  1. Hi, i really need some good advice on what to do. i was silly and made a mistake about settling up my council tax and stuck my head in the sand. I got two enforcement arrangements made and passed over to jacobs. i set up a payment plan with them which was more than i could afford. they were supposed to take payment every month. I'm not someone who regularly check my bank statements and didn't know the payments had not come out. they said they sent me a letter but i never got one or a phone call. I came home and found a letter in my door saying if i don't pay in 24 hours, that they were going to take my possessions. the debt is for 1700 and i simply don't have the money, i live barely hand to mouth as it is and struggle all the time. it says that if i don't pay in full within 24 hours they will take everything. i have hardly anything of value and the letter even says they will take things even if i am not there. what am i supposed to do? what can i do? jacobs head office says everything is in the hands of the enforcement agent now and they can't/won't re instate the plan with me and its at the sole discretion of the bailiff. what do i do? i have a car i use to get to work, i live in a somewhat remotes area and without it i couldn't get to work. i won't let them in at all but they say they can come in without me there! i tried calling the bailiff but got no answer other than to leave my name, number and postcode and he will get back to me. do i need to stay home to make sure he won't come in? i know i was stupid but i tried to fix it but i don't know what to do. i live in a rented flat with my partner and we really struggle financially. do they have to agree to a payment plan? please give me some advice, please.
  2. Hi first post on here Hope you can help! Received a removal notice of 24 hours today pushed through letter box for council tax business rates 9281.50 +costs Called the enforcement agent just said full amount or will remove property Explained not had any break down to debt nor the amount nor any communications it a commercial property we are doing up had it for 12. Months and still empty and not open He said unless I pay in full in 24 hours would go to court to get committal warrant so have to attend immediately with court officer to magistrates and would be given 6 months prison!! Scared out my life He wouldn't help at all council say it in hands enforcement agency and nothing they can do Help! No communication at all and is he right in being able to have me carted off to court I'm on universal credit my partner on minimum wage and just manage to pay rent and other bills but nothing lest over In dispute with ova as to valuation of property we have converted top floor into our flat now and waiting for a new valuation for business rates
  3. Hey lovely Caggers Just after some advice on how to help my daughter, if you don't mind. She was in a private rented flat but cut the tenancy short, we agreed with her landlord (I was the lead tenant although I didn't live there because she's under 18) Housing benefit was paid up until the date her tenancy officially ended, a month after she'd physically moved out. She stayed with her ex's family until ending up in a hostel with her young baby when her ex headbutted her. Nice eh? there was some overlap between the housing benefit on her flat and the housing benefit she got while in the hostel. She accepts she should have told the original council that she'd moved but at the time assumed her landlord would do it. there's been an overpayment & we're happy to pay it for her. My issue is the council have already passed it to debt collectors (the overpayment was only in July) She's now in a house of her own with her little one and is doing a fab job a as a mummy, but... Question is, seeing that she's only 17, living on her own with a baby and being treated for anxiety and depression, do you think the council would take the debt back from Jacobs and allow us to pay it in full for her direct to the council? I don't trust jacobs not to have whacked charges on top but the last thing she needs is the threat of 'bailiffs' knocking on her door, as they've called themselves. There's no court order that we know of. She lives 4 hours away so it's not like I can just go with her to the council to sort it. I wish she lived nearer but it's her choice and she wants to stay where she is TIA!
