Hi All,

On 19 May 2014, I received an email from MotorMile Finance chasing a debt which I believe will be statute barred in November 2014.

The email states that they note that I have not responded to their previous communications (never had any!), and that my continued default will shortly be reported to all three major credit reference agencies.

The email also states that the file is now being prepared for a notice of default to be issued and then for a Doorstep Agent visit to my property to try and resolve the matter amongst other things....

 

Basically, the loan was from a pay day loan company at a time of a money crisis within my life. I have not paid the debt and not heard from the payday loan company since November 2008. Now I have received the above email and also another one which states -

 

"We note that we have not heard from you in response to our earlier communications.

Your file is shortly scheduled to be transferred to one of our Home Visit Divisions.

 

We are happy to try to resolve this matter without conducting a Doorstep Visit and would ask you to contact us by telephone or email to discuss repayment terms.

 

Please note that if we do not hear from you, then you will be visited to assess your personal circumstances with a view to passing your account to our Legal Department.

 

We would, lastly, advise that if you are able to make a lump sum settlement offer, then we would be willing to allow a 25% discount on the outstanding balance and to waive the default costs and interest that have not yet been added to your account balance."

 

 

I am currently in a position whereby at the end of next year, my credit file will be completely clean - no CCJ's showing and all defaults will have dropped off. I cannot afford to get a default or indeed another CCJ. I have checked my credit report and there is no mention on there anywhere of this pay day loan, nor any default showing.

 

What is the best course of action I can take with this? I have read up on another forum about MotorMile Finance UK Ltd and can see that people have had major problems with the company and that they aren't reliable and/or knowledgable.

 

I also do not want them showing up at my property, however, I no longer live in the property where the loan was taken out. But the only other property is my parents, so I do not want them turning up there, especially when I don't even live there myself.

 

Could someone please advise on what I should do?

Relax

 

Motormouth con people who are unaware of what this outfit are like.

I would ignore them... Just search for them in the top search box.

 

They are renowned for their threats and nothing ever comes of it...

You can send a letter telling them they are not entitled to visit you blah, blah, blah...

 

They have no powers and for that matter have no brain cells!

 

To add, they cannot register a default, only the original creditor can do that... Who was the creditor?

Wage day advance or maybe, the money shop?

Thank you for your reply. Is there a standard letter that I can use about the visit? The pay day lender was Pounds Till Payday.

 

I just can't understand why having not heard anything for almost 6 years, I now have these people on my case. I have never received any letters, just these two emails over the past week or so.

 

I'm just worrying as I really don't want them to turn up at my parents.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I also forgot to say it could be quickquid.

 

IMHO... Ignore them for now... Once 6 years hits, then the DF will be gone.

Wait until something with more substance turns up...

 

However just to be sure... Be honest with your folks in case they start getting phone calls.... MMF believe they can make up the law so ignore.

Just to be clear, i don't have a default from them or any entry on my credit file from PTP. My parents address was not the address where I lived when the loan was taken out, but they will be able to find this should they choose to review my credit file information.

They have no telephone numbers for me either, which is a relief.

I'm surprised you don't have a Default... Or do you, it's just you haven't seen it?

Do you subscribe to Noddle? PTP are more likely to report there.

 

Guarantee you now, MMF Have done a trace search on your credit profile

..

Right okay , thats interesting, Follow mine and DXs advice, ignore for now :)

I have my own bullets for them waiting, I have 3 accounts that were fraudulently set up and they wont write them off even though they have had the documentation!

Ignore them completely, contact with them gives them something to hold on to, with no contact they will never be sure if they've got you or not.

 

 

They are not as easily scared off with a CCA letter as most DCAs are, as others have said they proceed from the basis that they have an absolute right to pursue full payment of whatever random figure appears on their system - whether or not you owe it and whether or not their activity is legal is of no consequence to them whatsoever.

 

 

This company does do visits and apparently does litigate, but it's very unlikely their threat-o-gram cycle will get that far in the 6 months you have left till SB.

 

 

No letters from them is not unheard of - they've been trying to pursue me for a debt which *is* statute barred since last August and they *know* where I live, but have never sent any letters or made any visits, just a barrage of phone calls and emails which all get sent in the middle of the night.

 

 

You're really missing out if they don't have a phone number for you - you wont get to laugh at all the messages that 'Mike' will leave.

Hi. I received 2 emails from this crowd both were automatically sent to my spam box & because I didn't know who they were 1st time that message was marked as a phishing [problem]. I am like you in that I no longer live where the loan was taken out. If the attempt make a doorstep call without your consent then they are in breach of the consumer credit act an must leave if requested to do so. As far as I am aware there is no law of trespass in Scotland.

Theyre not in breach of the CCA. They would be in breach of GUIDANCE on debt collection. If they dont leave when asked, then there would be a possible breach of the peace/tresspass, or harassment if it continues.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

MMF have recently sent an email regarding an old PTP debt to myself. I owed and still have paperwork £200 they now want just over £1200. Again this debt goes back to late 2008/09 and will soon be stat barred.Word of warning though MMF do enter Default Notices with credit agencys where the original lender failed to do so. I have 4 defaults on my credit rating from MMF, they all expire within the next 18months, so i wont be losing too much sleep. However they did issue a County Court Claim against me in respect of one debt which i had sett aside. So be very careful, they may get a CCJ against you in particular if they do not know your current address or if they register a claim against you at a previous property you have lived at.

If they do enter it and the OC hasnt, then you MUST report it. Also remember that with PDL's they normally enter a default minutes or similar to the account being sold.
