hi,

 

i'm currently on benefits

 

received a notice of warrant of control and notice of enforcement for an unpaid ccj that I was unaware of.

 

bw legal are demanding £200 per fortnight on a £1480 debt!

is this fair ?

what can i do?

 

the debt is a shop direct account from 2011.

 

any advice welcomed :)

In the first instance, you need to make enquiries with the County Court to establish where the summons had been addressed to. If all correspondence had been sent to a previous address then this could improve your chances of having the judgment set aside.

 

If it is your intention to apply for 'set aside' then you need to be aware that such applications are not automatically granted. The court will consider (amongst other points) whether the debt is one where there is a genuine defence to the claim.

 

Once you have made contact with the court please do post back.

If you are on benefits you should be able to apply to the court for a variation order without any fees being due. You will then be able to pay by instalments based on your income and expenses situation,

and are they court bailiffs or HCEO?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

county court bailiffs are usually quite reasonable

 

have you been able to explain to him what has happened.?

 

 

I take it you had no idea about the CCJ

and sneaky lowells got it on purpose by the backdoor?

 

 

have you moved since that debt was run up?