  4. hi due to my own stupidity i broke an arrangement with Jacobs bailiffs to repay council tax arrears; (i thought id paid the last one but i hadn't - my own error totally admit that) They sent me a letter dated the 12th November stating that id broken the arrangement and that if i didn't ring them and pay or let them know that they would come and take goods. Now this letter didn't get here till the weekend, as i was at home till friday and then I've been away until today working. I rang up immediately the payment line to pay that last amount only to find they had added on another 75 pounds. What is this for? and how much longer do i have to pay this 75 pounds before someone comes round and demands another 235! i can pay it in the next 24 hours thats not a problem but i need to go to the bank tomorrow to deposit cash before i can do it. Ive had no further contact since that initial letter and i have had no visits for this debt at all so far Thanks
  5. Hi Received a letter today hand posted from Jacobs Enforcement Agents Saying pay bailiff or Removal of goods in 24 hours....Its regarding council tax I had made offers to Jacobs but they refused my 2 offers I rang bailiff and he spoke to me with a bully attitude saying he wants full payment or removal of goods.....I cant afford to pay in full I rang council tax office and they told me they could do nothing its now in hands of bailiffs. What can I do ? Will he return ? Will he take our goods ? How can I get out of this mess ? Any help/info very welcome Thanks
  6. My daughter received a notice of enforcement yesterday dated 6 October wanting £280 by next Wednesday. This relates to an old liability order and she had entered into a payment arrangement with the council whereby the original amount owed was added on to this years bill and weekly payments were to be made. This problem arose when the bank cancelled the DD in error and 2 payments have been missed. She rang the council to explain the situation and to request they take the debt back. She said she would pay the 2 arrears with next weeks payment on Monday via the post office (approx £45). She also reminded them that she was a single parent on a zero hour contract and couldn't pay what she didn't have. The council employee told her she would "try and get the debt back" and went to call Jacobs. After the call she said that they wanted £100 and the council couldn't make them change their mind. I advised that she should ring the council back and remind them that they were in charge of Jacobs and not the other way around. She followed my advice but got nowhere. She spoke to someone else who stated that Jacobs dealt with all arrears anyway (presumably without liability orders also) so it was up to them how much they could ask for. My daughter said she would not pay £100 because she didn't have it, but would bring the payment plan up to date and would pay the council direct. Later today I intend to email the council on her behalf with details of the conversations so she has a paper trail. However, I'm concerned that they're just trying to obtain more fees and will slap the next stage fees on because she won't give in to their demands. Any advice on this would be appreciated
  7. I too am experiencing the might of a Jacobs enforcent Agent. He said he was attending with the police at 5pm today. He did not show up but I spoke to him earlier and i asked for his registration details and ID and a breakdown of all his charges. He said he does not have to provide them. Previous to this, and this action is for a parking offence(which is a civil offence) He said failure to pay in full would result in a warrant being issued for my arrest.
  8. Hi all. Around 2 weeks ago I recieved a letter from Jacobs bailiffs due to non payment of council tax 2 and my previous property. I called them promptly and we agreed, over the phone a payment plan of £20 a week. This was to be paid by standing order and I would await confirmation of the payments and the necessary info to set up the payments. I didn't receive any such info and tried to call a couple of times to no avail. I have now recieved the following notice. BROKEN ARRANGEMENT AMOUNT DUE £694. you have not maintained your arrangement to pay 20 every 7 days. Your arrangement is therefore cancelled and WILL NOT be reinstated. If full payment is not received in 4 days a bailiff will attend to recover full payment or remove goods. I had an arrangement around half a year ago with items levyd at my old property. That agreement was fully paid and settled. So am I right thinking there is no current levy in place? No bailiff has attended my new home. I intend to pay what I owe yet cannot without the right info and confirmation of our agreement so how have I broken a contract? Help! I'm desperate and really worried now..
