  1. Hi Diva 1987 , What evidence/statements have been supplied to you so far . I note that you say you have been informed that you are not allowed to know who has written statements about the allegations or dates when the alledged offences were supposed to have taken place . I personally would inform your employer that you wish to have any witnesses that have written statements present at any disciplinary so that you can question them . Your employer could refuse this request but must have a good reason to do so or it will weaken their case at any tribunal . Also,if your employer cannot even give you the dates of the alledged offences how the hell are you supposed to defend yourself . I'd just say that you can't possibly answer any questions as you have no idea what day they are talking about . Goodluck .
  2. From what I can gather the most likely outcome will be that I will have to sign a declaration that I haven't received the package and a replacement will be sent out . Thats if BT don't agree with PFs opinion that it has been 'delivered' by their standards . I'll be miffed if BT agree that handing over the goods to a woman pulling up in a car outside my residents was a good idea but if that has happened I do have some sympathy with the delivery driver as he's been duped by a opportunist thief . And as Silverfox points out its the senders responsibility to ensure the goods are delivered to you .
  3. Thanks Mitch , It does seem a bit strange , as you say the woman that signed for the parcel wouldn't have a clue what was in it . According to PF they can tell via GPS that it was signed for in our road at the stated time but I'm dubious of the delivery drivers claim that he knocked on the door , the wife was in and we have a jack russel that goes beserk if anyone has the audacity to walk up the path let alone knock on the door . I was also under the impression that items had to be signed for but this isn't so unless specifically stated by the sender . BT have opted to send £100 worth of electrical gear that didn't require a signature , not that it matters as some random woman has supposedly signed for it anyway . This is the second time a delivery was supposed to been made that has not turned up and I will be extremely wary of purchasing products that require courier services in future / As for PF I expect you'll get the same reply as me , we've got a signature job done now go away .

Hi Rich , Having the same problem myself , expecting a delivery(BT Home Hub) ...no one showed.When I contacted ParcelForce and was told it had been delivered and signed for but they would ask the driver what happened . Now get this , according to the driver he knocked on our door but didn't get a reply but when he was walking back to his van a neighbour directed him to a car that had pulled up and was told that the woman getting out of the car was living at our address so he approached her , she apparently took the parcel and signed for it . I have asked my neighbours if they know anything but have drawn a blank , ParcelForce have investigated and consider this to be an acceptable delivery as no signature was required and they are within their rights to leave the parcel somewhere safe/hidden or with a neighbour . I'm now waiting to see if BT find ParcelForces delivery method acceptable , if they do I suppose they'll expect me to pay for it . As far as I'm concerned its been stolen .

Pretty much standard tactics by respondants solicitors ,they do and will try everything in the book to omit any documentation that is detrimental to the employers defence and that includes lying , its win at any costs for them . Ensure you take copies of all documents you wish to be included in the bundle with you on the day . Unfortunately the Employment Tribunal does little to stamp out these underhand tactics by respondants solicitors and its done to stress you out and wear you down.Good Luck
  7. Entirely up to you of course but personally I wouldn't be in a rush to pay this debt off , its not often a lump sum interest free comes along . write to your ex-employer explaining why the cash is no longer in your account and offer to pay back the minimum you can afford . Happy Xmas
  8. well as I see it its THEIR mistake not yours , obviously it needs to be repaid but on your terms not theirs . As long as you agree a reasonable/affordable repayment plan I don't think there is much they can do . So there you go , an interest free loan .

  10. Shocking that a firm(tesco) that posted profits of over 3 billion has access to free labour , maybe if small businesses or charities were benefiting then these work programmes would be more acceptable .

Same experience with a ET judge here as well , Spent the best part of 2 1/2 yrs getting my ex-employer into a tribunal , after the usual ignoring dates for disclosure and the tribunals orders I finally managed to get my day . Wish I hadn't bothered because within 5 minutes of starting it was blatantly obvious the judge was going to side with the employer . I had a pretty solid case , a roster informing my colleagues of that an "unforseen vacancy had arisen" and were changing their hours to cover the vacancy was put up on the notice board on the day of my dismissal......dated the previous day , the decision to dismiss was pre-meditated therefore automatically unfair . They never gave an explanation in that 2 1/2 years but on the day of the tribunal the manager explained that he never intended to dismiss me but was going to send me on a lengthy training course but changed his mind , this excuse was accepted by the judge. When my union rep questioned this "long" training course the judge shot him down quite rudely saying that the manager didn't say he was sending me on a long training course and that there was difference between long and lengthy . Bemused to say the least . If the judge was prepared to argue in favour of my employer over the difference between long and lengthy I realised I was wasting my time .
  13. That was quick thanks , As I said I've not received anything from Barclays personaly saying the debt has assigned to Cabot (yet) . Am I within my rights to pay nothing to Cabot until I received such a notice ?
  14. Hi everyone , I owe £1500 on a Barclays credit card and have been paying £1 a month for over a year after seeking advice from the CAB and getting on a debt management plan . CAB have now taken me off the plan and I am now dealing with all my debts myself. I'm not intimidated by these firms as I have been reading through CAGs forums but would like very much your input as I want to make sure I'm doing everything right . It would be nice to put the boot on the other foot to be honest . I've received a letter today , via the CAB , stating that Barclays have sold the debt onto Cabot , Barclays state that they can find no record of a formal reduced payment arrangement but recognise that they have been receiving regular payments of a £1 and propose that that I keep to this arrangement for the next 6 months with Cabot . They also state they have sent a notice of the sale of the debt to me but I haven't received that yet. I've never attempted to claim back any charges or ppi on this debt and I'm waiting for Cabot to get in contact , ideally I want to make myself as awkward as possible , anytakers ?
  15. How's it going Ricky ? Best thing you can do is keep a very detailed log of everything thats happening , times/dates and any paperwork . Sounds as if they're cutting a few corners and your best chance at a Tribunal is proving that they haven't followed statutory procedures . Any news of a disciplinary pending ?
