    • @jk2054 retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free so I hope dpd will refund them so they don't lose out.   Will keep you guys posted. 
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx  
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So much negativity recently so how about this, if you were in charge of our Country what would you change.

Chose up to 6 things

 

1) I would abolish the Government

 

2) I would have a smoke free UK ( if only )

 

3) Stop this stupid inflated wage thing, specially over paid footballers, no one should have a price on their head

 

4) At least £10 a hour plus for all, stop the £500+ wages,

all equal

 

5) Help GOSH and The Lullaby Trust and any other charity not getting Government help

 

6) ban dummies. baby carriers, cot bumpers, and front facing car seats ( until big enough to sit on own )

 

Could think of a few more things, but over to all you Caggers

2) Impossible, but im with you on "if only"

 

3) Private companies can pay their employees whatever they want. By putting a pay cap on them, you make the companies and directors extremely wealthy and the employees less well off.

 

4) Say hello to sky high taxes and item costs.

 

5) How would that help if you abolished the government?

 

6) Nothing wrong with baby carriers, although i agree with the others.

1. Ban smoking anywhere other than inside private property/in dedicated smoking shelters on private property - no smoking in cars, on public streets, in parks etc. There's incontrovertible evidence that passive smoking damages health so why is making someone else breath in your cigarette smoke anywhere even legal?

 

2. Oblige any company employing more than 50 people to employ at least 1 person who is claiming/has claimed benefits for a mental health problem and 1 who claimed for a chronic illness, even if it's only for a couple of hours a week, and pay them at least the living wage for those hours.

 

3. Insist that all school leavers have at least a basic understanding of how bank accounts, mortgages, rent etc work

 

4. If banning stupidly high wages and bonuses isn't realistic, how about an upper limit based on a multiple of average wages?

 

5. Before handing out money to other countries, make sure no one in this country, especially children, are hungry or don't have a roof over their heads. Perhaps it simply isn't possible to stop any child in the UK from going hungry, but it should never be because of action/inaction by the 'authorities'.

 

6. If only 10% of prescriptions in England have to be paid for, scrap the charge and save all the money that's spent on administering the system.

Agree about the smoking, it is a factor in cot death :(

 

Why should asthmatics have to pay for prescriptions? it is after all a life threatening condition, as for baby carrier I hate them with a passion, I saw someone fall over front wards with a baby in one and it ended up seriously hurt, what happens if you faint, trip? same as the ones on your back

1) Bring dragons back from where they went, they are not all bad !

 

2) Have other countries help us out ( if possible ) instead of other way round

 

3) No more paying a footballer inflated money just to kick a ball around

 

4) Make the Queen let homeless people use the empty rooms she has, after all she does not use them!

 

5) Do more to save endangered species

 

6) Let people retire when they want without penalty's ( if possible )

1. stop the gold plated pensions for mp

2. bring the army in to control the borders and enforce it

3. start cracking down on tax avoidence by companies and individuals

4. scrap all foreign aid and spend it in this country

5. Big one her start looking at local goverment and prune the managers or pen pushers you would save billions

6. start co llective contracts for goods and services for local bodies etc

Interesting:

 

1. Change the voting system from FPTP to the Alternative Vote

2. Make it mandatory that secondary schools teach personal financial management, and a basic knowledge of the UK political and legal systems.

1: make all schools teach children how to mange money and say no to pay day loans and door stop loans

 

2: teach children the basic how to run a home/bake/read and write etc, there are still some who can not

 

3: make them who work in Job centers try find a job and sanction them i f the do not, see how they like it!

 

4 : cut hospital waiting lists if possible

 

5 : make prescriptions free to those who can not afford them or need them to keep alive

 

6: Let parents take children on holiday when they want without being fined or make holiday more affordable
