  1. Well Done But I see they just used bully boy tactics! An absolute disgrace. What did the Judge say about all this, or did he let her fire away on all cylinders? Did he mention anything about your court bundle or whether you had put in an adequate case? Did it even get that far? Good to know, so that I know what to expect?
  2. Hi Mate Good luck tomorrow. One thing I have noticed from the 2 cases in England that the Banks won, is that the claimant didn't/couldn't provide enough or good enough evidence that the charges were excessive. So make sure you can provide evidence to back up your claim. In the ROI, the BOI only charge approx. £8 for 'UnPaid Items', etc while in the North they charge £38. This is an area you can focus on. Let me know how you get on.
  3. Hi Mate I've been advised through a couple of sources to lodge a complaint with the Financial Ombudsman. You can download the complaint form on-line then complete and post. I believe though, that there is a backlog of such complaints and it may take some time. But with these guys breathing down their necks may get them settling quicker. I know of one case where the settled once the Ombudsman got involved. Good luck.
  4. Hi Mate Keep at them as they appear to following the same pattern with all claimants. As you will see, there are some who have went the whole way and the bank appears to be defaulting at the last minute. So Good luck.
  5. Here is my copy of BOI's Dispute.... 1. The Respondent's correct title for the purposes of this Claim is The Governor and Company of the Bank of Ireland. 2. The banking relationship between the Applicant and the Respondent is .governed.byjerms. and. conditions which permit the application of usual bank charges to include charges when the Applicant is in breach of those terms and conditions. The Respondent maintains that the charges were correctly applied in accordance with those terms and conditions. 3. The Respondent denies that the charges applied to the Applicant's account were applied pursuant to an unfair term of a contract. 4. The Respondent denies that the terms and conditions or any one or more of them governing the relationship between the parties are unenforceable or unlawful by virtue of Unfair Terms in Consumer Contracts Regulations 1999, any Statute, Regulation, by virtue of Common Law or otherwise. signedMiu-x
  6. Hello mate Just to let you know that I'm in the same boot and got the exact same reply, word for word, from the BOI sols. So I'll keep an eye on your case as I don't have to appear until Aug 9th. Good luck!!!
  7. Just new to CAG and have been battling with BOI for several months now. Have followed all the correct procedures and was offered what now seems to be the norm, £500. Obviously I refused, started a 'Small Claims On-line' application and have now had the bank dispute the case. The case has now been transferred (Civil) case and I have been asked to appear in court on Aug 9th. Found a friend already in CJ who is going to review the bank's dispute. I hope this can be settled beforehand, based on some cases that I have read about already. Will update the thread tomorrow with copy of dispute. Anyone out there in the same area, speak up as I would like to hear you about your case.
  8. Hi Jackster - Just new to CAG but I've also stated a claim with BOI and they too offered me £500. I've since refused their offer and stated a 'Small Claims On-line' application. The bank have disputed the case and I have been set a court hearing for Aug 9th in Belfast. So I'll let you know how it goes (although I'm in the States on this date!!!)
