Arrow Global chasing via Rockwell & Fenton Cooper

Hello, I'm being hounded by Rockwell on behalf of Arrow Global who in turn say they want money regarding a debt with MBNA.

Rockwell have written various times but have now instructed a firm called Fenton Cooper to act. These guys are threatening to advise their client to lodge a CCJ.

 

The last payment to MBNA was on September 2007.

 

From what I have read on these forums it must be at least 6 years before I can claim the debt is SB'd.

Should I be sending Arrow or Rockwell or Fenton a CCA request? How will this help?

 

Hope someone can provide guidance.

Ahh ok. I was going to mention that if it was in scotland, then its 5 years for SB.

 

 

Do you acknowledge the debt, meaning do you admit you owe the debt?

usual threats, how about asking for a CCA1974 for starters, send request with £1.00 postal order (write on the back "For CCA Purposes Only". send snail mail (2nd Class) Recorded Delivery see what they come up with, ?

 

Others will be along I am sure to advise as well, later on after a few months may seek a SAR but not at the moment. Did you have any PPI & Default charges on this account???

Who should I send the CCA to? All three companies or just to Arrow Global?

There are plenty of default charges but I will need to dig up the old paperwork regarding PPI.

 

The CCA should go to whoever is chasing you, in this case Rockwell.

 

Rockwell & Fenton Cooper are all part of the same Company which is Tessera.

 

Once you dig out the paperwork for your PPI reclaim, this should go to the Original Creditor (MBNA), do not get one of these Companies to do it for you (they charge up to 30% + VAT), you can do it yourself for free, if you need any help, post a message in the Reclaim Forum.

Ok, so I have sent them the CCA recorded delivery last Friday and from what I have read on these forums they get 12 days to respond.

 

-- What happens if they don't write back within the 12 days?

-- What can I expect them to write back to me?

Ok, so I sent the CCA request to Rockwell on the 15t June.

Fenton Cooper reply on the 20th(2nd class so I get the letter a few days later...), their letter states:

 

 

"We note your comments and have sought further information from our client.

We will contact you again shortly."

 

Is this all they need to do to be within the 12 day limit - acknowledge me? or are they supposed to produce an agreement within 12 days?

You might want to send a Subject Access Request to MBNA - they routinely shred information after 6 years, so the sooner you make the request, the more information you will obtain.

 

It will cost you £10.00 - they have 40 calendar days to respond.

 

This will help you with your charges and PPI claim as the amounts will be on the statements.

It has now gone past the 12+2 days (Sent CCA request on 15th June) and the only letter I got from Fenton on the 20th June stated:

 

"We note your comments and have sought further information from our client. We will contact you again shortly."

 

Should I be writing some kind of follow up since they have not sent me a CCA.... or have they gone away for good? (I hope).

Then ignore all future rubbish that they send to you until they comply.

As per usual, never chat on the phone either to them or if they ring you, refuse to go through the security questions and say "in writing only" and hang up.
