      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi:

 

I have send the SAR letter to the Natwest concerning my loan together with the £10 postal order. Today I received the answer and all I got is a piece of paper with my loan paymnet installements since I started, my name and account number and dates. There's no information about PPI or anything I see relevante? Don't tell I just paid £10 for a printed statement. That I can print myself from the internet banking. I have sent the SAR exactly as shown here and only editing my details.

 

Any ideas?

Hi Master,

Bit late I know but I've been on zummit else. Now go for the Data Controller and tell him you require FULL disclosure; and point out the 40 day limit is up (if it is) but 'as a goodwill gesture' you'll give him 14 days to come up with the goods!

Bye-the-bye folks, since my final request for info from a data controller has bought forth zilch (but I know they have the info and do NOT want them wheeling it out in any future court action), does anyone know of a link to a draft N1 for my next step into court on the SAR quest?

Eventually received the cd with telecons on. My friend is incorrect on a couple of points BUT some other items in the FSA guidance were omitted by Barclays and so we shall proceed.

On the disc the 'saleman' should have been an auctioneer- when exactly does high speed monologue become o.t.t. so far as courts are concerned?

Although if listened to VERY carefully (about 3 times) one can hear him touch on a number of the mandatory items associated with ppi, however when a new mum with baby in the background has to absorb it all in one take it hardly seems either possible or indeed a reasonable expectation so far as anyone is concerned.

My missus took her Halifax loan out in Oct 2000 and paid a single premium PPI because she was told that she wouldn't get the loan without it.In Feb 2003 she was made redundant and tried to claim on the PPI only to be told that as she failed to notify of a change in her working hours they wouldn't pay-out and wouldn't let her cancel the policy,she is still paying off this debt to a DCA......is it to late to claim???

This is a clear case of mis-selling and its never to late to get this money back.

 

I suggest you start a thread in the PPI forum as it will be easier to track you claim in there.

I now believe that HX have held out on us for info; if they produce data at court that should have been made available for the SAR then do we have any cause for redress and can we request that a county court action be placed on hold whilst the new ionfo is examined?

In my experience a favourite tactic of Lloyds and their subsidiaries is to return your payment if they experience a problem in fulfilling a SAR. (Twice now for me)I have started including the line "SHOULD YOU EXPERIENCE A PROBLEM FUFILLING MY REQUEST I EXPECT YOU TO CONTACT ME WITHOUT THE RETURN OF MY PAYMENT". Don't know if it will make any difference but you know how pedantic they can be!

has anyone had any trouble with getting a sar from hsbc? i had my letter and check sent back with a letter from hsc bank saying they cant locate my account. not surprising when i dont bank with them??? ive only ever banked with hsbc.

I sent sar request to bos had 5 loans with them all applied for by telephone, should they have sent me transcripts of the telephone calls with the sar information or do I have to request these separately? It was the above sar template I sent, also guy from bos phoned with regards to sar request I told him I wanted all the information they have with regards to the ppi.

Hi,

It may be that they will ask for dates and times of the calls before they provide transcripts (or copies of the actual call)

The problem is that most of these companies delete calls after a few months.

 

If they provide account history notes with your SAR, there may be notes on it regarding incoming phone calls which you could use

If you are asked to deal with any matter via private message, PLEASE report it.

Is it important to have account numbers... I don't have every account number after so many years

 

They should be able to supply you with all the info they have If you give them your name address ect at the time of opening the account's.
