    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Daniel Hannan hit the nail on the head  -

Freedom includes the freedom to fail. We could become a Singapore, or we could become a Venezuela – or we could become somewhere in between the two, and that will be our decision. That’s the great thing about responsibility as an electorate, that I would rather live in a country where people are free to make mistakes than live in a country where officials who are immune to public opinion tell me what I’m allowed to choose.

I’ve a good feeling about this decade, we have a good Prime Minister and a new Government one that has the strength to get things done and not have to argue the point with the very left wing Labour party.

Of course we won’t always agree with what they do but we will be free to make our choices and can now forget the continual arguments about remain or leave which has ripped this country apart, we will at last obey the voice of the people, all pull together and make this country great again.

The EU aren't funding anything except their own pockets, that is just pennies of the £billions we pay into them being returned.

I wish I shared your optimism. The £ is still struggling and foreign holidays are going to be expensive.

It's all relative. Prior to the referendum, the £ was trading at 1€35 - 1€40. The day after, it dropped to around 1€25 and now it stands at 1€19.

That makes UK goods cheaper and foreign good dearer here so we buy more British, surely that's good

My how you have fallen for it.  It matters not what you come up with, WE BREXITEERS have won, Johnson IS the Prime Minister and

none of your moaning or whinging is going to change that so just get over it, go to the pub and cry into your beer. :)

By the way, it is people like you who give yourselves a bad name. Narrow minded, ignorant, rude and live under bridges

Oh look another whinger.  Why can't you just accept it, you believed all the lies and rubbish peddled by the Lib Dems and Red Party and you lost.

Now just get on with your life and enjoy the bright future.

It matters not to me what happens to this thread, it's just a load of remoaners whinging and throwing their toys out of their prams

and ganging up on the glorious winners of Brexit and the Election just because they didn't get their way

First off a deal is two way, the EU stands to lose more than we do.

Immigration was a factor and not as you would hope to promote on a racist line, it was the totally uninhibited amount of people allowed in

mainly illegal economic migrants who listened to Germanys Mercal who said everyone is welcome knowing that they weren't refugees and

would claim asylum in the first country they came to but all want to come to the UK.  Just take a look at France today.

Meaning of Brassneck in the Cambridge Dictionary

"a type of behaviour where someone is extremely confident about their own actions but does not understand that their behaviour is unacceptable to others:"

This thread is dead anyway, the Article 50 discussion is dead, lets move on.

How about we debate the lies about climate change instead ?

In all honesty, I think the thread has generally been quite civil and has opened up quite a bit of debate.  Its only when Maharg1 gets involved because he's clearly on a wind up.  "Don't feed the troll" has never been more apt.

See, you just don't like opposition.  How can it be a good thread if everyone on here is of the same ilk.

I don't think moderators should get involved at all on threads like this.  They change it to how they want it and the proof is in tobyjugg signature

"Please don't assume what you see here is what I wrote - At least some of my posts HAVE been edited without my knowledge or agreement - or anything showing people they have been amended "

When a moderator with a different political view deliberately deletes sections to change the meaning of a post, that is wrong especially if they do

it and don't acknowledge the fact.  Promoting your view by stealth is wrong.
