Hi to all on this fantastic site

 

I received my first bog off letter and am confused by a particular paragraph

 

"In your letter you claim that we have been acting as your fiduciary, which is not correct. This does not form part of the normal banker/customer relationship and if your claim is based on this premise I can only recommend you seek independent advice"

 

Fiduciary

Law.a person to whom property or power is entrusted for the benefit of another.

Surely the bank has power over my money and the way it is used so therefore is my fiduciary

:confused:

 

Am just about to send of LBA so help as to whether this affects my claim would be most appreciated

Same here when trying to find a parachute account until I tried the Co-op Cashminder Account

The Co-operative Bank : Cashminder

 

Seems a good choice to me. And no problems getting accepted!

 

Anyway. I doubt Natwest would close your account though.

Thanks for that will try them.

 

Amazingly, whilst checking my account today I noticed that a d/d that will have taken £12 overdrawn has been paid yet a couple of months ago a d/d that would have taken us 99p overdrawn was rejected and cost us £38. Are they scared of lil' ole me!

Hi Jolou,

 

Good luck. You could try the Yorkshire Bank, I opened a parachute acc. with them there and then, no credit checks nothing and it has all the normal things ie cheque book, debit card and O/D facilities if wanted.

You do need to be aware that if you qualify for fee exemption, which if you are claiming benefits you almost certainly will, you need to complete a new exemption application for each fee that becomes payable.

 

For example, you fill in form Ex160 (downloadable from the HMCS website) when you first submit your claim. If it then reaches the stage where you have to file an AQ, there is normally a fee of £100.You will at that stage have to complete another EX160 with the required evidence to gain exemption from that fee.

Well I received second Stuart Higley letter this morning

Looks like everything is running along the normal timescale and response of twatwest is same as loads of others

I guess my next step is N1 from local court

O.K N1 form filled in three copies made I will take it to the local court tomorrow and then judging by other threads I've read it's a waiting game. Did anyone catch that program on BBC 2 last night about claiming bank charges They estimated the cost of applying penalties to accounts is about £4.50 and the banks are changing charges to service fee to try and justify the amount of money they are [edit] from us. An estimated four and a half billion pounds the banks are making on these charges. I dont eve know how many zeros that is.
