    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Underdog, brilliant instigation on your part and I am deffo right behind you with this one. In the absence of any consumer lawyers, I was thinking of the Sun or News of The World newspapers:eek: I don't have copy & paste situations, in fact we have been given no agreements:eek: I have originals though....... might be easier just to give you access to my complete MBNA photobucket file :confused:

ime subbed to quite a few mbna threads dont mind sending anyone i come accross re mbna to you - i think its best we have some unique thread that anyone with mbna problems gets to know about immediatly once they post with mbna in their first post or in their thread header,,,just my unique idea of the madness this eve,,,may not even work,,oops

Well I've come a long way in the last 15 mths regarding MBNA ad its been an eye opener regarding what they are capable off.

 

My case should be coming to an end soon but as I say ill still be around to help others the best I can AND FIGHT THEM WITH A BIGGER STICK.

Think the media is an excellent idea, AA99. If one of the red tops will run with this, I think they are going to be very busy looking for people's agreements.

 

Angel - I was wondering the same thing - maybe a thread for gathering our evidence? People could post up their agreements, notify us of originals, etc.

 

Think your case could be useful PF - considering their suspect DN.

Re post 356 im very much up for this, but i think because of the scale of this its time for DIRECT ACTION we need to get this covered in the press as much as possible and then hope they will be investigated.

 

To that end i think we should gather as much evidence as possible so every one with suspect agreements or default notices post them up removing personal information of course them one of us print them off add a page detailing where they fail put them in a binder.

 

Then we we need to hit fleet street yup in person and get noticed. while we are there we could also give copies to the regulatory bodies.

 

Because MBNA have brought so many credit card companies they will be the biggest loser :D because a lot of what they have brought does not conform to cca 1974 and or CPR

 

I also think they will be interested in my bundle because of the fraudulent DN.