  9. Hello everyone, this is my first post here although I have been a visitor to this site for a very long time and have made much use of the fantastic advise given. I've tried giving a bit of background without boring you! Last week I received a claim form through the court from the council for a debt of school dinner money from last year. This came totally out of the blue, it's the first I have ever heard of any money I owe on school dinners so I've been on to the school to get figures from them to begin with. The first issue I have is that the claim form stated that 'despite repeated requests by the claimant via letter, invoice and letters before action, and similar requests by the claimants recovery agents, the balance remains unpaid. The defendant has not provided any reasons for non payment.' I can honestly say that I have not seen anything about the debt from anyone! The school normally sends a reminder if we are 2 weeks in arrears and I think I've had one of those a long time ago, but I paid what i owed and didn't hear anything else about it. Now, I've been onto Jacobs and asked to be provided with details of the letters they had sent. I was told that wasn't possible as the case had been closed. I was then told that a bailiff had also called round to my house and left a card when there was no answer. Then today, I have received copies of all the letters supposedly sent by Jacobs, all dated 19.10.12 with a note stating that copies of the originals could not be sent but provided a list of the dates the originals were sent. Also a copy of the letter supposedly left by the bailiff. I'll say it again, I have never seen these letters before. Also, the date the bailiff supposedly called was Easter Saturday, we had visitors staying and there were at least 3 people in my house at any one time all that day and we didn't have anyone knocking the door or any letters/cards left. The woman at Jacobs said the bailiff would have had a GPS pen or something that would position him at my house at the time stated but to see that information I would have to pay £10. I'm sure that mistakes have been made. The claim covers 2 periods of supposedly non payment of dinner money. The second time was for the term before summer. I must have known I owed the money because I made a payment online during the first week of september. The council said they sent a letter telling me I owed them that exact amount a few days later. I didn't see any such letter. I have my bank statement proving I made the payment yet they are trying to put it on this claim form! Sorry for the in depth rant, what I really want to know is what to do about the letters supposedly sent by Jacobs. I really don't think they were ever sent but I don't know how I could prove it. Can anyone give advice please?
  10. Hi I am looking for advice and possibly a way to stop a debt collector trying to force me to pay a full amount which was not actually my doing as a person who lived with me was paying the council tax in his name and then once he had left changed it in to my name but without my knowing. this has now caused debt of £491 owed to the council which I have tried to resolve and pay in instalments but have moved from the property and had no corrispondence until it was too late and passed to jacobs the debt collectors who have been less then fair and aggressive with their methods. what can I do to stop them wanting a full some of £760 in one go and threatening me with court orders and bankrupcy etc. Kind regards Paul
  11. Hi Guys, I have had plenty of experience dealing with Jacobs bailiffs but never for a PCN, it's been council tax in the past. My husband received a PCN through the post but had never had a ticket attached to his windscreen in the first place! The council weren't interested and passed us from pillar to post and the debt was passed to Jacobs. They sent One letter through the post asking for 112 which was the PCN cost only, we were away with work when it arrived and when we got home the Bailiff knocked on the door for his 1st visit and has requested £151.44 in fees plus the £112 PCN! We paid the PCN direct to the council and advised the Bailiff of this via text message. Today we have received a letter stating that there is a balance outstanding of £151.44. As far as I was aware they can only charge a 1st visit fee and nothing else as no levy was made and nothing was signed by my husband. Can somebody give me some info regarding the correct lawful fees they can charge so I can email them to tell them how much we'll be paying and nothing more! Thanks Lisa
  12. Hi I was pointed in the direction of your website and it has been very helpful. I am looking for advice, rather urgently, since i came home from work yesterday, to find a 24 hour removal notice through my door. This was a shock as the last contact i had with jacobs was back in aug 2013, the account was put on hold as i disputed it ( bit of a lon winded reason why, but it was a back dated change a few months after i left the property. I am a lone parent, working part time and my circumstances changed twice, propmpting all benefits to be recalculated, ending in this underpayment) Anyway, I do not have the funds, i have £30 in my bank account. The bailiff has never been into my house, nor, as far as i am aware, made any levy. I have not been given the chance to make any payment plan. ALl doors and windows are locked, burgler alarm is on, curtains closed and car parked a few streets away. I have text the bailiff on the letter, the following: I returned from work yesterday to find a 24 hours removal notice from yourselves. I am quite surprised by this as i have had no correspondance from you since august 2013 where my claim was disputed and put on hold. I do not believe this to be in line with policy and will be making a formal complaint to the council on monday. I al requesting that my account be handed back to the council under the protection of vunerable people act, so my income can be assesed to enable me to make weekly payments. Thirdly, since noone from jacobs has ever entered my property and no levy has been applied, no goods will be being removed. Please provide me will a full break down of ' costs' as detailed on your letter. I shall be emailing a copy of this to your office and to the council. Is that ok? I shall be speaking to the council on monday, but there isnt much i can do before then. And although my house is all locked, im pretty terrified. Can anyone offer any guidance, help. reassurance?
