I will send a letter tomorrow first class recorded .

 

This was due on the 1st by card payment

but Kenny's took a payment from my old bank account on 30th

for more than what was arranged that in turn bounced.

 

I called them on the first

was told to contact Ken sing to not specialist services

and they stated they would let me know by the 4th

 

I called today and was told that the decision was with my case handler

and they would prob decline the offer and issue repossession

as notes stated issue futuer action straight away .

 

When I paid on the 14th my account will be 170 less than what's on the court arrangement

as I've being paying more than stated and as next payment won't be due until 1st of August .

 

I have last wage slip from previous job and will have new wage slip at end of July

 

I hope I have enough time :(

 

I took this job as its 3000 more a year

 

:( hope I can manage to let them be 2 weeks late :(

You need to state in your letter that you have taken this job to better yourself and improve the family financial situation which in turn will mean you can pay the arrears on the mortgage without difficulty.

 

If your payment is due on the first of the month and you will be paying on the 14th then it is still being paid within the month that it is due.

Hi, draft letter affixed. Make sure you have the right address and department and send by special (next day by 1pm) delivery.

 

 

If you have an email address for the arrears/legal department then copy the body of the letter (and your account number) into the email and send it that way too, just to cover all bases.

Thanks ell you are a life saver .

I will get it sent today .

 

 

I maybe OK if they come back with an answer of yes we will accept the payment date change .

If they don't then I'm off to court again :(

 

 

as I stated the arrears will be less than what is stated on the agreement breakdown .

Kenny's sent a schedule and it states the arrears balance at the end of each month

so end of July states 28462 sticking to the agreement offer .

But because I've paid more each month the balance will be 28216 by the end of July ..

 

They put the cmi up again by £ 4 apparwnlty due to coverr thé court costs from April may :(

I hope they do agree to the date change- I think a judge would give them a piece of his mind for taking further action and heaping more legal costs onto your account (if you have to defend we will ask that costs are not added as the action is unnecessary)

Thanks slot ..they applied the legal fees after the last hearing even when we asked courts not to :(

That's why cmi has gone up again this month .

 

Letter posted . Have receipt.

 

When I called them on Tuesday

I was told the case handler will call me back that day with the decision .

 

No one has called not on Wednesday and not today as yet ?

 

Should I call them as ?

 

It's as if they are ignoring me and prob getting the ball rolling with the further action :( .

 

The obundsman is also fast tracking my complaint and looking into it as we speak .

 

I hope the eviction warrant doesn't arrive until at least the end of the month .

allowing me to make sure September cmi payment is paid (taken on last working day of August )

 

I'm also due a hearing sometime in September to go over all the charges .

The judge orders Kenny's to send in full breakdown of charges to the court .

 

PS maybe they trying to get me evictcted before the hearing for the charges who knows ????

who is looking into my complaint about the card payments online system blocking our payments because of high arrears.

 

I got the dreaded Eversheds letter swell when I got in on Saturday addressed to me dated 2ND August (same day I paid 1000 first thing . Stating further action is happening and a warrant for eviction has been applied for .

My next payment is due on September the first ! I'm paying that end of August so they can't say that's late .

 

I really upset and suffering from anxiety over this .

They probably won't have read the letter yet. I'd give it a couple of days before contacting them. Did you send the letter by email as well ?

Sorry I meant before the letter

 

I was told on Tuesday that the case handler would get back to me that afternoon

and also there was the note at the bottom of the case note stating proceed with further action if a day late.

 

There is no email option as they state it's not secure :(

I 've tried to email before

 

Got a letter today saying Kenny's will try again for the direct debit on the 11th from the wrong bank account again .

 

This will fail and I will be charged another £18 i présumé .

 

I just hope a judge can see when I pay within the month that the payment is due I'm trying my best .

 

should I make some small token payments each week ?

Or just pay the full arrangement amount when I get paid ??

 

I'm already 400 less and be 600 less by the end of this month off the arrears

as I agreed 200 extra each month .

 

Kenny's called me 5 mins ago and said the verbal arrangement of changing payment days was with senior management and I should get a decision tomorrow :(

 

also apparently if I didn't pay by the 5th the arrangement would end !

 

And they have suspended my direct debit for the 11th - they did this I didn't have to ask .

 

senior management will decline my offer I bet and then it's back to square one in court .

 

However at least I will have paid the arranged payments and a bit more each month so hopefully the judge will see this :(

The 14th is only a week away so just make the monthly payment on that day no matter what their decision is. Have you been paying by direct debit since the court hearing ?

