      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes all my posts were meant seriously. But please could you outline which part of any of my posts were offensive to benefit claimants?

This afternoon I put a complaint at Jobcentre about my advisor telling me to remove my gaytshirt as he has no right speaking to me like that, anyway when I went in at 4pm while I was doing Jobsearch, an advisor came up to me and he said the following (Shaun, what did your advisor say to you? remove that gaytshirt and put another on, if you come in tomorrow with them tshirts then when you sign on tomorrow my advisor will send my JSA claim to a decision maker and I could possibly be sanctioned)

 

This is a joke, what gives them the right to threaten me regarding sanctions because of a tshirt, I think this is a stupid excuse to sanction me and save money.

seems to me you need a sanction,what a loser.

Why do you keep posting this though, on various forums slightly altering the place, and up dating the date (I take it they are all you) as the story is more or the less same, written in your style.

I could not care less what you look like, dress like, but its sad you waste peoples time with it all.

People wear all sorts at the jobcentre and as already pointed out this time someone has been threatened with a sanction so it can only be homophobic

Homophobia still exists and is a sadly all too common idea

 

In the end we are only hearing one side of this story from this OP !

So you now want to disbelieve every OP? Or is it just him?

Sanctioning someone is terrible and you actively want this inflicted on him? You are just trolling

 

Anyway - I complained and found out that 2 months later there's no record of it and nothing has changed

It turns out that some jobcentres are ignoring complaints so it's best to keep a copy and complain to the jobcentre manager, area manager and your MP if they are likely to be understanding

Keep records of your dealings with the jobcentre as it may help in the future

Anyway OP how many other forums have you posted this on now and have you learnt anything? Or do you plan on wearing these Tshirts just to lose another job and to get sanctioned?

The OP said that was a stint of labour at a charity shop and considering they don't have uniforms they couldn't complain about a tshirts without it being homophobic plus is there a problem with being a member of more then one forum?

As already pointed out people wear all sorts to the jobcentre without the grief and threats of a sanction so why this t-shirt being bad? Again it's homophobic

I used to volunteer at a charity shop and whilst we had no uniform, we had a dress code.

Which is normally whatever tshirts you want based in experience

Actually, no. And we couldn't wear jeans and had to dressed decently.

 

Is this panto now or something?

I have been in loads of shops where people wear jeans and whatever tshirt they like, I have also been forced to labour in them with no mention of dress code

Volunteers in charity shops are putting people out of work.

 

Quotes: "I am working here to keep the dole of my back"

 

"I have been put out of work by the new management policy and now I am on the dole."

 

I can verify the second as I provided the reference for the worker. He is now subject to a reduced benefit after he was invalidated out and now he just gets basic rate. First of all his skills become redundant by the closure of factories and he did well to get job after a period of volunteering for the Wildlife Trusts. I employ him as a volunteer but I create work given a chance but the cut-backs and making it increasingly difficult. More than adequate expenses though.

 

Volunteering is only OK if it you get something out of it.

WP wear jeans sometimes. I mostly don't. I did today after the rain.