  13. Hello everyone, Just what I needed the week before christmas! The council have a liability order for rates. I fell behind with payments as I haven't been paid for several months. The letter was posted through the letter box, so as soon as I saw it I called them. They said it had to be paid in full and to ring back with payment. I told them that I don't have it, he said they'd be back to take stuff and if they couldn't get anything they'd commence bankruptcy proceedings. He also said they finish on Friday and it would have to be sorted by then. I've tried to ring him again this morning but am getting voicemail. The debt is circa £600. I spoke to the council but they said there was nothing they can do. I don't dispute t, I just can't do anything about it right at this moment. I'm having a read through the forums, but could do with quick advice of what they can / can't do. Really worried that they'll turn up with a lorry and take our car or something.
  14. Jacobs are chasing for council tax. I am in and out of work but for the year Jacobs are chasing for I was actually not only up to date but ahead of my payments at the time of the court hearing. However because I paid over the monthly ammount (ie it did not match exactly the monthly installment) to take into consideration previous arrears the council decided my payments were SOLEY for the previous year because of course I just LOVE having CCJs Anyway in and out of work and I am crap at paperwork. I have had a new contract since August and have been using my payment card to make payment directly to the council it amounts to about £100 per month paid in weekly installments. Jacobs did their first visits although at least one of their letter arrived by post (sadly I didn't keep the envelope) Yesterday I got a call from someone claiming to be the Jacobs Bailiff trying to sound reasonable in that he said did you know a van has been booked to take your property. my response - sorry so what, I am paying the council direct, you will not under any circumstances gain entry and I will not be paying you anything - repeated a few times as he pretended not to understand He even phoned back after a couple of minutes to ask 'are you alright' to which I reiterated what I had said previously he said he would make a note of what I had said about paying the council I get home to a letter with a printed signature allegedly from the chief bailiff Mr E Davies The balance has mysteriously gained over £200 and the letter was short on words but included the phrase removal might take place even in your absence I calmly and coldly scanned yesterdays letter plus a previous one to show the difference in balance, and sent them attached to a long email to my local councillor, MP and local rag The local councillor knows me as he used to serve on the council with my mother what will come of this I don't know When I searched for Mr E Davies on the certified Bailiff register I couldn't find him - nearest is an Ian Davies that works for Jacobs I will continue to pay the council and ignore Jacobs as much as humanly possible - I have put a notice of widthdrawal of implied rights of access The council is using our council tax money to pay thugs to bully and intimidate local residents - its just not on. I know what they can and can't do others will be terrified of them
  15. Hi guys... ..long time no see. ...but yet again I have problems with Jacobs re Council Tax!! Ok here goes.. ..Liability Order granted by Teesside Magistrates Court on 04/06/2013 for £1106.05 plus a £17.50 charge for granting order (£1123.55) Jacobs arrived on the scene on 27/08/2013 and posted a Bailiff Attendance - 24 Hour Notice with a Balance of £1148.05 + Costs written on it..... .....I was away with work at the time. He came back on 28/08/2013 and posted a Bailiff Attendance - Final Notice 24 Hours with a balance due of £1166.05 + costs written on it.... ..I tried to contact the bailiff on the evening of the 28/8 but got his answerphone left a message to contact me the next day.. ..no contact by 11am on the 29/8 I called again and yet again he ignored my call, I left another message with all my details asking him to contact me and he never did so I left it. Then a letter came through the post on 10/09/2013 Bailiff Removal with an amount of £1166.05... ..I ignored this as I had never spoken to or seen the bailiff at my house and so have never signed a Walking Possession Order, let him in or received a Section 4 through the door to state that he'd written my car down as a levy. Today 30/09/2013 I came home to find another hand delivered letter from Jacobs through the door with another Bailiffs name on it.. ...Removal 48 Hours with a balance due of £1357.55!!!! He can't take anything away as my car has been moved to a safe place and he can't break in as I have never let him in to the property (Although this bailiff is the same Bailiff I did let into my property last year when Jacobs were dealing with my 2012 Council Tax) but I feel I should send an e-mail to Jacobs about the fees as the £1166.05 included the 1st and 2nd visit fee as far as I can work out so what is the £191.50 for??? Can someone give me an idea what to send as the last letter I sent to Jacobs asking about fees etc. was in 2012 a nd it was from a now defunct e-mail address so I can't copy and paste it!! Also can somebody just put my mind at rest that this Bailiff they have now sent me who I dealt with in 2012 can't break in by saying he's been in the house previously in 2012 regarding a different Liability Order?? Thanks in Advance Lisa xx
