Paragraph 3 – this is unnecessary because you are not claiming as an entitled third-party. This worries me because it makes me feel that you haven't fully read around because this is a paragraph which you would include where you were suing EVRi as a beneficial third party because you had actually made your contract with Packlink or some other broker. I think you need to revisit and do some more reading. I'm afraid I have a sense that you have simply copied this from somebody else's witness statement without understanding that it wasn't necessary. Please can you post the amended draft. Other than the suggestions above, it looks okay – but let's see it again for a further appraisal. In terms of the evidence, parties bundle, I think it might be an idea to start off with the correspondence with EVRi and then go onto the other evidence. You will have to amend the index page accordingly. You could shorten this bit. Take 19 is pretty well blank and you may as well miss it out also, there seems to be some repetition of emails and the email chain. I think will be worth going through and getting rid of duplicates if you can. 49 pages is a bit long and it would be a good idea to try and reduce the number. I have a feeling that 50 pages as the County Court limit anyway. The judge will be happier with you if the bundle is smaller. Maybe you could reduce the size of some of the images or messages et cetera. You have got several messages which straddle onto a second page so that things like sign off information and standard confidentiality information become orphans. A bit of manipulation and they could be joined to their parents I think. Page 31 as an example. So is page 19. You may only be up to shorten the whole thing by 56 pages – but I think it would be a good idea. 56 pages is, after all, 10%. If you can do more then so much the better

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,:-)

 

I bought Television- Samsung UE46ES6800 from you on 05/01/2013. I now find the goods have the following fault:

Take too long to power on, too slow when changing channels and smart hub don't connect to network. Tv don't recognize network connected devices, slow in all processes...etc..

 

I contacted Samsung directly and after the visit by Samsung Engineer he advised to change the MAIN BOARD, which I don't agree as the TV is only 5 months old and I don't want a repaired premium TV only 5 month old. But after I visited Curry's store later and spoke to one of the manager in store he refused to replace the TV as he says its more than 28 days old and cannot be replaced as per their policy (he was very rude at the visit to store). As last resolution I have to send it to repair to Samsung service center.

 

Now the TV is back from repair center after changing Main Board the above mentioned problems still there along with the picture is really of poor quality now and still can't find any of my network connected devices. I again contacted Samsung and they again booked in for check and says they can't find any defect the the TV is good but when this time the technician who came to deliver the TV also tried to connect the devices but failed and even wrote this on delivery note.

 

So later I been to Curry's store back again and spoke to one of the staff and he promised that store manager will call me next day and took copy of the all documents along with my contact number but as usual they never bother to call me or contact me in any way. :mad2:

 

Can any body please suggest me what to do next.

Update........

 

Hi Guys...

 

Been to Currys store on last Friday and guess whataaa able to speake to the guy who sold us the TV and he is new manager now and his response was exceptional, outstanding... really help full that he even argued with Samsung to give him the code so he can exchange the TV but unfortunately as it was in late hours Samsung Manager said that he is going to call me back on Monday and sort this our....

 

Will update as soon as get a reply from samsung....:-o

Never, never , never buy a TV from Currys. Always buy from Costco. I have the same TV as you which kept turning itself off on it's own. I called them, they went through a list of things to do, I did it, left it a day, still had the fault and they said no problem, take it back for a full refund so I did.

Never, never , never buy a TV from Currys. Always buy from Costco. I have the same TV as you which kept turning itself off on it's own. You got a full refund considering they could have insisted on repair under SOGA, you did well.

 

So TV's from costco never break down then? All electrical devices break down, that's why manufacturers supply warranties.

TV's break down but Costco have the best returns policy in the industry. I was in there the other day and a guy rocked up with a trolley of beer, said his guests didn't drink it at his party and can he return it. Sure, no problem they said. Ok, so it's not a TV but you get the point.

 

And no, I don't work for Costco, I just think that highly of them.

Update guys.....

 

As always the Knowhow customer service is crap. My TV had again shut itself down completely and when the Samsung Service center picked it up I specifically asked them to don't carry out any repair just check it and let me know and let me decide what to do next. But as usual they never cared and repaired it and now the don't want to replace it as its already repaired.

 

Anyway I contacted Ombudsman and they are happy to take this case further. Hopefully this will be sorted out soon.

Update:

 

I got my TV replaced with Samsung 2013 model which I chose to from Currys. After I refused by KnowHow and Samsung to replace the TV I just tried my luck going to the store last Friday and spoke to Dash who actually sold the TV to us and he helped us to replace it straight away within 5 minutes he spoke to KnowHow and managed to get a replacement code which was really impressive.

I really appreciate his effort and care towards customers problem....:-D

Yeah it was a long wait for 2 months and lots of disappointments,

and really annoyed with KnowHow's and Samsungs reply to not replacing but to go for an another repair

 

the Sales Person(Dash) in Currys store, Ancoats, Manchester was really helpful.

 

It was a totally different experience visiting the store last time and speaking to a really unhelpful Manager few weeks back

 

but this is the second time I spoke to Dash and he was helpful both the times and he even asked us to come to him straight if we have any further problems.

 

Its good to know that the store got a really efficient and helping staff like him.

 

I really recommend him.
