      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

two more things. I can see that I had multiple agreement, a term I did not previously understand. Secondly I need to report a success from Egg. Son's account fully settled last year through debt collection company but after finding the old agreement when clearing out last month saw it had PPI. Went back and claimed and got him back £500 in one letter which he accepted as he was skint! I am contributing to thread for "Egg agreements -what do I think is wrong with them thread at the moment " and have a Cahoot thread. Can't cope with anymore at the moment as fighting Egg on two other agreements.

Having spent weeks reading and digesting the excellent advice/info on the PPI thread I am happy to report 2 successes!

 

For myself the return of a single payment + 8% from a First Direct Loan.

For my daughter mis sold PPI on her credit card.

Been requesting ppi refund on loans and credit cards for old accounts over 6 years old with Lloyds TSB since september 08. they seem to have split my claim into three claims, one for loans and two for credit cards or so I thought.

 

Eventually received letters rejecting my claim for loans and credit cards. Then out of the blue received a letter about the loans, but writing to me in my maiden name. It seems two people were dealing with my loans claim, one in my married name and one in my maiden name, the original name on the accounts. The person dealing with me in my married name had rejected the claim.

 

Then about a month later got an unexpected letter from the person dealing with me in my maiden name who wrote and said they were upholding my claim and return premiums plus interest!

 

The thing is they are not different loans, both people were dealing with the same loan accounts!!

 

Had the first of the two refunds today. No interest though. When I rang they said the interest goes into your account seperately and can take upto 21 days!

 

Expecting a total of about £2.5k :-)

 

FOS are still dealing with the credit card side of the claim so will have to wait and see what happens

I received confirmation today of refund from Halifax for mis-sold PPI on a secured loan - just over £1300!

 

I'm absolutely delighted as times are hard for us at the moment and this money makes a lot of difference.

 

Only took one letter and about 6 weeks - all thanks to this site. Will be making a donation as soon as the cheque clears!

Ihave just made a claim through the Financial Ombudsman for missold PPI on Lloyds TSB in 1999 - ten years old!

 

Same here! well mine went back to 1998! I had 2 Lloyds loans with PPI added to the total amount of the loan and FOS have just written to say that lloyds need to pay it back plus the 8% interest and £200 goodwill payment. Apparently they say lloyds will take 12 weeks to pay it though!

30 Jan 09:First letter to MBNA sent

05 Feb 09:Received an standard 'we are investigating your complaint' letter

20 Feb 09:Followed by a negative response from MBNA advising if unsatisfied could take up with FOS with the paragraph re outside of the time-limits.

25 Feb 09:Complaint form sent to FOS

20 Mar 09:Letter from FOS advising investigating further with MBNA

15 Apr 09:MBNA confirmed an offer of a full refund of premiums paid, along with associated interest plus interest at 8%

18 Apr 09:Sent settlement form back to FOS

09 May 09:Letter from MBNA advising refund of premiums since inception date £1,827.17 associated interest £422.79 so £2249.96 credited to account. A cheque for £791.14 being sent in the next 7-10 working days. Total refund £3041.10:D

 

Thanks to everyone on this site who gave me advice on this forum. Donation on its way once cheque cleared.

Very very well done! ... & thanks for putting your timelines on here. I have been sent a 'questionnaire' from BARCLAYCARD re my ppi re-claim. Can you believe they have not got records (so they say) the form is like war & peace. Shall I just go straight to the ombudsman? or write them a letter back saying i will do this first?

I've won against Firstplus!!!! I received a letter from the FOS today and they have upheld my complaint. Firstplus are not making any admission of liability and are making the offer of full settlement as a gesture of goodwill. The FOS have instructed that they must put me back in the position I would be in had the PPI not been apllied.

The FOS also considered that I should be paid compensation for the distress and inconvenience. Firstplus have refused to pay the compensation.

I can take it to the Ombudsman or accept the offer. The method in which they should calculate the refund is attached but I can't work it out. Is there anyone out there who can help. I will PM you with the figures if so.

Hi Guys,

 

My mate has just had a PPI claim won against Lloyds TSB. It was on his loan he took out in 2004. They have decided to refund all of the monthly insurance instalments he paid which is great. However there is one bit that he doesnt understand and that is the bank has said in addition to the refund of instalments that:

 

'I have calcualted and paid the difference between what the settlement balance would have been on your loan account at the date of cancellation, had the insurance not been included on your loan. I have deducted this from the actual settlement figure net of your insurance rebate. This means that had you not purchased insurance you would have reduced your settlement figure of £675.80.'

 

That is the first point of the letter and that's what he doesn't uderstand. I have never done one of these and so I don't understand either. The letter then goes on to the second point which talks about the amount paid in premium instalments which obviously we understand. So is he also going to get £675.60 refunded as well as the premium instalments he paid. They are also giving him a few hundred quid statutory interest which is quite good.

 

Any help appreciated.

I don't think he is going to get £675.80 as well - what this is (I am pretty sure) is the amount he would now have to pay to settle the account once all the PPI pricipal/interest/repayments have been taken into account.
