You have to put yourself in their shoes for a moment. If this was your only means of making a living living, would you:

 

a) Uphold a reasonable appeal and deprive yourself of money?, or

b) Reject any appeal, however justified, and hope that the victim pays up?

 

Once you look at things in that light, you soon see the futility of appealing.

yes i see what you mean, i was more interested if people thought it may have stood considering the weather conditions and the inability to see any marked bays

 

Well the charge can never 'stand' because it's legally unenforceable.

 

If you mean would they have cancelled it, no. They'd just write back with some rubbish about terms and conditions and how you should have swept the snow away or some such pap.

I have received a letter from Euro Car Parks claiming I failed to pay the parking fine £30 and now it goes upto £50. Claims I was in the Sainsburys car park in Potters Bar.

 

1 Don't Shop @ Sainsburys

2 Never been in that car park

3 Was actually in my car just off the Edgeware Road London delivering documents for a Solicitors

 

Do I communicate with them or just ignore

 

I have complained to the Store and Sains head office but neither were interested and the said car park doesn't have any cameras

Just ignore, and it's not a fine!

hi, could someone help me as i took my mother in law down to the town centre we parked in a euro car park and displayed her disabled badge when we came back there was a ticket on our windscreen when we enquired we were told that they do not provide disabled parking , i have refused to pay now i have received a letter from a debt collection agency, should i take them all the way or pay up, thanks in advance.

Do not confuse debt collecting agencies with bailiffs. Debt collectors are just private citizens with no more power to collect money from people than you or I. They cannot enter your property, they cannot seize goods and they cannot blacken your credit record. If they do turn up at your door then ask them to leave. What form of words you use is entirely up to you! If they refuse to leave then call the police.

Hi guys, I posted on a thread regarding LDK security. Can I assume that these people are the same bracket?

 

I am contemplating ringing them tomorrow basically to say that they hold a photo of the car and it is clearly on public land, meaning they shouldn't have bothered anyway.

 

I know people are saying I should stand firm but as a student it's my mother who is the registered keeper of the car and she is a little apprehensive about taking this path and wants to just pay up.

 

I've heard on another forum if you ring them up, tell them you're willing to go the distance/court, they will give it up as a good will gesture?

 

Edit: I'd also like to hear if there are any downsides to trying this?? People say not to bother and just ignore them, but surely it's worth trying on the off chance something good comes of it? Is there any reason I shouldn't ring?

I'm really just looking for some reassurance and clear, proven, advice because it's all very easy saying don't pay but when you start getting letters threatening court action it becomes alot scarier!

 

Please help/advise.

You can't reason with [problematic]. They don't care what you say, it won't change anything. They just send out junkmail and wouldn't be very good at their job if they gave up following a phone call or letter. They love it when you contact them because they know their letters are reaching someone.

 

Debt collection threats aren't scary. Anyone who has moved rented house has to wade through letters threatening court in the hallway when they come back from work!

 

Show your mum these letterchains so she can see the [problem] in action:

This is the parking [problematic]' means of income. Therefore if they were to allow an appeal they deprive themselves of money. On that basis, I'm sure you can guess just how many appeals they allow ;) The only people who usually advise you to appeal are the [problem] artists themselves, because they like to pretend that there is an air of legitimacy surrounding their industry :rolleyes:

My wife managed to get a Euro Car Parks ticket stuck on the car in December 09 by parking outside of Sainsbury's. She didn't notice the Euro Car Park signs and had parked in a disabled bay near the entrance. She didn't know there was parking enforcement in operation. If she had known she could have put disabled badges on display but didn't. She wasn't stopping anyone else from parking either side as it was unusually quiet at the time and there were lots of other spaces available. When she returned to the car a ticket was on it saying she had been parked there for five minutes without displaying a disabled badge. The ticket was for £50 or £30 if paid within 21 days. I read this forum at the time so we decided to ignore them. 23 days later came the letter saying the amount had been increased to £50 for not paying within 21 days. Recently we've had another letter from Control Account plc increasing the amount to £79.38 and threatening to obtain judgement against her. They state such a course of action may adversely affect your credit rating and would include costs, court fees and interest which may disproportionately increase the amount outstanding. The letter insisted on a phone call to them with 5 days or immediate payment by return post. I assume that was just an attempt to frighten her into paying up. We intend to continue ignoring them and go to court if necessary. I have a question has anyone reading these threads ever heard of anyone being taken to court or having there credit file damaged or do these [problem] artists always give up?