Hi guys

Just an update .

I've paid the full cmi and Kenny's want a new income and expenditure and contract from new job and they will send off to senior management to see if they will allow the date change !!

 

 

If they decline then further action will be commenced they have given me 1 week to get all the info together .

 

 

I've asked at work for the contract but the boss has said its still getting sorted :(

Doesn't matter what size of firm it is, you should at least have a letter confirming your statutory terms i.e. hours of work, pay, holidays. How did you know what you were going to be paid before you accepted the job? or indeed what hours you would be working ?

hi guys .

sorry not been on for a few weeks - i have been training .

^^regarding the above elleen i knew about the hours and pay as i have replaced the previous employee who i knew .

 

i have paid kennys what was due under the court order (well ive paid extra )

 

after the last convo i had paid them on the 14th july kennys stated i had to pay by the end of the month aswell in order with the court order (collected at the end of july) as the court order is for the following day 1st of the month .

so after saving up i had the funds available for the end of friday 29th july .

 

on monday evening i checked the bank and the payment hadn't gone out

- i was out with the wife for her birthday and it was 10 pm when i got in

 

i tried to pay via the online payment but it declines my card

i have had complaints about this with them before- s

 

 

i had to call them on tuesday the 2nd of august

i called kensington 1st thing 9.23 today tuesday the 2nd

and was told the direct debit was suspended as i had paid by card the previous month

I could pay by card over the phone .

i did i paid them the full 1000

by card and said sorry

 

i have proposed (court order was £682 cmi + 200 ) i had agreed to pay a bit more as more funds available

 

i was then shocked to find kennys rep informing me they have issued an eviction warrant at 9am on that morning for a late payment

and now further action is going ahead :( and an eviction date has been applied for

because i was 14 days late in july of which i had explained moving jobs

and 1 day late in august due to them not informing me the direct debit was suspended

 

what can i do ???

 

the court order is fully up to date and ive paid £300 more than what was due !

will a judge crucify me for a day late like kennys have ??

 

the next payment will be going out on the last day of august - i get paid on the 14th so there will be plenty of money left for the payment

 

i now have to wait for the rep to call me back to see if senior management will allow the direct debit to be reinstated

and the specialist team who my account is with have stated because of the level of arrears further action is the only option ?

even tho i have kept the court order upto date and paid more than what was due - well kept upto date i have missed it by a day .

what can i do ???

 

please please help and guidance

they can't have issued an eviction warrant at 9 am that morning - they might have taken the decision to apply for one but that takes time. When the rep calls back tell them you are applying to the court immediately to report them for obstructing your payment in order for the arrangement to fail so they can repossess the property !

 

 

If I were you, I wouldn't rely on a direct debit - I would pay by card over the phone for the next 6 months or so until you are confident everything works OK.

Do they have a valid case tho as I was 14 days late in July .

 

I sent in all the paper work income .expenditure and wage slip .and was advised senior management where looking into my proposals .

Nothing ever happened apart from being advised the payment was due at the end of July .

Of which I paid today

 

They required 882.00 and I paid them 1000 .

 

She didnt call back .

So I presume it's bad news :(

 

I have checked the arrears balance and it's 818 pound lower than it was when we went to court

So at least I have that in my favour :(

Help please

Kenny's phoned today and said management had declined my proposals . A day after taking my 1000 payment .

And also they explained I'm not allowed to use the online payment system as I have large arrears . So I'm not able to make a payment .

 

Also got a letter today dated the 2ND of August from eversheds saying Kenny's have applied to court for a warrant of possession :(

My court order is up-to date

And they have used the fact I paid late in July (when I started my new job ) and because I was a day late in August (due 1St ) I paid 2ND August as soon as they called and stated no payment had been made .

 

What can I do

Please help !!

 

They have turned down my proposal of 1000 a month swell - even tho they happily took it yesterday .

The court order was for 892 .oo

They ask for New income and expenditure of which I send them through the financial Ombudsman because he has direct email full stop

 

 

Kensington said they would referred to senior management and keep their eye out or the payment of which I paid.

 

because they take a payment end of July 4 the first of August due date and it failed because of AA suspended direct debit and not been able to pay online August pavement a day late

 

They took the 1St of August due payment was late on the 2ND and because July was late . That's why they have used the warrant .

 

Oh and because the arrears are so large .

They won't accept any new proposals :(

Kennys are out of order here and hopefully the Judge will see that is the case. I notice you said you get paid on the 14th of each month, why not play Kenny's at their own game and call them to make a payment on the day after you get paid, and then later on take them for the interest....
