    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Nope deffo Column K .... the only ones you should edit according to the notes on the sheets are .....'Complete the turquoise boxes in columns B, C, D, G, H and I only using the details from your statements'

 

Do you think you could have accidently knocked out a formula somewhere?

I just want to make sure I am doing this right, I have entered the interest date as the date I am being charged, then the actual interest charge and finally the balance for the period in which I am being charged. The charges, as my overdraft went up to 6,000+ seem to be around 70 to 80 pounds a month but the interest on penalties remains quite low...

 

Is this right. Also, the baalance should be a negative number...? Any chance of reclaiming the entire interest amount...?

Need help please! Am doing schedule for credit card and need to change the interest rate to 24.9%. Have tried retyping "Interest 24.9%" but it is still calculating at the 8% rate - what am I doing wrong?! Thanks

hi what do you do if you have had interest or refund paid into your account ie i had 0.47 gross interest paid into my account, also i have tax deducted 0.09 what happens with that and 15.00 charges refund which columns do i put these

I am totally at a loss to understand spreadsheets, interest and everything else thats it happening with my claim.:mad: embarrassed or what!!!!

Have sent the first letter - replied with copies of charges over 4 years - NOT statements.

O/D interest.....O/D Excess fee..........Inpaid cheque........Unpaid D/D

These are the four things that are listed.

Do I claim for the amounts listed?????:-?

Have No idea whatsoever on any exact dates or costs etc., No statements.

Do I need to use a spreadsheet?:-?

Have you entered the interest rate you are claiming?

 

Yes if you bank account balance is overdrawn then enter as a negative

 

Once your spreadsheet reaches the point where the charges you are claiming exceed your o/d then I think it will automatically calculate that you claim back all of the interest charged - this is the interest in column J on the sheet I'm using (claiming contractual compound interest)

On my claim I entered a line the same as you would with the charged and just put 'interest paid' and a negative in fromt of the amount to show it was a refund

 

Do this with the refunded charge too

I hope you don't take offence here but it sounds to me like you are nowhere near ready to make your claim yet - you really need to have a good read round the forum & understand the process more before you start. I spent at least a few months reading before I started & it really helps make things a bit clearer.

 

As for you other Q then yes you will need a spreadsheet of some sort for your claim - which one you use is your choice based on what you are claiming - personally I have used the Vamps ones & they are working for me but there are others available too

 

As for the info you have from your bank then if they haven't fully complied with your SAR request you will need to write to them stating that they haven't done so ... there are letters in the templates library to help with this I believe.

I've just started trying to complete the 'speadsheet with contractual rate of interest', but as I'm working from a Mac, googledoc says it doesn't recognise my browser; anyone else using a Mac to calculate interest and use Vampiress's speadsheets or are there Mac frinedly ones out there?

Hi I have a few questions...:???:

 

Have read through the entire thread so as not to duplicate others' questions but haven't found what I need, I'm afraid! Am using (and struggling with) Vampiress's Advanced Spreadsheet for claiming contractual rate of interest back.

 

1 I'm claiming from the RBOS, they have differing rates for even agreed overdrafts up to £100 free; up to £1,000 - 18.33%; £1,000 to £5,000 - 17.56 % and then unauthorised seems to have hovered around 29.8% over the past 8 years. The only interest free overdraft I've ever had is for up to £100, so do I claim the unauthorised rate throughout (29.8%)or the 17.56% % or what!? There doesn't seem to be space on the spreadsheet for accommodating differing interest rates for agreed borrowing. The bank don't seem to be able to let me know what my various agreed rates of borrowing were over the past 8 years but are checking for me. My question is how do I accommodate this information in the Spreadsheet? Do I average it or what? and if so, how?

 

2 With the complex spreadsheet, are you meant to use both pages? ie the 'Charge and interest' sheet and the '8%' sheet? Do you have to fill them both out? Have filled out the same information on both but I'm not sure why! In the notes section, it doesn't say to fill out only one page, nor does it say to fill out both. Sorry if this seems like a thick question to those of you who know spreadsheets inside-out, but it isn't obvious to me what to do... I thought there were entirely separate spreadsheets for those claiming only the 8% standard interest rate...

 

Sorry if any of the questions aren't appropriate in this thread, but I'm gettng a bit confused posting stuff all over the place and trying to keep a track of who's answered what and making sure I'm in exactly the right thread!

You're doing a fantastic job here, how do you find the time. Its taken me 5 months to start since I got my copy statements from A&L!

Just like Molly Monk tried I could not link to the spreadsheets, tried the google one but it is not simple enough for me:p . It would benefit from entries for the actual charges and the interest with maybe an explanation of how to enter data or ''how to use'' notes. I did Like the labour time and post charge claim so dont be put down, I am a hands on worker;) and a spreadsheet is for picnicing! Have a look at Martins money savers one, it doesn't need much working out to use it, could you do a mod like that?

Yep did gogle the google spreads, didn't see any usefull novice notes, BUT I just found a gread template which I downloaded and filled in the whole six years worth tonight. Mindzai has done a fantastic job on this, so glad I found it. You may want to add charges for time, post and preparation, someone has done a sheet for this too. Let me Know your opinion of Mindzai's compound sheet.

Yes I've seen Mindzais spreadsheet before & it's great! Remember this is just a spready for bank accounts not credit cards :)

can anyone clear something up for me? i've used mindzai's spreadsheet, altho i've only claimed on 1 account and then i only claimed the charges. this time i am entering debit interest(interest paid on penalties). what i don't understand is when i enter the debit interest of say £30.03 that they took from me and date etc the interest paid is £28.25 but it doesn't seem to add the the interst charged on ie the 30.03 + 28.05. now i may be one sandwich short of a picnic, but can someone explain this please?
