    • I've completed a draft copy to defend and will post up here for review.  Looking over the dates and payments this all stemmed from DVLA cancelling in Feb , whereby I set up a new DD in Feb hence the overlap, why they cancelled when I paid originally in Jan I have no idea. Anyway now stuck with pending court action and a suspended licence . I am also firing off a letter to DVLa recorded disputing the licence revoke

I know all my DVLA details are good. I recently (last year) renewed my license, and my car's V5 is current with the correct details; the same is valid for my partner.     • Good morning all, No further communication with P2G so now submitting my small claims action. Would be grateful for any feedback on my description of claim before I submit later. The defendant in this case is Parcel2Go Limited The claimant sent a parcel using Parcel2Go Ltd as a broker and Evri as the shipper containing two handmade bespoke wedding trays to a customer with tracking number P2Gxxxxxxxx. The parcel was never delivered although the defendant stated that three attempts had been made to deliver the parcel.  The claimants customer waited in for four days to receive the delivery but no delivery was attempted. There was no communication with the claimants customer.  Despite many web chats and emails the parcel was not delivered and on the Parcel2Go website it stated that the customer had refused delivery. This was not true as no delivery had been attempted.  I was informed that the parcel was being returned to me but after waiting three weeks was informed by Evri that the parcel was lost. I was offered compensation of £20 + shipping fee which I refused and after sending Parcel2Go a Letter of claim this was increased to £75 which I also refused. It is clear that the defendant is responsible for the loss of the parcel as they did not act with reasonable care and skill when handling the claimants parcel, contrary to section 49 of the Consumer Rights Act 2015. The claimant therefore seeks £370 in respect to the value of goods plus court costs. I thought it might be better to use the CRA rather than the Supply of Goods and Services Act as we are sole traders - is this correct?
    • No new development, I'm afraid. The last update I received was a letter from the court, advising that the case had been transferred to Croydon County Court.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If this is not the case, and the Defendant truly believes that these charges are lawful, then the Claimant contends that the Defendant is mistaken. As the Claimant only became aware during February 2006 that the charges debited were unlawful, then section 32(1 Xb), or section 32(1 )©, of the Limitation Act 1980 should apply, and the charges debited are therefore within the primary limitation period.

It has been used by many as part of a POC or witness statement and the last half should read:

 

As the Claimant only became aware during February 2006 that the charges debited were unlawful, then I hold that section 32(1)(b), or section 32(1)©, of the Limitation Act 1980 should apply, and that therefore, all of the charges debited fall within the primary limitation period.

Hi Tanz, you mention February 2006 when "we/claimant" became aware that the charges were unlawful and Zootscoot mentions 21st March 2007 when the revelations were made public. Which date do you think we should we be quoting in our POC? Cheers ROS

b). Alternatively, the Claimant seeks to rely upon s.32(1)© of the Limitation Act. The Claimant paid the charges in the belief that they reflected the true cost of administering the contractual breaches. The Claimant has now discovered, following revelations relating to a similar organisation, that the true costs are much lower and that the belief held by Claimant was in fact mistaken.

 

It is thus submitted that in accordance with s.32(1)(b), s32(1)© and s.32(2) that the time period for the purposes of the Limitation Act does not begin to run until the Claimant’s reasonable discovery. This was the 21st March 2007 when the revelations were made public.

 

 

That's precisely what I used (and read over the phone) to HBOSplc (a month or so back) when they said: "Sorry, you can only have statements going back 6 years."

 

It was like a proverbial rocket fighting0049.gifup their sweet *SS! They promised me that they would comply with my original S.A.R - (Subject Access Request).

 

The fact that they haven't, as yet, is immaterial. The Information Commissioners Office are on their tails on my behalf, now! As can be seen!

Hi All.

This is fascinating stuff.

Some years ago (at least ten) there was a flurry of activity over the miscalculation of the daily rates of interest charged to overdraughts on business and personal bank accounts. This was spearheaded by a bloke called Mark Radin and his company Anglia Business Associates. He found that these interest calculations were almost routinely wrong and that with compound interest added there were often large errors being made on overdraught interest.

I engaged the services of a similar company called Audit (UK) Ltd to do an audit for my business account and we found errors to the tune of about £1400.00, which NatWest admitted to and were prepared to refund. Audit UK then hit them with the ‘whammy’ that due to this over charge they had subsequently bounced cheques and debits and were therefore liable to also refund any and all charges plus compounded interest that had been raised as a result. As you can imagine NatWest back-peddled quicker that Freddie Flintoff on a pedalo, they stuck to their original offer but it was in ‘full and final settlement’ etc. As I felt there was ‘more to come’ I rejected the offer and its limitations. If only this information about the penalty charges also being unlawful was available at the time we could have taken them to the proverbial cleaners, as they were charging me £27.50 a pop back in those days.

The good news is I still have all the paperwork and the correspondence so I am going to have a second go at dear old NatWest and shall hit them with the ‘double-whammy’ of interest charges and penalty charges combined plus compounded interest. I am pretty sure I have statements that go back as far as 1985.

But first I need to reclaim some smaller personal bank account and credit card charges to build a fighting fund so I can go after them properly.

Fascinating stuff, and I think you may have an unusual situation that could cause some big ripples.

Will be fascinated to find out how this one gets handled.

 

I think you could even have a basis in law under something called "duty of care", in that they have failed in this basic obligation, which strenghtens your case for claiming interest above the statutory 8%.

 

I suggest you do a lot of reading, and get some of the knowledgable Mods involved to advise you on how to handle this one, before taking any actions.

Hi all,

 

Just to advise have received Woolwich Mortgage statements back to 1991 without too much hassle on a mortgage redeemed 4 years ago. Need to contact them again as the mortgage was taken out in 1985 so they owe me 6 more years but not too bothered about them as don't think there were many charges then but hey ho we'll see.