  16. Hi, hope someone can advise me please. I didnt receice a council tax bill this year so I rand the council in April and told them. Said a bill had been sent and would send a copy. I still didnt recieve one so in May I requested it again but still didnt receice it. The next thing I received was a letter stating that it was going to court for non payment and then a letter stating that they had received a liability order. Within a couple of weeks I came home from work to find that a bailiff from Jacobs had pushed a letter ghrough my door (not in an envelope) stating that they had been to levy for the outstanding balance but I could still pay by instalments if i allowed them in and would cost £50. I rang them and explained that I had never even received a bill etc...they just said well its with us now and you still owe the money so we will visit again. I rang the council again who again said the bills and reminders were sent so basically tough and Jacobs are dealing with it now. I called Jacobs and they wouldnt accept anything less than £200 per month for a bill including charges of £904. I eventually received the original bill after my last call to the council. I sent a cheque for £200 for the end of Sept as arranged which hasnt been cashed and yesterday I received a letted from Jacobs infirming me that they have sent an attachment of earnings order to my employer!! And they have requested it be paid to Jacobs. How can they use an attachment of earnings order given to the council for themselves? Surely as this was gdanted to the council it cant be used by Jacobs to be paid to them? Or can they?? Wouldnt they have to obtain their own AEO? Any advice on the whole mess would be really grateful.
  17. hi iv received a letter from jacobs the turned down my offer of 80 payment, and the said the minimum payment the can consider suitable is 167 per month the debt is for 880 ct and the want my payment with in 7 days,as my husband as lost his job its only my income coming in,and the council said when i rang them said its got nothing to do with them and to sort it out with the bailiffs, iam not sure what to do
  18. Hi, firstly apologies if im posting in the wrong place. Ive received a letter as above from a debt recovery agency chasing a HB overpayment from 2002. im lucky to have a reasonably good income and ive never fallen behind on any debt whether it be my mortgage or credit cards etc. now im not disputing that this debt may have existed as the 2 month time period that it is referring to is around the time i had my son and times were much more difficult for me then. what concerns me is that 1, ive never had anything to tell me that this debt exists until now (11 yrs later) and 2, if i pay the money to Jacobs am i just lining the pockets of the recovery agency not actually paying the debt to the council? the letter itself is quite frightening. it advises me that they will take court action against me and that i will be liable for further court costs etc. finally ive got a good credit history and i really dont want it to be affected by something like this any advice will be welcome thanks
  19. Hi all, desperate for some help. basically we have had the worst couple of months here. i got behind on lots of bills, council tax included. my c. tax went to magistrates court, and was passed to jacobs Baillifs. this all happened so fast, i thought i had more time. i missed payments in april, may and then june. this is for my council tax from april this year until march next year, so the entire 2012/2013 bill they now want off me this morning a bailiff put a hand delivered letter thru my door at 8am. they didnt knock on the door, they just posted the letter. its a bailiff attendance 24 hours liability order. says i have to pay them £1340.88 in full. says they will accept a payment plan, BUT apparently the only way they are willing to do that is if i let them into my house ( never going to happen ) , and, " sign the relevant paperwork ) I tried calling the council debt recovery and pleaded them to take the debt back, but they refused. Basically, i can in no way pay the whole amount in one go, and thus pay my council tax right up to next march. Apparently , according to the bailiff letter, my only options are to pay in full + costs, or let them into my house and pay them £50 to allow me a payment plan. I just dont know what to do. was paranoid all day and kept the doors and windows locked, but i cant really live like that. can anyone please give me some advice ? im in bits and mega stressed over it . my wife also recently had a heart attack and is meant to avoid all stress. is there a way i can pay installments without letting them into my house. as of right now, i have not phoned the bailiffs back. didnt want to leg myself up and enter into some kind of contract on the phone with them accidentally. i just cant see how it can be fair to tell me i have to pay all up to next years c, tax i dont know what to do. please help