Update 14/2/2010

We have now received another letter from Control Account PLC Stating the letter is their "notice of intention to make a civil claim against my wife". It states "this is your final chance to prevent litigation being commenced against you: if you ignore this warning then proceedings may commence and judgment will be sought". It then goes on to tell her how court costs, interest at 8% etc. etc will be added on. It then says if we still don't pay the bailiff's will be sent in to take our possesions and sell them plus a load of other ways they can forcefully take the money from us e.g attachment to earnings, charge upon our property etc.

Obviously this kind of letter would intimidate many but as for us they have just wasted another stamp.

I followed the advice on this site and ignored their threatening letters. I've heard nothing from them since ignoring their second letter.

They always give up. No chance of court.

 

Two letters from Control Account is the norm, then Euro give up.

 

Please take the time to express write and express your disgust to Sainsburys. Forward them copies of the letters and a copy of your disabled badge and inform them of the distress Euro's letters are causing. Inform them you will never be shopping there again.

Hi, this is my first post but I'd like to say a big thank you to those members of the forum who gave me the reassurance that Euro Car Parks are just a worthless bunch of chancers, out for what they can get without any legal basis. I wonder how many poor Pensioners have been worried to death by the ever increasing threats that these people dish out and suffer real hardship to pay their so-called fines.

For that reason I could not resist phoning them up and telling them just what a worthless job they do, what a shower of sh*t they are and that they could go and swivel before they get any of my hard earned cash.

Harsh I know but it was quite satisfying, the sooner that everyone knows that this is just a [problem], the sooner these people will go out of business and make this Country a slightly better place to live in.

Exploringofficer great minds think alike!. This is my post on MSE from this morning:-

 

"There is an article in the "Money" section of today's Times naming and shaming companies that target disabled and elderly people with their products, such as mobility scooters and adjustable beds. Perhaps private parking companies could be added to that list.

 

From reading on here it seems that some elderly people, when they receive private parking tickets, get really frightened with all that talk of court proceedings and bailiffs and pay up. This is because they grew up in a different era when you could usually trust the correspondence that dropped through your door, and there weren't all these sorts of scams around."

Hi everyone, 1st post here.....

I have been issued a ‘parking ticket’ by these fella’s too, but my incident is slightly different…….

We went to Manor Walks Shopping Centre in Cramlington on 27th Feb at 11:30 to visit the estate agents and do a bit of shopping at Sainsbury’s too. We left after about an hour and a half. We then returned (but as you can imagine, parked in a totally different part of the car park) later the same day around 16:00 as we popped into Argos to buy a few bits n’ bob’s for our children. Upon leaving I noticed a little ‘self sealing plastic bag’ stuck under the wiper. Personally I thought someone had damaged my car and left their details! however this was not the case!

After reading the ticket it said ‘Your vehicle was parked longer than the maximum period allowed’. I managed to locate the attendant and when I asked if he’d issued the ticket, he replied “No. The machine did”. I wanted to laugh at him sooo much but was seething at the ticket. I told him we’d left and returned but we got the reply so many have had in the past – Once the ticket is issued, there is nothing I can do’.

I have since written to them (before finding this forum) and provided receipts for both visits, so we’ll see what comes back.

For those who know the shopping centre will agree it is simply impossible to spend 4.5 hours in there!

Be rest assured I’ll update on here what happens.
