Just new to CAG and have been battling with BOI for several months now. Have followed all the correct procedures and was offered what now seems to be the norm, £500. Obviously I refused, started a 'Small Claims On-line' application and have now had the bank dispute the case.

 

The case has now been transferred (Civil) case and I have been asked to appear in court on Aug 9th.

 

Found a friend already in CJ who is going to review the bank's dispute.

 

I hope this can be settled beforehand, based on some cases that I have read about already.

 

Will update the thread tomorrow with copy of dispute.

 

Anyone out there in the same area, speak up as I would like to hear you about your case.

Here is my copy of BOI's Dispute....

1. The Respondent's correct title for the purposes of this Claim is The Governor

and Company of the Bank of Ireland.

2. The banking relationship between the Applicant and the Respondent is

.governed.byjerms. and. conditions which permit the application of usual bank charges to include charges when the Applicant is in breach of those terms and conditions. The Respondent maintains that the charges were correctly applied in accordance with those terms and conditions.

3. The Respondent denies that the charges applied to the Applicant's account

were applied pursuant to an unfair term of a contract.

4. The Respondent denies that the terms and conditions or any one or more of

them governing the relationship between the parties are unenforceable or

unlawful by virtue of Unfair Terms in Consumer Contracts Regulations 1999,

any Statute, Regulation, by virtue of Common Law or otherwise.

Hi There, I've just had a reply from BOI offering me £250 - I'm claiming £675, want the lot. Just sent LBA today. I'll be interested to see how you get on, let's keep in touch.

Prelim letter sent to Ulster Bank for £1734.00 on 18 September

Received offer of £150 - 30/09/06

LBA sent 02/10/06