  20. Hi everyone:help: Been a member for a long time and once again i come to this forum which has helped me and supported me so much in the past and to say i am very grateful for all your help. Which brings me to why i am asking for your urgent help today! sorry it is long !! In june 2012 i parked my car in a council pay and display car park and went 16 mins over my time after being locked in santander bank while the security people filled the cash machine etc which took about 10 mins. So i would have probably been late back to my car but by less time. I received a pcn stuck to my window with pictures taken of my car. the fine was for £35 if paid within 14 days then it would go up to £70. I was really upset at the time as i had only recently just lost my mum who lived with me, and my sister had just refused to help me pay her funeral costs, i also had an undiagnosed mental illness for which i am still being treated and with the death of my mum i had a nervous breakdown and I receive DLA and income support. with all this going on at the time i totally forgot about the pcn and didnt hear anything else about it until just over a week ago. when jacobs bailiffs put a clamp on my car and a note through my door at 7.30 am when i was still in bed. I had no opportunity to speak to the bailiff or to ask him anything whatsoever. The notice stated that the bailiff would be back at 5pm to take my car away and just gave me a mans name and a mobile number to contact and an amount due of £294.94. I was so shocked i just started shaking and crying and i was physically sick, this is how my mental illness affects me i can not deal with things like this especially coming out of the blue without warning. I had an appointment at the hospital at 10am and missed that because i had no way of getting there because my car is my life line because of my illness I can only go out using my car, because i get panic attacks on buses etc. (I know it all sounds really pathetic doesnt it? But unfortunately it is true, but unless you have ever had a breakdown or suffered with a mental illness it is hard to understand how someone can be so dramatic over things that normal people just deal with. Its so frustrating) I was so hysterical i phoned the bailiff and asked him to take the clamp off told him about beig vulneralbe told him i had hospital appointments and he just said basically nothing to do with him and told me to borrow it off my parents and i told him they were both dead and didnt have anyone to borrow that kind of money from he said sorry nothing i can do. my husband calms me down and rings the bailiff again and tells him that i am a vulnerable person a nd really upset and that it was an oversight that i never received the NTO so had no opportunity to challenge the pcn or pay it, so could he please contact his client the council and let them know the situation that i fall into 3 of catagories of a vulnerable person and ask them to recall the debt to then be collected by a method which is non-confrontational). and remove the clamp because i had an appointment at the hospital. and a few more in the next few days. The bailiff said NOPE! He said it was nothing to do with him he was acting on behalf of his client and it didnt matter to him if i was a vulnerable person or not, because the council would have checked that out anyway before instructing him. and if i wanted him to remove the clamp then i would have to either pay the full amount or ring the council and get them to contact him with instructions and if i didnt the car would be towed at 5pm. so my husband rang the council and he said it didnt matter if i was a vulnerable person there were no laws about vulnerable people they were just guidelines and were optional wether they chose to follow them or not and there was nothing i could do and it was too late to do anything now so pay upmy husband couldnt believe this guys attitude. we got some advice from a friend who told me to complete an out of time application and witness statement and submit it with evidence of my illness to the TEC (Traffic Enforcement Centre). which i did immediatley on the 12th of june 2013. my husband then informed the bailiff. to be fair to the bailiff he said he wouldnt take