I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've heard of people losing their DLA after being cured of long term disabilities at the ATOS Miracle factories. I'm on ESA at the moment, but if I ever get called for a WCA I shall cancel my claim for ESA. I stand to lose a lot more by having a miracle cure than I do by losing ESA.

 

If the cure was real though I would go for it. Call me a cynic, but I can't see how a French IT company can cure people with long term health problems. I mean if they really could do what they claim they could run the NHS. What a bargain £40m to cure all those on the waiting lists.

 

With their help all the countries problems would disappear over night. In fact they could probably change the world for better. What a waste, their skills only being used to cure a few benefit scroungers.

I bet it doesn't work both ways though - if you've deteriorated (and the report is accurate) I bet they don't automatically increase your DLA.

 

Incidentally, that version of the handbook is out of date since it refers to the original descriptors, but I can't find anything more recent.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

This is a very worrying time for people who get DLA and are then found fit for work by ATOSser.

 

I get DLA HRM & LRC,

it was renewed in June 2012 for another 2 years

but I am currently being migrated from IS onto ESA and have a WCA booked for 13/11.

 

When ATOSser cures me with their miracle hands, I am really worried about DLA then deciding to use that info and stop my money.

 

They didn't send me for a medical this time but renewed my DLA from the doctors report

and part of me wonders if this was down to them knowing I was going to be assessed for ESA

and they could then use that decision to remove my DLA.

 

It is sad when you have to think like that but we know that it does go on and it really isn't right at all.

 

I wonder what the statistics are for people cured by ATOSser who then lose their DLA???

to ask again sorry, if I have appealed a DLA decision can i make a new claim whilst waiting for appeal? (over year away) and if i do will I be auto rejected.

 

Yes you can make a new claim. They may refuse you off hand, but you still have the right to challenge that decision. When was your DLA refused?

the original decision i believe was around 2 months ago now. So by refusing off hand you mean they wont treat a new claim seriously?

As far as I'm aware, there are no time limit restrictions on reclaiming DLA, but local policy may be to automatically refuse claims within a certain period of time unless there has been a significant change in condition - however if you request a reconsideration or appeal it will be looked at properly. Not all areas do this, but if you get a refusal without them even contacting your GP, then it is likely. same used to happen with community care grants in our area - 99% of initial claims were refused, but many were paid on review.
