in my past statements of these companies taking liberties.... They will also attempt to take tiny amounts such as 5p to see if you have any money in the account... this really feels like intrusion of the worst personal kind, rape comes to mind.

These tactics need to be stopped legally but I am sure they are already working on new business models to get round the changing legislation - including finding another way to express their APR rates - did you know this can be calculated 23 different ways?

hi mr worried,

just to enlighten you a little i may have been a little daft when i got the ptp but i had little or no option my son has severe cerebral palsy hydrocephalus and spinabifida he became seriously ill and was taken to a hospital miles and miles away that could give him specialist help i had no money to travel no car no way of getting there to support him so thought i could manage a ptp but then it starts the madness of having to roll over so i could pay normal expenditures etc and then suffered a nervous breakdown because of stress and other factors including my son being ill so then i was only getting statatory sick pay and this is where i find myself now i have just returned back to my pt job and also a carer for my son but now am struggling bigtime my rent is £800 and then theres the NORMAL living expenses luxuries like food etc come last for myself so long as my son has got what he needs its what matters, i hope this answers your curiosity? im sure there are many people in my situation at the moment but these companies dont care whats happened to make you default as long as they get there pound of flesh! am now awaiting the onset of emails phone calls etc..........someone say a prayer for me x

Hey,

Stop worring the more people who use or have used these companies should all get together and stop rolling over, losse your debit card or better still take all your money out of the account they have details of, write to your bank and tell them to cancel all dd's ect and tell them them you will hole them liable for any transactions that may occur that you have not allowed. Then e-mail the company and tell them that you can no longer pay the debt but make an offer of something you can afford. They will sing and dance to start with but they have no choice but to accept a payment, also tell them you are not paying any further interest they may apply. I have done this myself with PTP, WDA, Payday express and PDUK they have all agreed to a reduced payment.

Don't worry about these clowns the Government will soon be cracking down on these lenders. Watch this space.

Happy New Year

Hi Sleepy. You have done all you can and I would just wait for contact.

They really arnt worth losing sleep over and I am sure you will be able to handle them.

They pass to Clarity after a while and these lot are easier to deal with.

Good luck.

Hi

I am in similar position to inital poster -

I have 6 pay day loans all are for between £100-300 and i have just been paying the interest each month.

I cant afford to do this anymore due to arrears on mrotgage/secured loans, so either have or will be missing payment very soon.

The companies are:

Wonga

Cash Genie

1month loan

speedyquick

uncle buck

wage day advance

Anyone any ideas on how i can deal with this when it all heats up? They have already been taking randaom payments for strange amounts on my debit card, so i am currently in process of getting a new account.

Will any of them take me to court?

I want to try to pay them all say £15-20 a month as that is all i can afford.

Will be very surprised if it goes to court. Probably be sent to a DCA who will accept and reasonable repayment plan.

Just stick to what you can afford and dont rollover any of the loans.

I am in a similar position with Wonga, QQ and PTP .. all to default this month - can't wait for the negotiations to start !

I've heard that Wonga are quite hard to deal with - ignoring contact for weeks and weeks and before you know it you owe double the original amount due to charges etc.

Considering whether to try and keep Wonga going with rollovers and default the rest.

Not sure what to do.

Hi gram

Watch out for cash genie as they have been known to write to all your neighbours about a debt.

Overall lose your debit card or get new bank account, never let these companies have the details and insist on paying by standing order. Most agree to payment plans in the end. Have a good read through this forum and post again if you need any help.

Most importantly you need to get off the rollover merry go round.

Write to the neighbours?? They cant do that surely?

God, worried now, but yes i need to get off the rollover merrygo round. I just hope they all accept to take what i can afford to pay them and not take me to court or something.

Thanks for your help.

Hi Sleepy

Gavin is a bully so just refuse to speak to him.

He can only get to you if you let him. He has no power over you. He only gets to keep the account for a few weeks then he has to give to clarity. From what I have seen you can't negotiate with him so I wouldn't try.

Keep strong, you will be fine.

Hi sleepy

I had heard absolutely nothing, not a peep.....until today that is. I've had 3 missed calls on my mobile from 'unknown' number and a voicemail from a lady called Robin stating that she works for Northway and I need to contact her urgently.

I had sent a further email earlier this week in reply to their one asking me to call them. I asked again for contact in writing or email only and have had no reply to this.

It might be worth mentioning (for anyone who is considering going down the same route) that before I defaulted I logged into my PTP account online and changed my work and home telephone numbers....I changed them to random numbers and it seems to have worked because I've had no calls at work or home, only on my mobile which I am happy to ignore. I was dreading them calling my work in case someone else picked up my phone.

I intend to email them once more asking for contact in writing/email only and if I get no joy I will wait to be passed on to Clarity where I can hopefully sort out a realistic payment plan.

Looks like I've been lucky and my account hasn't been passed to the charming Gavin:rolleyes:

Do lets know if you hear anymore. I will do the same

Take care