the car at 5pm that day but would leave the clamp on and but said if he didnt hear from the council by the following day he would come back and take it. We heard nothing back from the TEC so pestered the council all that day and informed the bailiff wo again said he would not take the car now until he heard from the council then finally on the 21st of june we received a letter from the council stating that they had rejected the application and sent it back to the TEC for their decision and until that time they asked the bailiff to suspend enforcement action and remove the clamp whilst a decison was being made about the application. But my husband had already removed the clamp the day before without damaging it and put it in our hall on a towel. The baliff returned to remove the clamp and started shouting "where is my .........clamp, you better not have damaged it, have you cut it off ? I bet you have you ......... who do you think you are"? I was upstairs at this time shaking like a leaf and crying my heart out. thinking he was going to beat up my husband because the bailiff was a huge gorillla type! My husband calmly said "no i have not damaged your clamp", and handed it to him still on the towel. The bailff calmed a little and said" How did you ....get it off then"? so my husband told him. with that he said he would probably be back and drove away. For a few days we had a breathing space and i was waiting to get a letter from either the (council or the TEC) when out of the blue i instead i got a letter dated the 1st of july from jacobs saying that the council had instructed them to carry on with enforcement action AND I had seven days to pay up (but not stating anything about the decision from the court officer at the TEC). (I thought that the council or the TEC had to notify me first of the decision before instructing the bailiffs)?????? My friend advised me yesterday to fill in an n244 form and submit it to the court and advise the council and text the bailiff as to what i had done and not to continue enforcement action until that has been dealt with by the court but i believe that even though i have submitted the n244 it does not stop enforcement action, therefore i dont know what to do we have been hiding the car every day and i just cant go on like this i jump at every noise and if the door goes i am reduced to a shaking mess i really cant cope with all this it is making me really ill. i just want to pay the £70 the original pcn which i have offered to the council on the phone and on the original out of time application and over the phone to the council man and to the bailiff. but they have all ignored me i can not pay the amount they want. but none of them care and i dont think it is right to put someone through all this for going 16 minutes over my time in a car park at 4pm in a virtually empty car park. i was not causing the council any loss or obstruction by doing what i did but i feel like a criminal like i have robbed an old lady or something; please help i really dont know what i will do if the n244 doesnt work or they take my car in the mean time thank you and sorry its so long i just wanted youu to have all the fact s thank you again cher69:???:
  21. I owed £1000 to bedford county council for last years council tax (this years is now DD) We recieved a letter at the begining of may asking us to contact the bailiff directly due to a missed payment to Jacobs, which ended the payment agreement. i tried to pay through jacobs website but it wouldnt let me, it just came up with a message saying 'ring the bailiff' I rung the jacobs call centre who said i needed to speak to the bailiff, , i rung him but got his voice mail so i left a message stating who i was and to contact me. I didnt hear back from him. A week later theres a knock at the door and the bailiff wants £1110. I explained that i didnt have that sort of money, im on maternity leave. He said that he could split it into three monthly payments but that was it. He also stated that he was having problems with his phone and wasnt always able to hear what his voicemail said which was why he hadnt returned the call. I managed to get £1000 together, rang the bailiff and managed to get through to him and payed him over the phone. The plan was to pay them the remaining £110 on payday this month (26th) However i received a letter today stating that they are coming to take goods to the amount of £110. I rang the office, spoke to a very rude guy who said you need to pay the amount and wouldn't listen to a word i said. I rung back and spoke to a lady who explained that as the bailiff had come to my door that i had to pay the £110. So all in all, Do i have to pay this £110 bailiff fee? even though he never stepped foot in my house and it was his fault that he didnt ring back? If he had returned my call i would have been able to pay him the £1000 that they were asking and it would have closed the account.
  22. MOD's, if this is the wrong forum feel free to move. Hello. A friend of mine has fallen behind with payments with his Council tax and a letter arrived on Thursday from Jacobs Bailiffs.. It's an issue of liability order for £1064. They say the order was issued against him on the 11-06-13. This is the first contact with Jacobs and they have given 14 days to pay.. Now as far as the council side of things goes, with info iv'e got from CAG and other forums we're confidant that the issue can be resolved with the council direct, but i am unsure about Jacobs with them being an agent of the council. I know they are capable of underhand tactics like many others but on a personnel note i think they should be ignored... Any thoughts on this... Thanks...
  23. hi, I received the following letter today (I don't live at the address it went to, its my parents address where I lived previously. It is for a parking ticket, I received whilst at hospital giving birth! im 99% sure I had my blue disabled badge displayed at the time. This is the only letter I have received and it seems somewhat excessive. I am so scared they will go to my mums tomorrow and she will panic and pay the whole lot. I do know my rights to an extent, ie they cannot gain entry forceably etc and can add fees for a visit and levy but they def not levied.
  24. Hi everyone, I apologise if I have posted this in the wrong place, it's my first post on this forum (I'll try to keep it short) My partner and I have received letters form Jacobs regarding council tax arrears, I initially spoke to the bailiff as instructed to make a payment arrangement and to ask legitimate questions (i.e. there was mention of a warrant, entry to home etc is she authorised by the court, is this just like a debt collection thing?). She was very rude and angry at me, she claimed she didn't have the paperwork and she wouldn't send a letter if she didn't have authorisation to levy my goods by force and that I cannot make a payment arrangement unless I allow her to do this voluntarily (And pay £50 that day). She never returned like she promised, the person at the council I tried to contact had been in an accident and didn't call me back and I generally forgot about the whole thing after 4 or 5 days (Foolish). Now 1-2 months later there are letters claiming they were coming to remove my goods within 48 hours then 5pm the same day, they never arrived. The council also send me letters regarding the same debt asking for payment (???) and took it to court (Liability order?) In short, I want to make payments but I don't want to accept a levy from a bailiff, I would much prefer to pay the council directly even if it means making sacrifices to pay more (I lost my job last month) - One company offered to arrange this for £130 and have the bailiffs dropped so I imagine it must be possible to pay without accepting any levy? Maybe a long winded way of asking, how do I resolve this situation without going through the bailiffs or do I do what some people have advised and just let them in the house and sign the paperwork? P.S. I'm hesitant to speak to bailiffs again because they're rude, intimidating, angry and well seemingly they're liars too. Much Appreciated, HelloSpeakman
  25. Hi all, A friend of mine had a payment arrangement with Jacobs Bailiffs over Council Tax Arrears. The arrangement was to pay £40 per week. Just before Christmas she broke her leg and has been unable to get out of the house. This has caused her to miss 3 to 4 payments. Yesterday she received a letter dated the 03/01/2013. The contents of the letter are as follows; *************************************************** Dear Miss * ********* You have not maintained your arrangement to pay £40.00 every 7 days. Your arrangement is therefore cancelled and WILL NOT be re-instated. If FULL payment is not received within four days, a bailiff will attend at your property for the purpose of collecting the full payment or removing goods for sale a public auction, which will incur additional costs to you. PLEASE NOTE: If this matter is now out with our bailiffs there may now be further costs to pay in addition to the balance above. *************************************************** She telephoned Jacobs explaining the situation and offering to pay £100 immediately. The person she was speaking to said it is to late now and that the amount can only be paid in full. They want her to pay £575.04 in full, this she cannot do. I have advised her to only deal with these people in writing. I am also going to draft a latter explaining the mitigating circumstances and an offer of payment to catch up with the missed payments. Any advice appreciated. Regards
